RevDex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. I received the message from BBB saying that I did not reply to the business and that the complaint is closed. By the way, it took me some time to collect all the facts in order to respond to Mr W***. Unfortunately, Mr W [redacted] does not tell the truth. After I hired him through the tax defense network to help us with the two tax examinations we had, after my first CPA let me down in the middle of my tax return, we immediately provide him with all the information he needed to finalize our tax return 2013. At this time, we were still under extension. My bookkeeper at this time (September 2014) send him a copy of my books. He did some work with the IRS about the audits but did not do anything about our tax return. After that I had hard time to communicate with him and he remained silent for several months. When I finally reached him, in July 2015, he had done nothing about our tax return despite I had paid him in full upfront $3150 and he pretended that he never received the books. My bookkeeper, Mrs Linette W [redacted] can testify that she sent the book a first time at the very beginning and that she had to resend the books 3 times (2 times by email and one time on a flash drive) in July 2015 as Mr W [redacted] probably misplaced them. Finally, as soon as he had finished the preparation, I sent him the signed copy of the return but he gave me a wrong address! I received the envelop back with the mention address unknown and we lost one additional months to file. The consequences for us of Mr W [redacted] negligence are big as we have to pay to the IRS an additional amount of $ 3184.51 in penalties and interests for late filing. So I ask again that Mr W [redacted] refund me the money I paid him upfront for a very poor service and the refund of all the penalties and interests generated by his negligence so a total amount of $3150+$3184.51= $ 6334.51 . If not, I will not hesitate to take further action but I still believe that an out-of-court settlement is always better than going to court. I thank you in advance for your help. Best regards, ***

I have already provided the information regarding this complaint This client is upset that she has to pay (a lot) of income tax to the IRS and that they assessed penalties for her filing her tax returns well over one year late (returns were already late prior to contracting me.)

[redacted] charged me $1650, and did not help me.  When I first hired the tax company, I had no one to turn to.  He was suppose to resolve my federal and state tax issues.  He didn't do the state tax, so I owe even more now because of taxes and penalties.  I thought what I needed required a tax guy, but after a year and a half of not hearing from [redacted], and waiting weeks for any response, I finally went and talked to a local IRS office last week.  I found out that I owed $600 less that what [redacted] told me. In total, I owed the government under $1000. [redacted] charged me $1650 to put me on a payment schedule, basically.  He is a crook. I told the lady at the office what happened, and I will be filling out a form to complain about him to the IRS, also. The lady also informed me that if I paid my debt within 4 months, I wouldn't get charged the $100 fee to be on a payment plan. Not only was I charged an outrageous amount, but I had to call and email over and over and over to ever get a response from [redacted]. He failed to mention that I could have saved $700 total, and charged me more than I owed the government.  He is horrible at his job, and he is a crook and a cheat. I"m sure I wont get any money back from him, but I would like it to be known that this is how he handles business. I shouldn't have paid him that much money, and I deserve at least some of it back.

accompanying penalties and interest. The reason for this is thatshe was unable to document many of the expenses originally claimedon her income tax return. The IRS does not allow unsubstantiatedexpenses to be claimed on a business tax return. Ms [redacted] didprovide me with documentation for some of the expenses underexamination and I delivered that documentation to the IRSrepresentative who in turn allowed those expenses to be claimed.explained this dynamic to my client throughout the audit process andshe told me she understood.Concerning the filing of the 2013 income tax return I agree that it tooka very long time to finalize the preparation and filing. Almost all of the"delay" that Ms. [redacted] describes was a delay in her bookkeeperproviding me with information and documentation required to preparea thorough return. I received the signed return from my client abouttwo weeks ago at which time I countersigned and mailed the return tothe IRS. The IRS will likely not show record of this return being receivedfor weeks yet to come because that is how long this process takes.Because ofthe IRS penalty assessment and abatement procedures it isnot clear at this time what the final amount of penalty and interestcharged to this client will be. And I assert that all or almost all of thealleged "delay" in preparing and filing any documents was due to delayin my client and her bookkeeper in providing me with requiredinformation. I prepared the return as I received information from myclient and I did so in a timely fashion. I am prohibited by law from filinga return that I know to be either incomplete or inaccurate. I haveperformed the tasks I was hired to perform. And I thereforerespectfully decline the request to refund any monies to this client.I did in fact, due to a typo in an email, give this client an incorrectmailing address for my new office location. That may have caused aweek or so in delay of filing the 2013 return -one week out of eighteenmonths passed since the original due date for that return- a due datethat had already passed when I was engaged.I know that the income taxes and the preparation and filing process canbe stressful especially when audits and late filings are involved. But thisin no way means that I am responsible to pay this client's income tax orother liabilities to the IRS.As with any of my clients I am available to discuss IRS tax policies andprocedures with Ms. [redacted] along with the available options forpetitioning the IRS for penalty abatement and/or tax payment options.At this time it appears the IRS is taking between two and three monthsto process prior year income tax returns such as this client's 2013return. So sometime late this year or early in the new year I expect tobe able to address the penalty abatement and payment option topicswith this client. I performed all of the representation and preparation work as contracted in our engagement agreement.  This client asked me to perform additional services that were not contracted.  She was upset that I would not perform those additional services without an additional fee.The client was...

inadvertently overbilled as she describes but those monies were promptly refunded to her.

Work on this client case was suspended for non-payment.  Per the agreement all funds would be due and work would not have to continue.  I discussed the situation with the client and we verbally agreed for me to continue work on best-efforts basis and to continue to charge monthly payments...

to the client.  While work was in progress the client revoked Power of Attorney, making it impossible for me to continue work.
 
I am happy to complete any contracted work for payment of my fee if the client will re-instate Power of Attorney.  I can do nothing without that in place.
 
There is no provision in the contract to set up an Installment Agreement with Wisconsin.  There is no provision in the contract for ANY work with the state of Minnesota.

If not, I will not hesitate to take further action but I still believe that an out-of-court settlement is always better than going to court.
