In regards to the
complaint by Mr. [redacted], attached you will find the “Receipt for Design Fee and
Drafting Services” as signed by [redacted] and [redacted]. Please note that it
states very clearly that the payment is strictly...

non-refundable and without
contingencies. The receipt is for payment for design work, conceptual drawings,
etc. It is an authorization for us to proceed with that work. It also
authorizes us to work the process up to final prints from the build center. The
agreement does not state that they would receive “full construction plans”. Mr.
[redacted] terminated the project before we advanced to that stage of the process.
Mr. [redacted] did
receive two sets of prints from the build centers, one set from All American
Homes and one set from Northstar Systembuilt (despite the name Northstar
Systembuilt is an entirely different entity from Northstar Homes). Those plans
are attached.
I am not sure of
the basis of the promise of a quick turn around, and quick is such a relative
term. We were first contacted by [redacted] on June 17th, about a
new build high-end custom home in Crested Butte (in the mountains and a ski
resort) where winter weather comes early and gives a very short build window.
Because we provide factory-built homes and set them year around, we are
somewhat less restricted by weather but the ability to complete the necessary
site work is dictated by the weather on site. HOA approvals and site work were
not included in our scope of work.
The abridged
version of the timeline is: Design Fee paid 08/11/15, prints from All American
sent to [redacted] on 08/20/15, 08/27/15 60+ pages of HOA docs received from [redacted],
09/02/15 additional information received from [redacted] regarding roof lines for HOA
and other changes, 09/02/15 prints from Northstar Systembuilt sent to [redacted] for
HOA meeting on same date, 09/08/15 revised prints from Northstar Systembuilt
sent to [redacted].
Mr. [redacted] cancelled
their project because they were out of time. By their own admission, the
original plans submitted to us in mid-June were beyond their budget so the
design process had to begin from scratch. Unfortunately for Mr. [redacted] and
Ms. [redacted], they had already lost time on their project while the un-buildable
drawings were being produced by her father, which did not start until they had
purchased the lot. They said that they have a background in construction and
have lived in Crested Butte for five years so they should have been cognizant
of what it would take to get their project put together in the available
weather window. They should also have been aware of the HOA requirements and
what it would take to get HOA approval at the onset. Our first notification of
HOA requirements was not until on or about August 10th.  Anyone that is aware of what is going on in
the new home construction industry in Colorado this summer should understand
just how busy every segment of the industry is and should have allowed for that
in establishing their hopes of how long it would take.  It would seem that they set themselves up for
disappointment from the very beginning.
There was no scam
involved. We have pages and pages of email conversations back and forth during
the process, and multiple phone calls. They have received 2 sets of prints. Plans
had to be changed during the process due to HOA requirements so additional
plans had to be generated. They were provided with specifications for the new
house. It is hard to believe that they feel that they have nothing to show for
the fee that they paid.
Just prior to
cancelling the project, Ms. [redacted] in a conversation with Dwight expanded her
expectations of what she should receive from us to include aerial views of
their lot and illustrations showing the placement of the home, garage and shed
on their lot (outbuildings were not included in our scope of work). At no point
in time were these additional services included or offered.
Additionally, per
their authorization we out-sourced drafting services, the cost of which was
$2,500. The balance, $500, was paid to Dwight for his work in the design
process. Northstar Homes is out our overhead costs that were expended to get
the project to this point.
We are not really
in the design business, we are in the house building business and offer the
design work to help homebuyers get the home that they want and can afford. It
is not a profit center for us.  We regret
that the project did not turn out as Mr. [redacted] had hoped but we do not believe
that Northstar Homes is in anyway responsible for that. It is likely that Mr.
[redacted] and Ms. [redacted]’ real frustrations lie with their HOA and site work
contractors but they have no recourse there. Northstar Homes has met and exceeded
the terms of the agreement, the fee that was paid by Mr. [redacted] and Ms. [redacted] has
been disbursed. Therefore there can be no refund of the fee.

I am rejecting this response because:In an email dated Aug 27, 2015 Dwight states: " Yes, everything from day one, with your original submitted plans from your Father is what NSSB is making their commitment to produce prints, elevations, foundation with load points, for your presentation to the HOA"In the agreement for the $3,000 design fee it even states: "Completed prints become the property of the buyer"We received any of this, thus we have gone to the CC company to pursue a charge back.
