I have had a termite contract with this company for five years. I have termite damage on my home. The company rep,[redacted], will not pay for repairs.This pest control service is supposed to ensure my home is free from termites. I pay North Miss. Pest Control Service for this protection. Workers discovered yesterday that my house has termites. The company says it will not pay for repairs.I feel this is a contract violation. At the least, it is misleading. Please investigate. Desired SettlementI want the company to pay for repairs caused by termites. My contractor says it would be about $800. I just want the company to keep its word.Business Response Dear Ms. [redacted]: I am writing in response to your letter dated July 25, 2014, Case #40098904, concerning [redacted]. I have enclosed a copy of Mr. [redacted]'s contract with North Mississippi Pest Control and highlighted the areas pertinent to his complaint. When Mr. [redacted] first called us, we immediately went to his home to examine the area. The problem was clearly caused by water damage. Flashing was not installed in the roof area where he had this issue, and water was leaking in. The wood was so saturated with water that our representative could squeeze the water out of the wood with his hand. Our contract clearly states that we are not responsible for water damage. Our contract also states that we are not responsible for any damage caused by moisture. Mr. [redacted]'s complaint has no justification and is without merit. Breached contract on termite coverage. In June of 2014 while having work done on a shed at my home, workers found termite damage. I called North Mississippi Pest Control since I've had a termite baiting system since 2005, which they supposedly check quarterly. The technician saw it and said there's no guarantee and there's nothing he can do about it. I called the office and the manager told me since my current bill wasn't paid I wasn't covered. I had another company check my entire home. Additional visible termite damage was found inside my home. The damage is at minimum two years old. It is within inches of the baiting system North Mississippi Pest Control supposedly checked at my last quarterly inspection. The termite damage occurred while I was under contract which were paid in full every year. The technician came to my home quarterly and left slips stating all baiting systems had been checked and no termites were found. The damage on my home is clearly visible and within inches of the baiting systems. Yet it was not discovered.Desired SettlementI would like a refund on the two years I paid for termite coverage since it was not discovered. I would also like reimbursement for what I paid to have the damages repaired. I have pictures, receipts and two statements from certified contractors stating the damage occurred at minimum two years ago. I paid $390 a year for the termite contract with North Mississippi Pest Control. I've paid $2400 for a new termite system. I am NOT seeking reimbursement for that. However, I'm seeking the $400 repairs from the damage that occured, making the total refund $1180.00Business Response Mrs. [redacted] called out office for the first time about this matter on July 7, 2014, not in June. Out technician went to her home immediately and found that Mrs. [redacted] was completing an addition onto her detached storage building. This additional slab was not treated by North Mississippi[redacted]. Her contract with us (paragraph 3) clearly stated that failure to notify us in writing that she had structurally modified and altered the building would terminate the agreement. The fact that she added onto this building without contacting us in itself terminates her contract with us.As previously stated, we came to Mrs. [redacted]'s home that day she first called our office about this matter. The board shown in the photograph contained old termite damage (no live termites present), and was lying on the ground, unattached to the structure. We have no way of determining if it was pre-existing or new subterranean termite damage due to the alteration of the structure (see contract paragraph 3).The other picture she submitted of the window damage is old damage ans was clearly marked on the inspection diagram of her contract.At the time of Mrs. [redacted]'s original phone call to us about this matter, she was 100 days past due paying for the renewal of her contract. Her contract was thereby automatically voided by the time of her call (paragraph 6 of her contract).Mrs. [redacted]'s complaint is without merit.Sincerely,[redacted], PresidentNorth MS[redacted], Inc.Consumer Response This letter is to state my claims against Mr. [redacted], President of North MS.[redacted].Mr. [redacted] has not returned repeated phone calls and messages and was not even in town when I called the company to report the damage to my shed in July.Mr. [redacted] did not come to inspect the damage to my shed or my home.He has never seen the damage first hand to observe when it occured.He lied saying he would come to my home, but as of this date, he has not.And again, he has not returned my repeated phone messages to resolve this matter.My home was inspected July 14, 2014 by [redacted]. Termite damage was discovered on an exterior window as well as inside my home near the same location.[redacted] estimates the damage is likely more than a year old based on how termites eat through wood. That means the damage occurred while I was under paid contract with North Mississippi[redacted].I am bringing you a copy of my returned check for my termite contract with North Mississippi[redacted] dated April 14, 2013 for $412.24. which covers a one year period.I have paid this company for this contract annually since 2002. Although the account was past due, my history shows the account was always paid in full before the fiscal year of the contract expired. And it this case, the damage occurred while I was under paid contract.North Mississippi pest control did not discover the visible damage, despite quarterly inspections to my home. The visible damage to my window is within inches of the bait system that is supposedly checked to reveal termites.I am also bringing you a letter from [redacted] control which estimates the damage is at minimum a year old.As I'm sure Mr. [redacted] knows, that much visible termite damage the had to occur while I was under paid contract with North Mississippi[redacted] control.I am bringing the supporting documents to 3693 Tyndale to ensure they are received by September 19, 2014 and that my case may be resolved.I would like for Mr. [redacted] to refund my $412.24 for not honoring the contract to discover the termite damage, plus pay the estimated $400.00 to have my window and interior wood of my home replaced.Respectfully,[redacted]Final Business Response North Mississippi[redacted] control honored our contract with Mrs. [redacted].Once again, the damage she is requesting that we pay for was existing damage that occurredprior to the original treatment. lt is clearly marked on the contract that Mrs, [redacted] had withNorth Mississippi[redacted], Inc.Again, her complaint is without merit.
