Hi my name is Russell Shaffer from Shaffer sanitaryI am writing on the complaint filed on Jan .I tried to settle with this lady she was a customer for years The day she quit which was 6/18/She was prepaid till the end of the monthThe reason she quit was because we were running late, we went to open her gate to get the trash and her dog got looseAt that time she was outside with the dog around the corner when we opened the gateShe started yelling at me saying it was my fault that her dog got out which there were witness to her abusive treatment of the driverThe driver went out looking for her dog and minutes later he saw the dog in her vehicle heading for the houseThe driver stopped back at the house to make sure everything was okay and she verbally attacked the driver againShe said she was quittingBecause we serviced her in the month she did not get a refundI however am going to pay her $so that the harassing phone calls stopIf you have any more questions please feel free to contact me217-367- Sincerely, Russell Shaffer

This is a copy of our booth rental agreement. Direct your attention to the starred paragraph. I repeatedly asked said vendor if they were going to relocate with us or if they were going to close their booth when...

we moved. They kept telling me they weren't sure. They did not tell me they were difinitly pulling out till the day they came in to pack up stuff.

We do not accept the response from Northside Vendors for the following reasons: 1. We have a signed booth rental agreement (attached) that is dated July 17, 2012 which states a 2 week notice should be given prior to closing your booth. This agreement was signed with the previous owner. We have no recollection of being asked to sign an updated booth rental agreement with the couple, who are the current owners, when they took over the business. 2. As we stated in our original complaint, we were informed in Dec 2016 of the upcoming relocation, so we drove by to look at the new location and decided we were not interested. We were told by the male owner that we had to be out by the end of Feb 2017. When we returned to our booth 2 weeks later, we informed the male owner that we were not interested in moving our booth with them. His response was that he hated to see us go, but it is our booth and our decision and that we have to do what is right for us. Two weeks after that we came back again to our booth, and we once again told the male owner as a reminder that we were not moving with them. He again tried to convince us by saying how great the new place was going to be, they are doing a lot of work on the building and that several vendors were going with them. We continued to state that we did not want to go. At this point it was still our understanding that we didn't need to be out of our booth until the end of Feb 2017. So regardless of which version of the booth rental contract you look at, we were in full compliance with our notice to close our booth. We were then abruptly informed by a phone call on Wednesday Jan 18th, 2017 by the female owner that we had to be out by Friday Jan 20th. We informed her on that phone conversation that we would come pick up our items and that we were not moving with them to the new location and that we had already told that to her partner on several occasions. We went on Thursday Jan 19th and cleared out our booth. When we were leaving, we asked the female owner if we could receive our sales proceeds for January at that time. She stated that she didn't have any cash and would just send us a money order. We verified the address with her to send it to. At no time during this conversation did she state that she felt we were in violation of the rental agreement, perhaps that is because we were in full compliance all along. Therefore we do not accept the response provided by Northside Vendors.
