As previously stated in a letter mailed to *** *** and in the response to his Revdex.com complaint, I apologize for any inconvenience that our appointment recall and reminder system may have caused him He states that he received a recall text message in September 2015, which was the same month that we switched to a new Electronic Records and Recall system It appears that for some reason the request to opt out of text messaging did not transfer to the new system As stated in my letter dated Jan5, 2016, in response to Mr*** complaint I removed his number from the system After confirming with the recall company, he should not have received any messages from us since January I am confused as to whether Mr* *** is claiming that he continues to receive messages from our office, or if he is still expressing frustration from messages received last year We do take patient concerns seriously, and I feel that we've done everything we can to ensure that he doesn't receive any unwanted text messages or phone calls from our office Any unwanted messages, email, or phone calls that he may be currently receiving most definitely should not be coming from our office If he has any proof of receiving unwanted messages since January of this year, I would encourage him to bring it to our office so I can investigate the matter further

On January 5, 2016 I received a letter from Mr. [redacted], who was upset that he had received a text message or automated phone call from a third party that we use to communicate with patients.  This company is very commonly used by Eye Care Providers, Dentists, and other professionals.  He...

stated that he had told us previously that he didn't enjoy receiving text messages and calls, but had continued to receive them.  He didn't provide any specifics as to the exact nature or date of correspondence that he had received, but expressed that it bothered him.  
In response, I mailed a letter to him immediately, and apologized for any unwanted messages he may have received.  I explained that we had switched to a new Electronic Health Records company and a new third party communication company in September 2015, and it was possible that the request to not be contacted had not transferred over to the new company.  I personally removed any phone numbers and email addresses from his electronic file at that time, and marked him as an inactive patient to ensure that he wouldn't receive any recall messages or email newsletters from our office.  He should not have received any further information related to our office since then.  Upon reading his Revdex.com complaint this week, I double checked our system, and there is no contact information for him in our system.  We also contacted the third party communication company, and they confirmed that within one day of removing contact information or making a patient inactive, the information is synced on their end and no messages are to be sent out.  Therefore, no messages related to our office should have been sent to Mr. [redacted] since January, and neither we nor the companies we work with share this information with anyone else.
 Mr. [redacted] mentioned that he is currently being seen elsewhere for his eye care needs; it is certainly possible that he is receiving similar messages from his new eye doctor, or even from a Dentist or other provider.  If he has proof that he has received messages recently from our office, it would be helpful if he were to bring that proof to our office so we can investigate the matter further.  Most of our patients enjoy reminders of their appointments or the occasional email newsletter from our office, but we certainly respect the privacy and wishes of those that don't, and don't want patients receiving unwanted messages.

Complaint: [redacted]I am rejecting this response because:
I have taken pictures of all the text messages, I have logged all the incoming calls, I have a log of all the times I called and personally requested that they stop texting & calling me and explaining to some length that I am no longer being seen at that facility along with the staff person that I talked with on that day.  Each time I was assured that the calls would stop, however they never did. Also I have a copy of the letter I sent to Northern Lights Eye Care and also have a copy of the reply letter from Northern Lights Eye Care dated 01/05/16 which I will submit to refresh Adam H[redacted]'s memory. As I stated in my Revdex.com compalint, on September 30, 2016 the texting started again on that day. The unwanted communication of any form is harassment after formally requesting that they stop. Three years ago in my first request it was a friendly request that I be removed from their automated calling and texting system because there were so many.  As the requests went ignored over the past few years I have became furious in their disregard and their lack of concern in this matter. 
As it stated in his reply letter that most of their patients are happy about receiving these calls and texts.  I wish to remind Adam H[redacted] and his staff for the 99th time that I am no longer one of their patients, will never be one of their patients again and at this time have made it painfully clear what my next steps will be at this point.  Also, as I have already told them in my letter in 2015 that I will and have filed a formal complaint with the Revdex.com if it continues, and of course will contact everyone that I know and warn them of the actions that will occur after being a client of theirs.  Nuisance calls and texts that will not cease coming from a local business just goes to show the class of people that they are and why I left in the first place.  Normally SPAM, nuisance calls & texts come from poor third world countries that lack scruples of their actions or total scam artists and not the class of people that I wish to do business with.  Your continuing action shows blatant disregard for peoples privacy.  These actions coming from a local Anchorage company is reprehensible and shows total ignorance. For them to lie to the Revdex.com and suggest that the current texts (picture of text on file) are not coming from them shows what a low life business this really is.  I will fight just as hard as I have to and file every form necessary with the FCC, Alaska Consumer Protection Agency, the state Attorney Generals office and each and every suggestion that all of them request me to do to get these calls and texts to stop.  I think I have given my last warning in this Revdex.com rejection on complaint #[redacted].
