Review: I purchased a home in September of 2011, at which point I had a concern regarding the extent of the property boundaries as the MLS listing had something different than what was being conveyed to us from the seller. Because of this discrepancy I added a contingency in the agreement of sale pending title search. Northeast abstract provided a 5 page search of the title which contained no information disputing the sellers claim so I moved forward with the purchase; thinking at a later time I would be able to make improvements to the land in the future.

A few months later I was served with legal dispute ([redacted]) regarding a claim to quiet title on the property included in my contingency of sale. The plaintiffs are alleging that the rear property (for parking) is part of a 22 home development plan; and 4 homes who are not deeded parking, are entitled to parking on my property (along with my neighbors).

When I was served with the case I contacted NE Abstract to cover the defense of my title in this matter as it has a direct impact on the title, I was told that this claim was not covered by my policy at which point NE Abstract provided me with the FULL title search which contained information about an ingress/egress easement which was not previously disclosed to me. Using this logic of the ingress/egress easement, they refused to cover my title under a particular easement clause in my policy, details of which was not provided to me at the time of closing; even though the lawsuit does not pertain to that particular easement.

At this point I hired counsel to persuade the title company to represent me against the lawsuit - which they rejected. Rather than take them through a costly court process I have been left defend myself in the lawsuit in this action to quiet title against my property. It should be noted that the majority of my co-defendants (18 in total) have their title companies representing them. As the state of [redacted] sets the title insurance rate based on the price of sale, I do not understand how different services can be provided at will by different title companiesDesired Settlement: As I strongly believe this issue may have been avoided if NE Abstract would have satisfactorily completed the job we contracted them to do. Subsequently as a result of the lawsuit, they have acted in bad faith in dismissing my claims for representation that arose due to their negligence in the original task.

I am asking for a refund of services paid to NE abstract, as well as compensation for the $837.42 I spent on the counsel.
