Me [redacted] statement in her complaint is incorrect that "I had 100% zero knowledge of" as you will see by the supplied documentation to this complaint.  According to the attached documentation Ms [redacted] was informed about this debt 18 times. Twice in a letter from my financial billing company...

ABC Financial on 3/14/14 and 4/1/14. She was called by ABC financial 18 times to her cell phone, answering machine and home phone as documented in the attached information from 03/11/14 to 6/03/14. One attempt was made by email but was not delivered on 3/16/14. Her account was sent to collections on 6/18/14 where the company continued to contact her regarding her delinquent account. I have requested the documentation from [redacted] regarding their contact with Ms [redacted] but have not received it to date. On Feb 13, 2017 I received a "Debt Validation Letter" printed from the internet from Ms [redacted].  This was the first contact I had from Ms [redacted] regarding her delinquent account. Because the letter required several items that only F[redacted] could answer, I sent the letter to [redacted] to respond. I spoke to [redacted] Compliance Executive at [redacted] where she informed me that they would respond to Ms [redacted] regarding the Debt Validation Letter.  I also contacted Ms [redacted] by phone (number from her original contract agreement) to tell her that her account had gone to collection agency [redacted] and gave her the phone number to contact them regarding her account. In her complaint, Ms [redacted] misrepresented the amount she paid for her monthly gym membership. As shown in the attached documentation, as she paid $38 per month by her personal credit card. Her employer [redacted] reimbursed Ms [redacted] for her gym membership $150 every six months after she produced documentation on her attendance signed by me the owner of ATF.  I did not receive payment from [redacted]. She made her dues payment every month from 6/30/13 to 2/01/14. She stopped paying in March of 2014. Her contract required membership from 5/6/13 to 5/20/14 and required a 30 day notice to cancel which she initialed on her agreement with a auto renewal clause.  Per her contract all she needed to do to cancel her membership was deliver to the club in writing a cancelation statement and completed her original 12 months of membership. She also signed another statement which stated she understood this policy.  See attached documentation. This was clearly stated in her agreement which she was given a copy of at the time she joined and verbally mentioned to her at that time. A phone call to the club is not sufficient to cancel a membership as stated and explained to the member. On 2/01/14 I received an email from Ms [redacted] stating ‘she forgot to call and have her deduction amount changed to $100 so she could cancel her membership, and is there any way this can still be done” The way this type of member communication is done per our standard operating procedure is to call the member and explain that the cancelation must be done in writing, give 30 days’ notice and have completed the 12-month term. I do not have written documentation regarding this phone call but it is how we handle every members’ question regarding cancelation referring them to our written policy.  Which did not make sense in this email is we do not deduct a $100 from her account and her employer handles her paycheck deductions not ATF. Ms [redacted] did not provide written documentation to cancel, ignored the numerous attempts to collect the past dues and the many attempts by the collection agency to settle this debt owed. Ms [redacted]’s complaint is unsubstantiated.
