On Tuesday, Oct 4, 2016, we contracted with Topp's Fence Factory, to have two 8 ft sections (16 Lineal Feet) of common, white vinyl fence installed. Kevin T. scheduled the installation for the following Tuesday, October 11th, however, he didn't show nor, did he have the courtesy to call with an explanation.
So. we called him at the phone # on the Proposal and left a message. He returned our call late that afternoon with the excuse that the materials he ordered from an Indiana supplier was delayed because of Hurricane Matthew. He said the product should be in later that week and indicated that he could do our job on Thursday.
(With many local fence suppliers, it made no sense that a fence contractor would order two 8 foot sections of common, white vinyl fence from an out of state supplier.)
I told him to use a local supplier then.
Thursday Morning (Oct 13) We called Kevin for an update. He said he he had to see a doctor in Ft. Meyers because he had skin cancer.
So, we called again on Friday (Oct 14) and Kevin said he couldn't do it then, either, because he had to visit his daughter up in Ocala.
So, I told Kevin that I want to void his proposal and he could refund my deposit. He said he would send me a check in the mail. We the tried to lock Kevin T. into a date when we could expect our refund. He wouldn't commit. Kevin got real agitated when I suggested that I can meet him at his house to recover my deposit. He said he was going to deduct money for restocking fee and additional money for his time to do the estimate.
The fence material Topps is using is an open stock product that he uses every day and is NOT a Special Order Product. If Topps in fact, did order the fence product, he could use it on another job or drop the material off at our home, or refund our money. He has choices.
I called Kevin T. again to find out if he put our check in the mail and he assailed me with a barrage of nasty insults. Then Kevin T. threatened that, "each time I call him again to recover my deposit, he is going to deduct $25.00 on top of the other bogus fees. He is using that as an intimidation deterrent to extort me me from rightfully pursuing the refund of my Deposit.
