Review: NVPM refunded me $7.80 out of $1500.00 for a rental security deposit. They acted in "Bad Faith" charging me for false damages.

On August 9th, 2013 I received my refund of $7.80 out of $1500.00 rental security deposit. The reason this was that $1250.00 of it went to replacing the carpets due to they were "saturated with pet urine". By no means were they saturated with urine or any urine at all. They also failed to give me a proper itemized invoice for the repair of the carpet. All I received was a receipt that said removal of old carpet and installation of new carpet and pad. An itemized reciept MUST have the following: individual prices for all goods, total charge, and the terms. (Section 219 Civil Code 1950.5 (g)(2)) The receipt was also not signed by anyone. Also under section 228 Civil Code 1950.5 (f)(2) they MUST prepare an itemized statement of repairs or cleaning that the landlord or agent believes the tenant should preform in order to avoid deductions from the tenants security deposit. The landlord or agent MUST give the statement to the tenant if they are present. We were present, and no such paper was given to us. In the California Dept of Consumer Affairs there is a clause for Carpet and Drapes as they refer to the "useful life" rule if they need to be replaced. Which sates that carpet depreciates over years, and if they need to be replaced before its lifespan. The cost of the carpet will be prorated. There was no such pro rate, we were charge the full $1250.00. The carpet was approximately 5 1/2 years old. Today I personally went by the rental property and asked the current tenant if the carpets were replaced and she stated yes they were only after she ask them to. They current tenant had already given her security deposit and was moving in to the rental. There for we should have no responsibility to pay for the full cost of the carpet. If the carpet was so bad why did they charge us $125.00 for carpet cleaning if they knew that they were going to replace them 5 days later. I have no problem paying my share or what is due, but when North Valley Property Management violated 263 civil code 1950.5 (l) it upset me that they would have the audacity to write me hand written not stating "We are really sorry! You guys were awesome residents. Unfortunately the carpets were saturated with dog urine." This is a lie and false statement. I want to receive what is due to me and I believe at I am owed at least $1250.00.

Desired Settlement: I would like to receive the amount that I believe is owed to me of $1250.00. I should not have to pay for the replacement of carpets because the new tenant wants them. They were in livable conditions!

Truly sorry about the way things worked out. You were great residents. It's unfortunate but the fact is that there was dog urine in the carpet and the pad and carpet was completely ruined. Since you wrote this complaint we have sent you more of your deposit back. Good luck with your new home and I hope you understand our position.
