Complaint: [redacted] I am rejecting this response because: Neither [redacted] or I will signing any papers saying this in not a warranty repair, but a good faith repair You can deny all you want but you are saying now and what you said last year is two different thingsAs far as this being a good faith repair, the time for that passed along time agoThis problem started out as a small repair and remains a small but slightly larger that it started outYou have done enough work on Bainbridge Island over the last year that you have had plenty of chance's when you could have dealt with this, as you have to come within 3/of a mile of our house to get you crews and equipment there to do the workYou also have done a lot of work in Poulsbo which is not that far from the house, less than milesThis is not a major repair that would require a lot time to repair Accept the pictures or not they are not altered and show exactly why this area and only this area of the driveway brokeI will not be pulling anything down off the Revdex.com's website as everything there is factual and correct on my partIf you fix the driveway I will add a comment to the fact that you fixed itIf You don't than my final comment on this will be that I had to hire someone else to fix something that you warrantiedIf you do fix this be aware that ***'s son who is a Civil Engineer with years of Road and Bridge design and repair will be checking your work, this is also why I know this is not a time consuming and materials demanding repair, because he has looked at the existing problemSincerely, [redacted]

We paved *** *** driveway on 05/23/and her project was perfect and she paidShe contacted us last summer (2014) and said she had a "warranty issue"A Northern Asphalt Estimator went to look at this and reported that the edge of her driveway a 2' x 40' section had broken offThis is only
done by a big truck riding the edge and it was explained to her and her husband then that this is NO warranty issue but just to be a reputable company would just help her out and take care of itThis is a cost to us, and was explained it would ONLY be done on our timeWhen we were available last year, and in the area went to fix it and the gate was locked..as this is another struggle for us to complete itSummer months are OUR busy time and therefore this cannot be done during those monthsWe have tried to tell her this and she is being persistent and demandingIt is really unfortunate when we try to oblige and not charge a go back fee and Mrand Mrs*** feel they are right in filing a complaintOn another note, the date of purchase is wrong and therefore do not correlate with the date "talked to company" also, the date they came into our office to notify us was July of

You can deny all you want but you are saying now and what you said last year is two different things. As far as this being a good faith repair, the time for that passed along time ago. This problem started out as a small repair and remains a small but slightly larger that it started out. You have done enough work on Bainbridge Island over the last year that you have had plenty of chance's when you could have dealt with this, as you have to come within 3/4 of a mile of our house to get you crews and equipment there to do the work. You also have done a lot of work in Poulsbo which is not that far from the house, less than 5 miles. This is not a major repair that would require a lot time to repair. 
Accept the pictures or not they are not altered and show exactly why this area and only this area of the driveway broke. I will not be pulling anything down off  the Revdex.com's website as everything there is factual and correct on my part. If you fix the driveway I will add a comment to the fact that you fixed it. If You don't than my final comment on this will be that I had to hire someone else to fix something that you warrantied. Complaint: [redacted]I am rejecting this response because: First I would like to clarify a couple of things. 1. I would like to thank Northern Asphalt for correcting me on the dates, they are absolutely correct about those. 2. But that is all they are correct about. Most of the conversations have occurred between [redacted], the Owner of Northern Asphalt (Mike) and his office manager. I was there when the original visit to the office occurred to talk about the cracked and breaking tar, but most of the other information has been relayed to me by [redacted], I did however talked to him once about a year ago, when nothing had happened all summer long on the problem and he assured me at that time that they were going to correct it. The only other time I have talked to him was when the work was originally done.  [redacted] and I are not married and she is the actual owner of the house and because of this she felt that she needed to take the lead on this.3. Northern Asphalt claims that they have made good faith attempts on several occasions to correct this problem but have arrived to find a locked gate. One of the biggest problems with this whole process has been communication, every time [redacted] has talked to Northern Asphalt, she has been assured that they would call before coming over to work on the problem. On the couple of occasions where they have given [redacted] a specific date they were going to come over, they have never shown up or even given a reason why they haven't shown up, not even a voicemail on the house phone. On the occasions where they showed up and found a locked gate, it was because they were not expected and since the damage is getting worse on the road, when she is not home she locks the gate to ensure she has no one driving the road that shouldn't be.Now on to why we are rejecting this response from Northern Asphalt:
1. Their assertion that a big truck went up the driveway is not based on any actual facts and is just conjecture. They have never given us a reasonable explanation of what is a big truck in their eyes. Nor have they seen a big truck go up the driveway.
2. When there adjuster came to look at the problem all he did was take a quick look and blame it on a big truck. No broken pieces were removed to check for thickness.  The agreement between [redacted] and Northern Asphalt required a minimum of 2" of compacted Tar everywhere (Northern Asphalt has provided a copy of this document in their response.) 3. Because of this response I did that which I had been hoping to avoid, I reluctantly pulled pieces of broken tar from the damage areas and measured them, If you look at the pictures in the attached PDF's the pictures show  that only areas of the damaged driveway that was even close to the 2"minimum thickness of compacted tar was at the very edge, that portion that could be seen when walking down the road. The pieces I checked that were away from the edge towards the center, where the damage originally started were anywhere from just over a 1 inch thick to  1.75 inches  thick top to bottom (nowhere near the required 2" minimum). I would also like to point out at this time I ensured that I did not measure any pieces that were not representative of the actual conditions. I ensured that I had not left a portion of the pieces I removed in the hole, as this would have affected the measurements. This is not a case of a big truck went up the driveway, but is a case of not enough tar being used to actually meet the conditions of the agreement, if the proper thickness of compacted tar had been applied everywhere, the road would still be intact and undamaged. This should be corrected as a warranty issue. Sincerely,[redacted]
