Failed to verify billing chargesManagement company was contacted via e-mail on Jan 23, 2013 to verify abusive charges of collection fees and has failed - not willing to cooperate. Collection fees applied to my HOA account are found to be not in compliance with HOA/Condo Association documentation. HOA documentation does not support abusive fees of collection agency or reimbursement of attorney fees. Management company has merged my HOA account with collection and legal fees. Management company has not provided documentation to support abusive fees. I'm requesting the management company to verify and provide documentation to support abusive collection fees of $1025.940 CMR 7.00: Debt Collection Regulations (Current)7.07: General Unfair or Deceptive Acts or Practices(6) Any representation that an existing obligation of a debtor may be increased by the addition of attorney's fees, investigation fees, service fees, or any other fees or charges, if in fact such fees or charges may not legally be added to the existing obligation.Desired SettlementNeed verification of all collection fees and documentation that support abusive fees applied to my HOA account.Business' Initial Response Contact Name and Title: [redacted]Contact Phone: [redacted]Contact Email: [redacted] is a unit owner at a condominium Association. When [redacted] fell 3 payments behind on his condo fees, he was activated with the condo associations Attorney ([redacted]). On every past due invoice that [redacted] received, he was informed that he would be responsible for all legal fees if the account was activated with the Attorney. The Law Firm that is handling his account represents over 3,000 different condominium associations in New England. The law that the Attorney and the association is following is Massachusetts General Law 183 (a). This law allows the Association to charge the unit owner for the legal fees when they don't pay their condo fees. If [redacted] has any questions, comments or concerns about his account status or wants to discuss a payment plan, he should contact the Attorney at [redacted]. Northborough Property Management is just the managing agent for the condo association. If [redacted] did not fall 3 payments behind in his condo fees, none of this ever would have happened.Thank you.Consumer's Final Response (The consumer indicated he/she DID NOT accept the response from the business.)The management company still needs to verify the fees. Northborough Property Management did not notified about attorney fee reimbursement and Condo documents don't support that either. I just need management company to verify my HOA account and inform in writing about abusive fees added to my account. If my HOA fees/account is 3 payments past due? Send me docs to verify your claim. That's all I need. The management did not resolve my complaint. I need to know what it takes to bring my HOA account current. Attorney fees and collection fees are separate - I already know that I have to deal with them. But I need from management company what it takes to not be 3 months behind as they are claiming. Show me the papers? I really need to resolve this within a week. Business' Final Response [redacted] can log into the Associations Website 24/7 to view every charge and every payment he has ever had with the condo association going back 4+ years. In addition, I have mailed him out a copy of his full ledger (going back 4 years) numerous times. I e-mailed him another copy 5 minutes ago. To bring your account current, you need to contact Attorney [redacted] at [redacted]. I have told you this many times already. Attorney [redacted] has also explained to you the way MGL 183 A works and how it relates to your situation. If you have any further questions [redacted], please feel free to call or e-mail me.
