Complaint: [redacted] I am rejecting this response because: The situation has not been resolved and in fact NWCU is now hreatening legal action

***DOCUMENT ATTACHED [redacted] Thank you for forwarding the complaint by Mr [redacted] .On November 1, Mr [redacted] contacted us via the NWCU Facebook page; he was provided follby phone with a member service specialist, who resolved his issue.The date of action for resolution he requested was November 1, 2016, the same date as the filing date of this complaint with the Revdex.com.Mr [redacted] experienced inconvenience and concern as a result of an employee errorWhile he did not in fact qualify for the holiday "skip payment" offer (consecutive months of loan payment must precede the "skip", and his loan did not qualify)-it is also true that at least one teller indicated he could apply and simply pay the required $service charge to receive that service.Because our employee provided information that led Mr [redacted] to expect to receive the adjusted payment; and because no follcommunication was provided to correct this impression, when we learned of his complaint on November 1, we retroactively provided him the "skip" payment for the month of October 2016, and reversed the late-fee charge on his loan, as well as waiving the $service charge.We believe Mr [redacted] is satisfied with this outcome; should you receive further complaint communication, we will be happy to communicate directly with the member

***DOCUMENT ATTACHED [redacted] August 8, [redacted] ***Dear [redacted] By way of this letter, Iam correcting some of the facts you offered, in error, to the U.SDepartment of Justice (DOJ) regarding a third party check you deposited into your account at Northwest Community Credit Union (Credit Union)Your deposit in question was via the Credit Union's ATM and made on June 9,2016,rather than June 16, as stated in your July 29, complaint to the DOJBecause we do not accept third-party checks, this deposit of $was reversed on June 10,You've stated to the DOJ that you had no notice or warning;actually, you were contacted by our branch that day as well, to explain why the check was reversed-and to indicate you could pick up the check at the branch.In addition,I have learned that our branch manager advised you on at least one other occasion that the Credit Union does not accept third party checks.Five days later, on June 15, 2016, $was automatically debited from your account, which had insufficient funds available to cover the paymentIwant to point out that even had your June 9, deposit been credited to your account, your account would have still been overdrawnTherefore, the Credit Union charged its standard overdraft fee for this transactionAgain in July,the same scheduled automatic payment was presented to your NWCU account with insufficient funds, but with the earlier outstanding items, the amount exceeded standard overdraft protection and was declinedThis transaction also triggered a standard overdraft fee.The Credit Union made several attempts to contact you by phone to satisfy your overdrawn account, to no availAccordingly, we had no other choice but to close your accountYou will receive your third­ party check by certified mail.In an effort to amicably resolve this matter,the Credit Union sent a collection letter on August 3, informing you that you owe the Credit Union $If arrangements are not made to pay this debt in full by August 16, 2016, the Credit Union will be forced to take measures to collect the debt and may seek to have you expelled from the Credit UnionTherefore, Iencourage you to contact Northwest Community Credit Union as soon as possible to resolve this issue

In researching your February 13, complaint to the Oregon Revdex.com about insurancewe force-placed on your vehicle loan, I must correct some of the detail you offered in your complaint.First, I must emphasize: We've been in communication with you on this issue both before and
sinceMarch of 2013, when the additional amount for insurance would have been itemized on your statement.We tried to help you resolve this at that time in as follows:March 1st of in a phone conversation, you were again informed of the need to provide proof ofinsurance, and you indicated you would provide this but did notYou did indicate there was a gap incoverage during your state employment; you assured us you would email or call back; and, you clearlyunderstood that in all loan documents, you agreed to provide full coverage for the vehicle.Subsequently, when it was verified that you did not have insurance, on March 7, we addedinsurance to the loan to protect credit union's interest, as stated in your loan security agreement.At this time, there is a past due remaining balance owing on your loanPlease call Member Solutions at800-237-at your earliest convenience to resolve this matter.Sincerely,John *I***President/CEO*Please view attached document

While he did not in fact qualify for the holiday "skip payment" offer (12 consecutive months of loan payment must precede the "skip", and his loan did not qualify)-it is also true that at least one teller indicated he could apply and simply pay the required $40.00 service charge to receive that service.Because our employee provided information that led Mr. [redacted] to expect to receive the adjusted payment; and because no follow-up communication was provided to correct this impression, when we learned of his complaint on November 1, we retroactively provided him the "skip" payment for the month of October 2016, and reversed the late-fee charge on his loan, as well as waiving the $40.00 service charge.We  believe  Mr.  [redacted]  is  satisfied  with  this  outcome;  should  you  receive  further   complaint communication, we will be happy to communicate directly with the member.

Northwest Community Credit Union did inform Mr. [redacted] of our policy to hold the title until final payment as well as the restrictions on the use of credit/debit cards for such a payment. We also recently provided him an alternative option to release his title. The “possibility of dispute” Mr....

[redacted] is referring to is the fact that under federal regulation, consumers have a right to dispute transactions on their debit or credit cards for up to 60 days following a transaction. For this reason,  for final payments that result in releasing a title, we require that dispute period to be past before releasing the title; or, alternatively, resolved with a different form of payment such as cash. Mr. [redacted] was informed of this policy at the time of his payment; these terms are covered in the Membership and Account Agreement regarding the use of a credit or debit card. Our Member Solutions representative did speak with Mr. [redacted] on June 13th regarding the release of title and the option of bringing in a deposit that we could hold until the 60 day time period had expired in order to release his title.  He seemed interested in this option, but as of June 21, we have not heard anything further from him and there are no funds in his account.

This transaction also triggered a standard overdraft fee.The Credit Union made several attempts to contact you by phone to satisfy your overdrawn account, to no avail. Accordingly, we had no other choice but to close your account. You will receive your third­ party check by certified mail.In an effort to amicably resolve this matter,the Credit Union sent a collection letter on August 3, 2016 informing you that you owe the Credit Union $244.06.
