*** in regards to a dispute issued by SpitFire Training in Webster, Texas, by *** ***In regard to his issue with wanting his money back for the Summit Elliptical Trainer here is my response:Mr***, in his own words, claims Norton Fitness delivered the wrong piece of equipmentIn the invoice, which I have included at the end of this letter, he was properly invoiced for a Life Fitness Elliptical Summit TrainerThe piece of equipment that was delivered is indeed a Life Fitness Elliptical Summit TrainerI, *** ***, was at SpitFire training the day the Summit Elliptical Trainer was delivered and Mr*** had no issues with receiving the piece andaccepting deliveryFurthermore, I have also included a copy of an email between Mr*** and myself in which I include a hyperlink to the website with a photo and specifications of the Summit Elliptical trainerI clearly ask Mr*** for his input of the Summit Elliptical Trainer and he responded with the phrase “very nice.”Secondly, used fitness equipment is delivered “as is” and there are no refunds, exchanges, etc. After some time of having this elliptical, Mr*** expressed he was “not sure” whether he was satisfied with the machine and claimed he was not sure if his clientele would use the machineI reiterated to Mr*** that there are no refunds, however, I said if he was truly not happy with the machine he was welcome to call me and discuss exchanging the machine for another piece, subject to availabilityDuring the month of August, Mr*** expressed he was not happy with this Elliptical Summit TrainerIn previous emails, he had expressed interestin an Olympic Flat Bench PressI had three, and at the time, was willing to discuss an exchangeAfter multiple attempts to reach out to Mr*** via phone, I received a text message on my personal cell phone and called Mr*** to discussRather than returning my calls, Mr*** would send a text message hours laterI reiterated to Mr*** on several occasions I wanted to discuss this matter over the phone to see if we could reach an agreementInstead, Mr*** proceeded to send threatening text messages and emails rather than return my call to discuss a possible exchange. The elliptical has been in his gym for over six months during which the city of Houston received historical flooding during Hurricane Harvey at the end of August The area in which Mr***’s fitness center is located received heavy damageNorton Fitness is not aware if the elliptical is even in working conditionMr*** is claiming we delivered the wrong productto him (again, he paid for this product and accepted delivery, see attachments), and now he is demanding a full refund for a piece that is more than likely not functioning properly, due to his own negligence, lack of care, and/ or an act of God.Norton Fitness’ official response is that we will not give Mr*** a refund, nor will we exchange the piece for anything elseOur policy with used fitness equipment is there are no refunds or exchanges and unfortunately we cannot make an exception for this one case.If you have any other questions, comments, or concerns, you are welcome to address them to us in writing at the address at:Norton FitnessResearch BlvdBuilding 2, Suite 350Austin, Texas 78758Sincerely,*** ***President, Norton Fitness
