company)ASF collectedmoney that he owedI wasn't a part of this process, however, if a customer owes money, theircredit card being used has expired and bank service charges are owed, ASF will attempt to getcurrent information so bank service charges can be recovered and money owed can be collected.This is a standard process with any business.AFS does not have the authority to cancel memberships without my permission and or writtenrequest by the consumerAttached is a copy of ASF e-mail, there was no conversation aboutcanceling the contract after payment was madeMr*** did not indicate or Iresponded to his complaint with ASF on December 2, in a timely mannerASF has a copyof our policy and procedures on fileMr*** did not follow policy and procedures.Mr*** signed a one (1) year contract starting January 13, through January 13, 2015which remained open ended after January 13,To cancel the contract after January 13, 2015Mr*** would have to fill out a cancelation form and or write a letter indicating that he didnot want to continue with his membership when all terms and condition of his contract were met."Over a year ago" Mr*** was bound by contract and his membership wasn't paid in fullWe did not receive full payment of his contract, a cancelation form was not filled out, and hismembership cards were not returned per our contract and cancelation policyTo this date, wehave not received a cancelation letter, the cancelation form was not completed and hismembership cards were not returned.The contract is very specific, and Mr*** was provide a carbon copy of the contract withterms and agreements enclosed We also posted a copy of the terms and agreements on our boardright inside the entrance marked "Important "and "FYI."If Mr*** wants to cancel his contract, it is simple, write a letter and mail it to us a longwith his membership cardsHe may also come in and fill out the form and return his membershipcardsIf he doesn't have his membership cards (and 000857) he will be charged anadditional $Mr*** signed the contract and Membership Cancellation Agreement.I trust that this letter and attachments will satisfy your inquiry and if additional information isneeded, it is available for your reviewThank you for your consideration and respect in thismatter.Respectfully yours,Fitness Institute, LLCEnclosure:ASF e-mailNorthPointe Fitness Institute, LtdContract for *** ***
