We take the matter seriously and are pleased to have the opportunity to respond. The complaint was apparently not reported by our former customer, but instead a relative,
so perhaps some confusion exists in
their conversationThe check is not a “refund,” but
instead a payout of an estateOur legal counsel has advised us that estate checks must be
payable to the estate, not to individual personsThis advice takes into consideration that
we have no way of verifying authenticity of any will, that other family members may
come forward at a later date to claim the money, and that funds may need to be repaid to
the State for government assistance programs that were used in the past. At least one local bank has indicated to us that a customer in good financial standing who
has a personal relationship at their institution, and the proper documentation, would be
likely able to deposit the check into an existing account. Mrs*** has the check in her possessionIt is our assertion that with the proper
documentation, a check payable to the estate should be able to be transactedThe
complaint says MrsEtheridge was able to deposit a recent capital credit check by
providing her bank with a death certificate and a willWe sincerely hope this same
documentation will provide her bank with the proof that she needs to transact the more
recent check. We trust this further information will assist you and Mrs*** in resolving the issue. Sincerely,*** *** CEO
