Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] Please add your rejection comments below I do not understand why the company does not take responsibility for what unethically occurredInitially, we though it negligent misrepresentation and a mistake on their part based on misunderstandings of the sales team to comprehend our questions and give us the appropriate answers to the productWe have spoken to them at length before taking any action, and our aim is solely for them to correct their errorsThe sales team mislead us, twisting their answers to cater to our situationThe Director even had the audacity to say that if he were in the office that he wouldn't have even targeted us or would sell to someone who was only years oldOn that note, we were careful to ask specific questions regarding the product and many of the answers that were given to us were incorrect or misrepresentedWe are willing to work with them to agree on an appropriate penalty for "late cancellation." However, we never actually received a follow up call, as their responses have indicatedI had to call after the sales team called me at workI called them back and this is when I indicated we wanted to cancel (days after the initial signing)The Sales team had told us they were who we would liase with, and obviously, this was a rouse to keep us occupied beyond the day periodThey also indicated that we would have time to read through the contract, as we had already been stuck in their office for hours having stated multiple times that this wasn't the right time for us to make a purchase like this! They insisted that the price was their best, and since we would not be asked back at a future date, we had to sign now or never for their product and priceFor the product they had "proposed" to us, it was only appealing when they continued to knock fees and charges off of the balanceThey also had multiple different people come over and work with us in a fashion to coerce us to make a decisionIt is our intention to keep this clean and simple, as the company is at fault, yet we'd like to take responsibility for signing a piece of paper with the notion that we'd have time to read and cancel it within the weekThis is why we are wiling to pay a "penalty" as the contract does state! If you are holding us to this contract which your sales team tricked us into confiding in, then we'd like to hold you accountable as wellYou do state within days and at another point you state days cancellationAccording to this, we notified you within the days and should incur a penalty for being beyond the initial So, what is this penalty? Regards, [redacted]

Mr [redacted] did purchase a timeshare point package back in June of As part of the ownership/membership, we do offer discounted rates for overnights at our resorts as an extra benefit over and above his ownership within our family of managed resortsEvery resort sets their own discount depending on time of year and demand, just they way hotels doHe also has access to his membership with RCI a worldwide exchange/travel company with a vast array of discounts on his travel needs.Nowhere in the contract does it state the amount of the discounts because they do vary due to high demand seasons, and Mr [redacted] was told that at the point of sale.In our contract right above the signature line their is a paragraph in bold that gives the customer a cancellation period so they can look over the contract and if they want to cancel during that period, the would get a full refundMr [redacted] was told that, and tried to cancel after that time periodAt this time we cannot cancel the contract and give a refund. We are more than happy to assist Mr [redacted] is using his ownership and membership with RCIHe has the phone numbers to our reservation department as well as RCI, and can reach out to us for assistance at any time

Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] [That is a complete lie The sales person wrote in his own handwriting the rates that we would be offered He said that we could get these rates all year long Why would he write these rates on paper of they would not be offered all year long? We even asked him directly during the sales pitch if we could get these prices all year long His answer was yes, all year long He assured us that we would Prior to hearing about these rates, were not going to consider making a purchase But after hearing that we could get these rates in the summer months and all year, this offer became very attractive to us We specifically said to him that we recently purchased a new Pontoon boat and were interested in traveling around the north east to take it out on different water ways We said that we wanted to be able to travel with it and stay at nice places that were inexpensive He took us up to the front of the room and showed us the map of where they own properties throughout NY, Mass, Vtand other states He said that they have properties that we could stay at for the rate of $per night on week nights and $per night on week ends, all year long We made it clear that this is the reason their offer was attractive to us I am attaching a copy of the sales man's hand writing showing the rates that we were offered This is his hand writing I scanned it in to my PC to upload to you In addition, they had us fill out a brief survey right after we made the purchase It asked us to list reasons why we were joining today My reason #was Need places to take my boat to stay over #Inexpensive places to stay This company uses advertisement to make sales I realize that I made a mistake by not canceling by certified mail But what they are doing should be considered a crime They are luring people to purchase these properties with lies and deceit When you go to use the service, you find out that they do not actually offer what you were sold They get around it by the terms in their contract But I believe that the sales man writing this on paper should be considered binding, even if he didn't sign it What you see in yellow is my handwriting Everything else on the page was written by the sales man Another point that I would like to make is that I was not told that I had days to cancel I did not learn about this until I sent them a signed letter via email I received a call from the sales man the next day, when it was too late But no one actually told us that we only had days to cancel Furthermore, it takes them a minimum of weeks to get people set up in their system But the contract states that you have to cancel within days from signing Something wrong with that picture as well This organization is making sales by lying to people They knew exactly why we were interested in their offer So that used that to get us to make the purchase, even though they knew that they could not deliver it I want a refund from VRI We will never use their services or their resorts I will never pay them any maintenance fees, or user their resorts, everAnd by the way, we attempted to cancel within the days But we sent out cancellation letter via email We did not read the contract (our mistake) so we did not realize that we had to cancel via registered mail But they did have a signed cancellation letter from us before the 5th day It is very important to note that we were not informed that the rates would vary at all The sales man told us that we could get these rates all year long These are simply dirty sales tactics and we deserve a refund because we were flat out lied to As I previously stated, we attempted to cancel within the days ] Regards, [redacted]

After a dispute with his credit card card company, Mr ***'s credit card has been credited the amount that was chargedWe will cancel his purchase with us

Below are the response we sent to the AG's office for the same complaintMarch 24,02016 *** & *** purchased on 2/At which time, they signed a contract, and were given all signed copiesOn page of the purchase and sales agreement, it clearly states right above the signatures
what the cancellation/rescission time is per State Law It also explains what the process to cancel isThat gives consumers time to think about and change their mind if they want toAfter the sale, *** & *** went on vacation, and upon return, they had a follcall with the manager of that locationAt no time during the call did they express that they were lied to misrepresented or under duress when they purchased. It wasn't until a month later that they called to cancelI spoke to both of themFirst I spoke with *** who was very threatening and demandingThen *** called and was very civil and explained that after thinking about it and looking at everything, they didn't think they would use it that much, and the way they vacation right now was different then what we offerI explained that they were beyond the rescission period and I could not cancel the contractThe contract had been processed, and their membership with the exchange company had been sent inWe don't feel we as a company did anything wrong or that we misled, or coerced *** & ***I offered to assist them in any way I could to use what they purchased.May 3, Update: I am responding again to the complaint from *** *** and *** ***First of all, I want to reiterate that almost weeks after the sale, *** and *** were on a call with my sales manager, who always does a follwith every new memberNothing ever came up then that they were lied to or there was any misrepresentation or that they wanted to cancelWhen I talked to *** a month after the sale she stated that they just had a change of heart about the purchase and they weren't sure they would use it as much as they thoughtAs it says in the contract right above their signatures in bold print, per Vermont state law, they have three business days to cancelThat is in place to allow consumers who change their mind time to cancelUnfortunately, I can't refund money a month after the saleIn addition, at the point of sale they put the whole amount ($9,000) on a credit card with *** ***, which means they paid in fullSo it's not like we are just forgiving a debtWe would have to pay off the credit card because the bank wants their moneyI explained to both *** & ***, that we as a company would assist them with using the product they purchased to the fullest, but we can't refund the purchase

Dear Revdex.com & *** ***,To clarify *** & *** *** purchased a one week vacation ownership interval which included a year platinum point membership with the vacation exchange company ***, (*** *** ***) on October 5, not November 24, as stated. Per
page three of the signed Purchase & Sales Agreement the ***'s had three business days to cancel their contract Notice must be in writing either hand delivered or sent by certified mail, no such notice was ever received. I do not understand what is meant by "the place tacks on 4000," I can not respond.Regarding Ms ***'s claim of starting ten months in advance, this would have put her in the month of August 2015. I spoke and assisted Ms*** with her requested vacation on two separate dates in June 2015. The ***'s wanted a vacation in Maine during July, month in advance requesting a peak season with not many choices belonging to the exchange program. I did find them a location in Maine which they did not want. I also found them several choices in the White Mountain of New Hampshire which they did not want. Her comments of no on trying or looking is false. No one offered the free vacations, they were offered and given certificates for separate night stays at a cost of $per week, free of using a *** points. Each time Ms*** called I tried to work with her, she was very short and didn't want to take the time to understand her purchase.Sincerely,*** ***Office Manager, North Star Vacation Club

[That is a complete lie.   The sales person wrote in his own handwriting the rates that we would be offered.   He said that we could get these rates all year long.   Why would he write these rates on paper of they would not be offered all year long?   We even asked him directly during the sales pitch if we could get these prices all year long.  His answer was yes, all year long.  He assured us that we would.   Prior to hearing about these rates, were not going to consider making a purchase.   But after hearing that we could get these rates in the summer months and all year, this offer became very attractive to us.   We specifically said to him that we recently purchased a new Pontoon boat and were interested in traveling around the north east to take it out on different water ways.   We said that we wanted to be able to travel with it and stay at nice places that were inexpensive.  He took us up to the front of the room and showed us the map of where they own properties throughout NY, Mass, Vt. and other states.   He said that they have 120 properties that we could stay at for the rate of $59.00 per night on week nights and $79.00 per night on week ends, all year long.   We made it clear that this is the reason their offer was attractive to us.   I am attaching a copy of the sales man's hand writing showing the rates that we were offered.   This is his hand writing.  I scanned it in to my PC to upload to you.   In addition, they had us fill out a brief survey right after we made the purchase.  It asked us to list 5 reasons why we were joining today.   My reason #1 was Need places to take my boat to stay over.   #3 Inexpensive places to stay.     This company uses false advertisement to make sales.   I realize that I made a mistake by not canceling by certified mail.   But what they are doing should be considered a crime.   They are luring people to purchase these properties with lies and deceit.  When  you go to use the service, you find out that they do not actually offer what you were sold.  They get around it by the terms in their contract.   But I believe that the sales man writing this on paper should be considered binding, even if he didn't sign it.  What you see in yellow is my handwriting.  Everything else on the page was written by the sales man.   Another point that I would like to make is that I was not told that I had 5 days to cancel.  I did not learn about this until I sent them a signed letter via email.   I received a call from the sales man the next day, when it was too late.  But no one actually told us that we only had 5 days to cancel.  Furthermore, it takes them a minimum of 3 weeks to get people set up in their system.  But the contract states that you have to cancel within 5 days from signing.   Something wrong with that picture as well.   This organization is making sales by lying to people.   They knew exactly why we were interested in their offer.  So that used that to get us to make the purchase, even though they knew that they could not deliver it.  I want a refund from VRI.  We will never use their services or their resorts.   I will never pay them any maintenance fees, or user their resorts, ever. And by the way, we attempted to cancel within the 5 days.  But we sent out cancellation letter via email.   We did not read the contract (our mistake) so we did not realize that we had to cancel via registered mail.  But they did have a signed cancellation letter from us before the 5th day.   It is very important to note that we were not informed that the rates would vary at all.   The sales man told us that we could get these rates all year long.  These are simply dirty sales tactics and we deserve a refund because we were flat out lied to.    As I previously stated, we attempted to cancel within the 5 days.  ]

I do not understand why the company does not take responsibility for what unethically occurred. Initially, we though it negligent misrepresentation and a mistake on their part based on misunderstandings of the sales team to comprehend our questions and give us the appropriate answers to the product. We have spoken to them at length before taking any action, and our aim is solely for them to correct their errors. The sales team mislead us, twisting their answers to cater to our situation. The Director even had the audacity to say that if he were in the office that he wouldn't have even targeted us or would sell to someone who was only 23 years old. On that note, we were careful to ask specific questions regarding the product and many of the answers that were given to us were incorrect or misrepresented. We are willing to work with them to agree on an appropriate penalty for "late cancellation." However, we never actually received a follow up call, as their responses have indicated. I had to call after the sales team called me at work. I called them back and this is when I indicated we wanted to cancel (5 days after the initial signing). The Sales team had told us they were who we would liase with, and obviously, this was a rouse to keep us occupied beyond the 3 day period. They also indicated that we would have time to read through the contract, as we had already been stuck in their office for 3 hours having stated multiple times that this wasn't the right time for us to make a purchase like this! They insisted that the price was their best, and since we would not be asked back at a future date, we had to sign now or never for their product and price. For the product they had "proposed" to us, it was only appealing when they continued to knock fees and charges off of the balance. They also had multiple different people come over and work with us in a fashion to coerce us to make a decision. It is our intention to keep this clean and simple, as the company is at fault, yet we'd like to take responsibility for signing a piece of paper with the false notion that we'd have time to read and cancel it within the week. This is why we are wiling to pay a "penalty" as the contract does state! If you are holding us to this contract which your sales team tricked us into confiding in, then we'd like to hold you accountable as well. You do state within 3 days and at another point you state 5 days cancellation. According to this, we notified you within the 5 days and should incur a penalty for being beyond the initial 3. So, what is this penalty?

I do apologize; I somehow missed the initial email from the Revdex.com with North Star’s response and was unaware of it until after the file was closed. I do ask that the file be reopened and that this response be sent to the company. As you can understand, we prefer to keep our communications in writing with North Star due to what happened during the sales presentation, it is just a precaution we have to take. We are more than happy to discuss this further with them via this complaint or by email.  The only reason mentioned for denying our cancellation request is because we missed the cancellation period, but that just is not true. As our complaint states, we did try to cancel the day following the purchase. Our salesman [redacted] had an obligation to tell us there was a state mandated cancellation period and how to follow it. Instead, he refused to accept our cancellation request and completely omitted the laws involved. We unfortunately didn’t know to look into the contract for the information, when [redacted] said it couldn’t be done we believed him. Instead, we waited on the membership information we were to receive at a later date and once it arrived we were even more upset with what we found.  This entire experience has been terrible and we implore North Star to work with us in good faith.
