The letter arrived on 3/ The Revdex.com letter states I have days I will accept his offer of returning the engine I have and $for the other one as long as it is in full functioning order and like new condition His offer according to the letter is now void "No further offers will be made." was stated in his letter Is this offer still valid for this resolution? a club gathering. The man filling in for me is a good friend and business associate, as I have trusted him with $50,000 dollars worth of merchandise. He (the customer) didn’t get a repair tag (which is against shop policy) I did tell him to stop back and get the extra track BUT never accused him of lying even though my friend was positive he had given him the track.When he stopped for the engine I tried to explain to him that my P[redacted] had flared up (Probably due to a medicine change) and that I was way behind in repairs, if he could wait I would get it fixed, I don’t know how many times (if any) he stated “it wasn’t his.What I do know is that he had no compassion for my health situation.Now lets talk about the engine. So far, the customer, thru innuendo, had us thinking this was a new engine for this past Christmas, when in fact this “set" was produced in 2012. It appears m pages 78 & 79 of Lionel catalogue for 2012. Lionel doesn’t even show this number (6-18765) in their system. Additionally, the only other engine in my shop at that time of this type was a Baby Berkshire, # 1227 Polar Express, (They are not interchangeable.) And the stated price for this set is $439.99, not $479.99 as listed by the customer..I hunted the country over and found one (1) engine available for sale. It is like new and boxed as desired except for the plastic sleeve which has been and should be disposed of. (Choking lazard) And this engine came today with an owners manual. It clearly states that this product is warranted for one year from date of purchase. Obviously this set made in 2012 is not under warranty. The repair needed to get “his” engine running would be between $35 and $125 dollars. I am offering the following: that the customer returns the engine and tender (boxed) that he is in possession of, along with paying a $60.00 repair fee. .Result: Customer has a LN (like new) engine boxed as he desires for the same fee (or less) than he would have paid had he followed thru on his repair. I (the vendor) will use the $60. to help offset the cost of the replacement engine which was $300.00 (receipt available)Both parties need to sign the agreement that they are satisfied with the vendor’s offer as it fulfills costumers desired settlement as a new engine is impossible to obtain.This offer is valid thru COB 4pm, 24 Mar 17. [redacted]My offer of 21 March will remain open until COB on 24 April 2017. It is, as stated in my previous letter, in like new condition with all systems functioning properly. Box has plastic wrapping for each piece with Lionel blue ribbons included. Customer has stated he will accept my offer subject to his inspection (Understandable)Sincerely, Jacks Tracks

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  In the letter I received on 3/24/2017 has an unachievable response date on it.  He wrote the letter on 3/21 and the offer is valid thru 3/24?  The letter arrived on 3/24.  The Revdex.com letter states I have 10 days.  I will accept his offer of returning the engine I have and $60.00 for the other one as long as it is in full functioning order and like new condition.  His offer according to the letter is now void.  "No further offers will be made." was stated in his letter.  Is this offer still valid for this resolution?
