I did back into this man at a stop light and dented his hood of his carHe said it was not a big deal and his car was not nice anyways, I said I would fix the hood for him and gave him my phone numberHe called later that week and said that he would be out of town for work for the next couple of months and I could go get his car and work on it while he was goneI went and picked it up and brought it to my yard to look at and fixI started the car up to move it and noticed that the car had a check engine light on and did not sound very goodIt also had over thousand miles on itI looked at the car and the hood needed the dents to be taken out and the head light needed to be fixedIt was hard to tell what had already been there and what damage I had doneI pounded out the hood and replaced the head lightI checked everything else and it seemed to be okayI put around $into the car in parts and by looking at the car I would value it maybe at $700.00? ? The owner came back to town and came to get the car, He looked at it and said it looked good to him and drove it awayA couple weeks later he called me and said that he did not think that the car was fixedHe was angryI told him that he had looked it over and said it was fine and drove it away and weeks later is a long time to wait to tell me different.He called my wife later that weekShe told him that if he thought his car was worth more then we put into it to fix it then he needed to take it to get it apprised and then we would know in for sure what the value of the car is and we could go from thereHe called back and said that the dealer would not apprise the car and she gave him the number to a independent guy who does themHe said he was not going to do that or pay for any of itMy wife then said if you cant do your part then how do we know what the value of the car is worthWe are saying $he is saying $we are not anywhere close to the same amount.? He kept calling over and over again and yelling and screaming and my wife would hang up after trying to explain to him you need to get the car appraised until he does that we can not move forward, we offered to pay half the cost of the appraisal.? The last time he called my wife hung up on him and he showed up at our house banging at the front door and kicking the front door and spitting on the doorI went to the door as he was throwing a fit and yelled at him to get off of my propertyI did have a gun on my hip in the holster as I carry it when I drive the tow truckwe have tried to come to an agreement with this man but now he is out of control and coming on my property acting crazyI feel I have fixed the problem the best I canThe car is old has tons of miles and in poor condtion and I think that the $I put into the car fixed what I damaged and then someWe have done all we can and have tried to make this right and this man is out of control and crazy and I do not want him bothering my family.?

We can not agree on anything that has happened or any form of way to resolve the problemThis is why we are here, I do not have a problem having my insurance deal with these kinds of problems if that is what he would have wanted to do in the beginningI can let him deal with them if that is what he wants to doWe are not going to get anywhere this way, That car is not worth more them $and the mileage at is pretty close to miles and for any vehicle that is a ton of milesIf he wants my insurance to tell him the same thing and he can go to there office and kick there door and spit all over the place then fine with me.

I am rejecting this response because:It does not contain NorthStar towing's insurance information so that I can file a claimIt also contains numerous lies about the events, although I applaud their honesty in admitting to hitting methat will be usefull evidence in addition to the evidence I already have, in the increasingly likely event that I must take NorthStar Towing to small claims courtAllow me to correct the lies contained in the responseI will note the places they are honest.they said when starting my car it didnt sound goodnot sure what sound they heard, it runs great, as I recently rebuilt the enginethis is a rather irrelevant point thoughthe check engine light is indeed on, the knock sensor is faultyI have a replacement I just have not put it on yetagain, this point is irrelevantit also does not have over 250,miles, it's actually 242,000, but who's counting right? The owner/operator of Northstar towing backed into me in traffic, damaging my Subaru. He agreed to fix the car himself, or pay for the parts. He took my car, and had it for many months. He never fixed it, he never gave me any money. Since he failed on his agreement, I asked for his insurance information so I could file a claim. He refuses to give it to me. His wife works for Northstar towing as well. I have called and been hung up on multiple times. I have gone to their house and the owner brought a gun to the door. He has yelled incoherently at me on the phone. I am now looking to take them to small claims court

It was hard to tell what had already been there and what damage I had done. I pounded out the hood and replaced the head light. I checked everything else and it seemed to be okay. I put around $200.00 into the car in parts and by looking at the car I would value it maybe at $700.00

The owner came back to town and came to get the car, He looked at it and said it looked good to him and drove it away. A couple weeks later he called me and said that he did not think that the car was fixed. He was angry. I told him that he had looked it over and said it was fine and drove it away and 2 weeks later is a long time to wait to tell me different.

He called back and said that the dealer would not apprise the car and she gave him the number to a independent guy who does them. He said he was not going to do that or pay for any of it. My wife then said if you cant do your part then how do we know what the value of the car is worth. We are saying $700 he is saying $3000 we are not anywhere close to the same amount.

He kept calling over and over again and yelling and screaming and my wife would hang up after trying to explain to him you need to get the car appraised until he does that we can not move forward, we offered to pay half the cost of the appraisal.

The last time he called my wife hung up on him and he showed up at our house banging at the front door and kicking the front door and spitting on the door. I went to the door as he was throwing a fit and yelled at him to get off of my property. I did have a gun on my hip in the holster as I carry it when I drive the tow truck. we have tried to come to an agreement with this man but now he is out of control and coming on my property acting crazy. I feel I have fixed the problem the best I can. The car is old has tons of miles and in poor condtion and I think that the $200 I put into the car fixed what I damaged and then some. We have done all we can and have tried to make this right and this man is out of control and crazy and I do not want him bothering my family.

I am rejecting this response because:

It does not contain NorthStar towing's insurance information so that I can file a claim. It also contains numerous lies about the events, although I applaud their honesty in admitting to hitting me. that will be usefull evidence in addition to the evidence I already have, in the increasingly likely event that I must take NorthStar Towing to small claims court. Allow me to correct the lies contained in the response. I will note the places they are honest.they said when starting my car it didnt sound good. not sure what sound they heard, it runs great, as I recently rebuilt the engine. this is a rather irrelevant point though. the check engine light is indeed on, the knock sensor is faulty. I have a replacement I just have not put it on yet. again, this point is irrelevant. it also does not have over 250,000 miles, it's actually 242,000, but who's counting right? this is another irrelevant point. the engine doesnt have those miles on it, nor do many other parts I have replaced. they claim it was hard to tell what had been damaged on my car before they hit it. the only thing wrong was the grill is missing, which I still have and can put on whenever I get around to getting more mounting clips. All the damage to my front end was caused by them hitting me. it isnt just the hood and headlight that were damaged either. my core support was bent, my side lamp also needed replacing. the AC condenser and radiator were also damaged. they claimed they checked everything else and it seemed ok. guess they didnt check that hard or the damaged items I describe above would be known to them. they claim to have put $200 into it. another lie. they put nothing new on it. they say they think my car is worth $700. please. I've seen ones the same year as mine which had blown engines going for $650. I've seen ones the same year as mine that had similar work to the engine done that mine has had going for nearly $2000. this is another mostly irrelevant point though. they said whaen I came to get the car I said that it looked good. another lie. I didnt say much of anything because I was so mad that they had wasted so much of my time. they had my car for months and never fixed anything on it, even though they told me they were working on it. after my job ended I went for a long time without a car, waiting for them to fix it. waiting in vain. Everett never even flattened out my hood until the day I came to get it, as I waited. the hood needs to be replaced, not just flattened. they claim I called a few weeks later and said it was not fixed. this is also not true. what I did do was text asking for their insurance information so I could file a claim, since they had failed to fix my car as agreed. they ignored this. at this point I fully realized that they had no intention of doing the right thing and that it would be like pulling teeth getting them to do what is right. I sent an angry text or two at this point as my patience was spent. the next claim they make in the response is actually mostly accurate, regarding the appraisal. why should I have to spend a cent on this when they hit me? their insurance company will appraise the car, that's what they do. I agreed to allow them to fix my car instead of filing a claim first for the following reasons:My car is likely worth less to an insurance company than it is to me. I recently put over $3000 into fixing it up mechanically. this is probably why Everett said I claimed my car was worth that much. to clarify, I'm not claiming it is worth that much, only that I recently put that much into it. it's probably worth between $1300 and $1800, but this is just a guess based on what I see others go for that are similar to mine. it isnt much to look at, but it has an unbelievable amount of new parts, making it valuable to me. I only wanted it fixed the way it was, but I was worried I'd get an unsatisfactory amount if it was totalled out, plus that would leave me having to try to fix it with whatever the insurance gave me. If I had to guess, by choosing to keep the car, I'd probably only get around $1000. that's just a guess. the other reason I agreed to let them fix it was I thought I was helping them out as well. right after they hit me, his wife said something to Everett to the effect of "don't you think it's best we pay for this out of pocket?" at the time I thought she meant pay to fix it out of pocket but perhaps she meant pay it's totalled value out of pocket. I'll readily admit communication on this could have been clearer, that goes for both parties. regardless, Everett agreed to fix it. I also agreed to this because I sympathized with him as a business owner trying to make it. I know that if his insurance premium increases due to an accident, that is overhead for his business. if he could avoid this he could help keep costs of running his business down while still fixing my car. so my decision was one I thought benefitted us both. I was very sympathetic at the time. he said he couldnt see my headlights behind him when I came to a stop. to me it seems he should have noticed me as I approached, but regardless, it seemed to me an honest mistake that anyone could make. I've made almost the same mistake while driving for my company. so yes, at the time of the accident, I was very sympathetic, and as Everett notes, I did say it wasnt a big deal. it's regrettable that it is now taking up so much of my time and emotional energy. that, more than the damage, is what has me so mad. I tried to make this as easy on them as I could, and this is how they repay that. let's continuenext they claim that I kept calling over and over again and yelling and screaming at his wife. this is another lie. I never cursed at either of them on the phone, nor did I yell at them. I did send a few mean texts, perhaps they are conflating this with yelling. they claim they offered to pay half of the appraisal. this is true, but again, why should I have to pay for half of it? it's irrelevant anyway, because If I wanted to total out my car, I wouldve started with that, using their insurance, rather than agree to let them fix it. As I said, insurance companies appraise values all the time. next they claim that the last time after I called is when I went to their house. this was actually not the last time I called but whatever. they claim I was banging on their door and kicking it and spitting on it. only one of these things is true, the banging part. I had just been hung up on by his wife and was very upset at the way they were treating me. I rang the doorbell first, they didnt answer. perhaps it doesnt work, I dont know. it was at this point I banged on the door, though I never actually yelled or said a single word or noise. I was knocking really hard, as I was furious. I could see how they would think I was kicking it, but I actually wasnt. they claim I was throwing a fit when he came to the door. if standing there silently while he yelled at me to leave with a gun in his hand is throwing a fit, then I guess that's what I was doing. next he claims his gun was only in his holster, but it was not, it was in his hand, in the slightly lowered but ready position. not sure why Everett would lie about this detail. I can understand why he came with a gun. maybe his wife didnt tell him she had just hung up on me and he had no idea who was at the door knocking so loudly. so I understand why he did this. then maybe he can understand why I came over so angry. I do not like being jerked around. next he claims they tried to come to an agreement but that I am "out of control", another lie. I actually called once more a while after this incident at his house, and again spoke to his wife. she didnt immediately remember me, so I kindly reminded her who I was and that last time we spoke she had hung up on me, at which point she promtly hung up on me again. I immediately called back. this time Everett answered and before I could utter a word, he yelled something at me which I couldnt understand because he was yelling, ( I assume it was a mix of threats and insults, but I could be mistaken) then he too hung up on me before I could utter a response. if this is what they would call trying to come to an agreement, well, I'd have to laugh at that.

moving on. next he claims that he thinks the $200 he put into my car fixed what he did and then some. again I have to laugh at this lie. he put nothing new on my car. he put no money into it. in fact, he must have kicked my fog light or something while he had my car because it was fine when he took it from me (I have pictures showing this), but caved in when I took back possesion of my car. all he did was remove the broken headlight and pound my hood flat with a hammer. I had to replace the headlight myself so I could drive at night, and I have the reciept to prove it. finally, Everett says he does not wanting me bothering his family. well, his wife helps him run the business, and was involved in this just as he was. so yes, I will continue to bother them until they do what is right and give me their insurance information so I can file a claim, or until a judge rules in my favor and orders them to pay for the damages. that'll cost Northstar towing a lot more, as I'll be going after them for all the court costs as well. everything I can get really, for wasting my time and treating me in such a manner

We can not agree on anything that has happened or any form of way to resolve the problem. This is why we are here, I do not have a problem having my insurance deal with these kinds of problems if that is what he would have wanted to do in the beginning. I can let him deal with them if that is what he wants to do. We are not going to get anywhere this way, That car is not worth more them $700 and the mileage at 242000 is pretty close to 250000 miles and for any vehicle that is a ton of miles. If he wants my insurance to tell him the same thing and he can go to there office and kick there door and spit all over the place then fine with me.

I am rejecting this response because:

It STILL doesn't contain Northstar Towing's insurance information. Factors other than milage effect a car's value, and mechanically, mine has enough work done to it to be worth at least twice what Everett is claiming. I'd be all to glad to discuss it with their insurance. I'm not the only one who didn't want to do it that way initially. At the point Everett decided he wouldn't be able to or didn't want to fix my car is the point he should have told me as much and given me his insurance information. They may not be able to agree with me on much
