RE: *** *** ComplaintRepresentative at Revdex.com,This letter is to explain our position in regards to the above referenced complaint toward our businessThe *** s and Northwest Logging Company have a contract that states the responsibility of both partiesWe offered a FREE estimate prior to
contracting with the *** s to give them an idea of the value of their timberThe estimate in this case was given prior to property lines being put in and was based on a Selective HarvestThis means the highest value timber is harvested while the timber with very little or no value is left behindI warned them that there is always a chance the numbers may vary because this was just an initial estimateThe reasons for the variance can be a number of different reasons but the main ones are timber quality, where the accurate property lines are located, and if they choose to keep timber that we had originally planned to harvestThe owners should have paid for a timber cruise to be done along with pay for property lines to be surveyed prior to having us bid the project if they wanted a guaranteeInstead they invested nothing out of pocket in the project and expected a guarantee in returnThe *** s told me after we signed contracts that they wanted a thinning instead of a full harvest like they were originally quoted forI said that was fine, even though that changed the contract we signed and lowered my company's revenue on the projectI told them I would walk the property before we started to learn their plan for the harvestWhen we met with them it was very clear that they wanted a very specific evenly spaced thinning so that the property was ready to be sold down the roadThis harvest plan required several more loads of better quality logs to be left (value I had counted on them earning)I agreed to do the type of harvest they requested and went through with the workWe did a good job at leaving trees spaced throughout the property as they requested and the *** s frequently gave us feedback that everything on site looked very goodWhen the volume of the harvest was realized I told *** *** that the numbers were going to be less than expectedTheir claims that we owe them the money is ridiculous and just an attempt at the *** s to get something extra out of usThe *** s are not owed anything from Northwest Logging Company and have cost our company more money by changing the original plan.In regards to brush piles and logsWe stack brush on every project exactly the same, this is so that there is good enough ground conditions so that new seedlings can be plantedWe did complete this much brush stacking and the *** s are upset because it didn't reach their expectationsStacking brush the way they want is much more labor intensive and would have cost them much more to do soWe met our obligation as stated in our contract and they are now looking for something extraThe owners are also upset about a few logs left on the landing at the end of the projectEvery project we have ever done has a few logs left over due to the fact that nobody has the ability to estimate the exact weight of a tree before it is fellTrucks can only legally hold a certain amount of weight and so as trucks are filled we try to ship every log that is made, but there is always a few that cannot fit on the last loadIf you ship just a few logs on a truck then what happens is the cost of trucking is more than the value of the wood, which means the owner and I would lose money sending the last few logs to the mill, as we share in the cost of the truckingMost owners prefer us not to take these last few logs because they would rather make more money and have a few cords of firewood to use for themselves or a friendThey told me the logs upset them after we had already finished the job not during and so I said I would gladly pick up the logs for themOn 12/I had some of the logs removed and was planning on doing the rest the next weekSince then I received this outrageous complaint about my company.At this point we have honored everything spelled out in our contract, but the ***'s are looking to get more money out of my companyThroughout the harvest, *** *** would repeatedly try to get different members of our crew working on site to do little side projects for her in regards to tree trimming in her side yard or falling dead or dying treesFalling dead trees and doing any work near a residence is not in our scope of work as it is exceedingly dangerousThis is what tree service companies specialize inWe did a few of the requests for her to be nice, but the requests kept coming, we have done logging long enough to know this type of client wellWhat they do is try to get you to complete a list of favors for the outside of your scope of the project so that they don't have to pay a tree service company to come out and do the work or do it themselvesThese types of clients are never very happy with the project because eventually you have to tell them NO to their constant requests for extrasI would also like to make the point that the ***'s stated in the complaint that they only made 50% of the original estimate, but separately they stated they made $19,This actually means they earned about 64% of the original estimate and with the added value from the trees left at their request their value would have been very close to the original estimate.Separately from this complaint, *** *** has already threatened to sue my company and explained to me she had been talking with an attorneyIn light of these facts I'm sure you can understand why my attorney has suggested I no longer work with the ***'s until this issue is resolvedI told them I could finish picking up the logs left on the landing along with doing some additional brush stacking if I were to receive a document from them stating this would be their last requestI was under the impression they would be sending that to me and so I had a crew out removing the logs on 12/Since then I have received this complaint from
Revdex.com and am yet to receive the signed letter I requested, I will not be doing other work until my company is protected from further issues from the ***'sI also request the letter they are tosend me to elaborate and say that they will not ask for anything else along with stating they willnot slander my company in anyway or file another complaint against me or my companyI also need them to remedy this complaint via the Revdex.com as it affects my business and I cannot invest more of my company's money to do extra work for them with the fear of future complaints.Settlement Option: The *** s give me a written statement signed by them that says they are satisfied with the outcome and will not request anything further from Northwest Logging CompanyThey will also include that no further complaints will be made against my company in any format and they will not try to "ruin my business" like *** *** threatened to doThey will also add a positive response to the Revdex.com complaintIn return my company will gladly come out and finish removing the logs on site and do additional brush stacking immediately upon receipt of the letter.Thank you.Northwest Logging Company
