I was hired to design and build a deck. I was given a 5000 dollar deposit. The deposit was to cover deck plans, a geotech survey and permits.   Upon reciept of the deposit I hired a company to come out and do a geological survey of the topography and its soil content to ensure the hillside...

could endure the weight we were to place on it to build the deck. The site portion of the survey was completed in july. I recievied 25 pages of a very detailed report of the survey in late November. I never recievied a bill from them. I moved in August and didn't think to update my address with them. I have used this same company in the past and upon completion of their survey it took almost 7 months to get a bill. When I didn't have one after 2.5 or 3 months I didn't think anything of it. My intention was never to skip out on paying them, as I had the money still in my account awaiting their bill.   While I was awaiting the survey and the report I enlisted a company to draw plans for me. The plans took much longer than expected. When I got them I noticed some things were inadequatly drawn. So I took the liberty to finish the plans myself rather than draw out the timeframe any longer and go back to the person who drew the plans.    When I went to the county to turn the plans in I was asked to provide a site plan. Typically I can ask for an as built which has a site plan already drawn for the house.  There was no as built on file. I spent 5 hours over the next 3 days at the county trying to figure out where the drain field was and where the cap was. The county's records haven't been recorded and put into their computer system. They only have old plot maps. None of which showed where the drainfield is. The given location description was "under the swingset" and there was no record of who  hooked up the actual drainfield, only who installed it. We later discovered the cap was located in the center of the driveway.  We happened upon an inspection report from 2008 if my memory serves me right. This report wasnt recorded anywhere, we happend to find it in a stack of papers. To finish the site plan I had to go bacl to the property and triangulate various points of the house, garage and shed to accurately show where they are located.    After I had the geotech report, combination of computer generated and hand drawn plans I again went to the county to turn them in and once again get the process moving forward. Shortly before that I had spoke to Mrs. [redacted] and she explained that they had been given a stop order by the county due to some clearing they had dome on the property. She had been into the county and they were advised to obtain a civil engineer to assist with determining a course of action to be taken regarding the stabilization of the hillside. When we spoke she asked my opinion and if I could recommend anyone. Before I could get ahold of any of my contact she was able to find someone. I then met with the engineer onsite and when asked who the point of contact would be for the project my name was give, as I was told I would be the person making the needed improvements as suggested by the engineer.    When I went into the county to turn the plans in they told me the property had been red flagged due to unpermitted clearing resulting in the instability of the hillside. I told them I was aware and would be meeting with an engineer at the property (i knew of the issue but had not met the engineer out at the house yet) when I told the county I would most likely be dealing with the violations they were relievied. Typically when there is a violation on a property it is not common practice to allow any additional plans to be submitted for review until the violations have been addressed and fixed. However, due to my reputation with the county I was able to get special clearance to submit the deck plans for review. I was told that if the violations were not resolved before my plans were approved that the county would sit on them until they were. This saved about 6 weeks.    Since I was asked not to come back I have given back 4300 dollars to the [redacted] (this was received and signed by the [redacted] at receipt on 3/8 at 2:32 pm, before this complaint was sent to us. I spent alot of time behind the scenes trying to get everything taken care of. I feel part of my job as a contractor is to protect my clients from the everyday hassels of the construction process. There alot of stressors we as contractors deal with and my professionalism is to assure my clients thay things are taken care of. My clients pay me to bare the weight of these stressors so they dont have to. At no time was I ever looking to not pay anyone. Im very sorry things came to this. I was very excited to complete this project for them.
