Review: I purchased a 2010 Honda Civic from Northern Auto Traders on 5/*/2013. At time of purchase the saleman ([redacted]) and the finance person ([redacted]) insisted that I needed a service plan in order to secure the loan. I questioned this and was told by both of them to call back in three months and cancel it, and I would be credited the pro-rated unused portion of the plan, which was for $2000.00. I called and spoke to [redacted] on 7/** and he advised me he was going to submit the cancellation. I called twice the following week. He informed me it was going to take ninety days. Then he said there was a 40% early termination fee. None of this was told to me at time of purchase. I called the plan provider, Allstate and was informed that there is no ninety day requirement and the termination fee ranges between $25 and $50. I faxed a lettter of complaint on Aug [redacted] to Allstate and Norther Auto Traders. [redacted] from Northern Auto Traders called me on 8/**/2013 to advise me they did not submit the cancellation because they needed it in writing. I told them I had been speaking with [redacted], who, since 7/** assured me the cancellation was in process.

On 8/[redacted] texted me asking for the mileage on the car in order to cancel the plan. I texted him back 38,896. On 8/** he again requested it and I informed him I had sent it to him on 8/**. He checked his texts and said, he hadn't seen it then but it was received.

It is almost a month since I first requested the plan be cancelled, and to be credited for the unused pro-rated portion of the service plan which is $1,833.33, which represents 33 months of the plan which is for 36 months. Allstate informed me today that they have not received the request.

This company lied to me:

a) by insisting I needed the service plan in order to get the loan

b) by telling me after three months I can call and cancel it and would be credited for the unused portion

c)by assuring me for over a month, that the cancellation was in process, when it fact it was not

d)by adding a 40% early termination fee which I was never advised of at time of purchase

I want a refund of $1,833.33 which represents the remaining thirty-three(33) months of the thirty-six (36) month plan for $2000.00 and expect only to be charged for three (3) months. [redacted], Unfortunately has become an angry little man and we don't know why?

[redacted] purchases a vehicle from us; we went above and beyond obtaining financing on his behalf because his credit standing was less than adequate. His reference that he was lied to is in fact a complete lie on his behalf, enclosed you will find all the documents which was read, reviewed and signed by [redacted] at the time of purchase. The service contact which would have protected [redacted] from all mechanical failures for the nest 3 years and 75,000 miles was negotiated and included as part of the term of the loan. [redacted] chose to cancel the service contract and we informed that we would assist him in doing so but like everything in life there is a process however [redacted] wants things done on his term that is the reason for his complaint, he wants things done NOW, RIGHT NOW!! Unfortunately the world does not revolve around [redacted] enclose you will also find all the documents relating to the cancellation of the warranty. We told him we would cancel the warranty and we have in fact cancelled the warranty the rest is up to the company, Please note where the company says "the funds will be distributed on the next payment, please note where the company says " the funds will be distributed on the next payment cycle"" This is what we were trying to explain to [redacted] but he's and angry little man who prefers to scream and shout instead of listening!!. Nevertheless, We cancelled the warranty and when we receive the funds we will forward it to [redacted].

I did respond to your earlier email.

This matter has not been resolved. I was referred to the Attorney General's office and am in the process of taking the complaint there.

I first called Northern Auto Traders on 7/**/2013 to request cancellation of the service plan and I have telephone records showing my calls to them and their return calls to me. I spoke to [redacted] and he said the cancellation was in process.

Based on the Rider to Sales Agreement, if the plan is cancelled before 30 days, the termination fee is $305.00. Worst case scenario, this is the most that should be deducted from $1,998.00.

[redacted] and [redacted] both insisted I needed the service plan in order to get the loan a time of purchase. They both assured me I should call back after 90 days, cancel it, and my loan would be credited for the unused pro-rated amount, this in the presence of my witness. They have failed to keep (1) what is in the rider and (2) what was told to me in the presence of my witness.

I feel defrauded by Northern Auto Traders.

Again, this case is not resolved.

My God, this guy is a pain in the [redacted]!!! you know what, we will deduct $305 and send this guy a check for $1693 so we may NEVER hear his name mentioned ever again!!! and speaking of being defrauded [redacted] what don't you tell everyone about your mortgage that you're not paying, I think that bank feels defrauded by you!!
