Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear belowFirst thing is I am not a general contractor for a home builder, my wife is I built my pool through BYOP (Build your own pool) at AZ Wholesale Pool Equipment and some of her subs that were better priced and recommended The reason I do not accept this resolve is because there are no proposed actions to resolve my complaint even though he admits to not finishing what he was paid for I have many texts, emails and phone calls saved showing that he admits to this being his fault in assuming the final finish was pebble tech I never told him what the finish was supposed to be I gave him more then weeks to fix the problem From the time the problem was recognized he spent over days giving me the run around and excuses why he couldn't change the heads, being out of stock at the supply store which was a lie or they cost him $and too much money etcall being lies of course He claims he is a subcontractor but that is impossible being that he is not even licensed or bonded, another lie The plaster company, Cal Plastering is the largest pool finish company in Az and said they would absolutely not be able to add that much extra material to fix his mess up Which is why they had to be called off the job separate times He has now been telling me since January he is sending the check for the refund of the full amount I paid him to make up for the cost of the heads that had to be replaced But now he is telling me he is going through a custody battle over his kids and thats why he can't pay me I have offered to accept just what I have paid him, I have offered to drive to him to pick up the refund, but he refuses to do so Please see attachments above of past emails, I am still trying to figure out how to download audio files from my phone and text messages The bottom line is he says multiple times he would fix it and then refund it, neither ever happenedThe plaster was supposed to be done by Jan 9th as stated in attached emails It was finally done Jan 30th due to his lack of follow through Now he says his cost was $each then why wasn't it just done the next day? My resolve for this is to be refunded the entire amount paid $minus the clean out cost of $plus his "cost" of $each collar The total then would become $I feel that is more then fair being that I haven't even brought the cost of the other start up guys into this and the fact that I had to pay $a collar.Here is the math just to make sure.($885)-$ =$610+$ =$ Regards, [redacted] ***

Mr. [redacted]  contacting me at the end of December of last year to possibly do a new pool start up set  popup cleaning heads collars and clean out the pool.  I provided him with the estimate which was send Dec. 30th 2014 for the following job in detailed..Install pop up heads...

$210 Install water valve internals $35 Install screen logic $65New pool start up $300Clean up $275Total of $855 I received a call saying that I was awarded the job and on January 14 of 2015. I scraped and cleaned the walls and the floor of the pool. Pumped out on the water and clean up all the construction debris left in the pool internal area of the pool to prep it for Pebble Tec.  Once this was completed all debris was carried out and dispose of off of customers property no trash was left on site. I installed the heads had a nice conversation with [redacted] he paid me in full even though I have not done with the new pool start up he said he would give me a few days heads up prior to them filling the pool with water to schedule start up. I received a call about a weeks later letting me know that the pebble tech company he has chosen to do the interior surface would not shoot the inside of the pool due to the fact of the height of the heads were too high for the surface selection by Mr. [redacted] which is Pebble Fina.  This finish is a very rare finish that you will see in the metro area [redacted] neglected as the general contractor to inform me of this unique situation I told him I would see what I could do I called several other plaster companies they said yes they could shoot it an 1/8" thick  to 1/4" thicker. I talked to the company who was hired to install the surface they said they would be okay with adding extra material if Someone paid the over cost. I told him I would split it with the homeowner or the general contractor at that point. [redacted] took it upon himself to hire somebody else to come out, remove the collets I installed and set new collars at his own expense I was not given an opportunity to perform this task myself which each collar at my cost is $9 where he paid $30 per coller. He refused to allow me to start a pool there for forfeiting the ability for me to go out and complete start up. Here's a gentleman who took it upon himself to be the general contractor of building a swimming pool, I understand he is a general contractor for building homes and is unfamiliar with the steps that are taking to build a pool properly, so himself did not know the difference between the thickness of pebble Tec, plaster, pebble fina [redacted] or a all tile pool as the general contractor on this job that was his responsibility to inform the subcontractors to give specifics to the installation.

As far as his complaint goes BYOP build your own pool is just that they sell him equipment and get him in contact with suitable subcontractors that's all BYOP provides they do not instruct the homeowners on how to build the pool and what stages and how is done that is why they save 30% on building a pool. They should be informed and do their homework and research so they understand exactly what is going to happen they  rely  on the  subcontractors to  educate them.  Order builders rely way too much on a subcontractor who is instructed to come and do their job and leave with no instructions the homeowner just assumes we know what is going on in this case  I was hired to set the heads which I did and I set them like I would on any other pool this homeowner or his wife neglected to tell me that they were doing a special rare finish called pebble fina.  I guess the bottom line is the homeowner was the general contractor and any project being built the general contractor is ultimately responsible for everything that is done on the project.
