Review: I own a business called Teachers' Heaven and we use a credit card machine for customer payment of merchandise. In April of 2010 contracted with Northern Leasing for a new machine and signed a 4 year lease with Encore Payment Systems. I thought I could get out of it. Rates were raised. After a search for a new provider contracted with Venture Processing. They promised better rates and verbally there rep, [redacted], said I could terminate my contract with Encore. That appears untrue. From what I can find out it appears that Northern Leasing, Venture Processing and Encore Payment Systems are all connected but do not inform possible customers of this. For example, when I attempted to cancel one of the contracts I received letters from Northern Leasing concerning both machines. Until then I thought I was working with Venture and Encore. Thus, a business that wants to change from one company to another ends up paying for 2 credit card systems when they only needed one system and basically paying the same company. When you realize that you are dealing with a conglomerate and attempt to communicate with any of the various companies you do not get any answers to your questions. You also get vailed comments concerning law suits. I have sent letters of complaint to Northern Leasing, South Carolina Secretary of State and the South Carolina Revdex.com. They called and directed me to this site.Desired Settlement: I feel that I am a victim of deceit and lies. What I want, is to be able to cancel the second credit card machine contract with no buyout requirement and no penalties and continue using the initial machine. If you could assist me in this matter your help would be greatly appreciated. If you can not assist me could you possible direct me to the correct agency?

Please consider this our response to above-reference complaint filed with your office on June **, 2013 against NLSI.

Lease No. [redacted] was originated by LeaseSource Inc. ("LSI"). NLSI therefore has all the rights afforded LSI as original Lessor but none of its obligations under the lease pursuant to Section 7 titled Assignment of the lease agreement.

NLSI is a leasing company, which provides financing for the lessee's acquisition of credit card processing equipment. NLSI does not sell the equipment to the lessee nor does NLSI provide the processing services. The agreement between the lessee and NLSI is a finance agreement. NLSI has provided the funds to enable lessee to receive the credit card equipment, and the lease agreement outlines the terms and conditions pursuant to which lessee must reimburse NLSI.

NLSI is strictly a leasing company and does not have employees who directly solicit merchants such as complainant to do business with us. We rely on outside vendors and prospective lessees to negotiate and agree upon the terms of the lease agreement. NLSI further assumes a prospective lessee is an astute businessperson who would read and comprehend the lease agreement in its entirety prior to signing it and thereby obligating their person and business to its terms.

The sales representative who presented the lease agreement to complainant is considered an outside vendor and is not and has never been an employee of NLSI. Therefore any promises and representations they made contradictory to the terms and conditions of our lease agreement cannot be held against NLSI and our enforcement of the contract against Lessee.

Furthermore, NLSI's contractual obligation to complainant is to provide funds upfront in order for them to receive equipment of their choice as dictated by the needs of their business and use it to the benefit of the business. NLSI fulfilled its obligation with the delivery of functioning equipment.

The lease agreement does not provide for unilateral termination by Lessee, and sets forth Lessee's absolute and unconditional obligation to make all payments due under the lease agreement no matter the circumstances.

We strongly recommend Lessee to contact the vendor who negotiated the lease terms under Lease No# [redacted] regarding their promise to assist in the termination of their previous lease

Review: We have sent back the credit card machine back to this company and cancelled service. we continue to get billed and now we are being harassed saying we owe money. I called the company to let them know I have the tracking information saying this has been returned and that I don't owe any money. the customer service rep hung up on me. we called back several times but every time we called back they either hung up again or transferred up to an empty line that says " the voicemail has not been set up" and it hangs up. I would like this settled, cancelled, and the bill to be taken care of. we haven't used the credit credit card machine or service since last year ( 2014 )Desired Settlement: I want the service cancelled, the bill to reversed that says we owe for the past three months. I want them to erase my company imformation and to stop harassing me or I will get a lawyer next. I see all the complaints with this company and im prepared to go forward with the next step. im just hoping the Revdex.com can handle this.. thank you
