*** *** has obviously not reviewed his records where I am concerned otherwise he would not have responded in the way that he has
I have emails showing that his leasing agent ***, contacted me via email on Monday, July 28, to let me know that I had been approved to lease with Nottingham VillageHer email also alerted me that I need to be sure to get renters insurance, my initial modate was set for August 16, 2014. I went in later that evening after work to ask *** if I could see the model apartment again because I didn't recall seeing any storage areaShe gave me the key to the unit *** if I remember correctly, when I returned I told her it did not have storage, so I may have to do something elseI went home reviewed my belongings and determined at that time, the 2/that I was approved for was indeed too smallI went in on my birthday the next day, July 29, to find out if I could opt out because the unit is too small***, informed me that the unit had been taken off the market for days while working to get me approvedOnce I was approved refunds are not allowedI gave them $I understand the processing fee not being returned but the $deposit they would not returnTherefore I was forced to accept another unit unseen because they did not have one available to show...otherwise I forfeit my depositSo I agreed, and I asked if he could respect the rental amount that was posted at the time I initially applied, which was July 25,, 2014, *** said that was not a problem because it was only $difference if I am not mistakenHe didn't have one available for August which was my original move in date (16th); but a resident was moving out on 08/31/and he could have my unit ready for moon 09/06/I acceptedI then alerted my then current landlord that I had been approved for an apartment and I would move out on 09/06/14; he was fine with thatHe has sold the townhome I was living in and had given me until 09/30/to relocateSo 09/06/was perfectI have emails to support what I am sayingI received emails from *** and from ***
At different times of the day or evening I would drive through the complex to see what type of neighborhood I was moving intoThe weekend leading up to Labor Day, I did go by and I saw that the current resident of ***, the unit I was approved to move into on 09/06/was still thereI became concerned when I realized that Monday was a holiday and I wondered how in the world would they be able to prep that apartment for me in 1/daysSo I went by the office to talk with ***, she was very abrupt with meShe told me that, that deal was between you and ***, if it had been me, I would have told you 10days to be ready, so you will have to talk to ***She told me that the lady had been there years, not years and that she was moving out on Sunday, 08/31/of course I was concernedI told *** in an email that I am trusting him to come through for me, because since I told my landlord I would be moving on the 6th he was expecting me to be moving, it was an agreement*** sent me an email, stating that he was having feelings of trepidations about me not being happy in his communityI said, I am trusting you to get this done, I am staying prayed upI am an organized person, and I wanted to make sure there were no hiccupsOn Thursday 09/05/another representative, ***, phoned me to ask me if I could come in Friday morning to sign the lease, but I could move into the apartment until after 5pm on Saturday, because work was still being done, she stated she can't even give me the key until 5pm, Really?! you want me to come in on Friday morning to sign a lease, but I can't get the key until 5pm on Saturday, I think notSo I did not go sign the lease on Friday morning, I went on Saturday morning at 11am; *** would not talk to me again, the representative *** ran the show this timeSo yes, I did go to the unit, the contractors were very nice men (2)They told me "This is ridiculous I don't know why they tell you this can be ready today, it cannot" So I went back to the apartment , and told them what the contractor said, they became very upset because I talked to the contractor, told me that it was a liability issue and they would be talking to the contractors
***, then told me quietly, *** knew this would not be ready, they were talking about it on Wednesday saying there was something wrong with the sub-flooringShe told me to look at the apartment before I signed the lease and that's the best advise she can give meI've already explained why I didn't move my furniture into a vacant apartment, that he should have just leased to me
On Sunday, the contractors didn't show up, and it wasn't because I made them feel uncomfortable, they told me, they don't work on Sunday, it was time for family and football
When I was able to talk to ***, I simply said, this is unacceptable I need you to cancel this lease and return my money*** said, I understandI would do the same thingI just come here to help them out on occasion because I use to be a property managerLet me just phone *** and get the okay, I'm sure it won't be a problem, clearly the apartment is not ready, and we don't have one we can give youShe phone ***, he told her to write Void on the lease, return my money orders one for $1000, the other for $She made copies of the returned money orders and gave me a copies of the money ordersShe wrote on the copies Returned in full asked me to sign it; but I also wrote on that she I want my deposit returned as wellToday, I phoned ***, he would not speak to me, but told his assistant to get my mailing address and that he will be expediting the deposit refund from CorporateThat was this afternoon 09/08/at 12:01pmI gave the young lady the address to my employer, since I am displaced and I don't have an addressWhat has happened to customer service, what has happened to being people oriented? where is the care, concern? where is honesty, loyalty and justiceI am displacedIf *** had reviewed his apartment log correctly, he could have said *** the first available date that you can move will be 09/15/that would have been fine, because my landlord had given me until the 30th of September to relocateHowever, after *** told me the 6th of September, then that made me, as well as my landlord happyHe could move sooner on his plans for the unit***, voided my lease agreement only because he was unable to complete the task in a timely manner as promised, he knows that this mishap is no fault of mineThis is his business, and he did not plan properlyHe returned my rent money, and therefore suggest he broke the lease contract and he should also return my full deposit and pay for my uhaul rental and punitive damages for my displacement*** did not properly execute the plan for a successful move-inI am without a home, and I have to figure out how to get my child back and forth to school on Memorial dr and *** ***I work 8-she gets out of school at 3:what am I going to do? she couldn't even attend school todayLast week I had a place of my own, today, my child and me are homeless

[redacted] first leased one of our medium sized two bedroom units for a move in date of 9/12/2014. We held a unit off the market for her for and after nearly a month [redacted] tried to cancel her application, because she suddenly came to the realization that she could not fit her...

belongings in the initial style of home she had rented. Being that we held a home for her and her application was approved, she was told the deposit was not refundable after approval, as is standard practice of retaining the deposit after approval as liquidated damages. When this was told to [redacted] she said she could not afford the loss, and would take the option of the size larger, I even went so far as to honor the old price of the larger unit that had since increased in order to accommodate her. There were no new fees charged as could have been per the law and the owner's policy. [redacted] was not happy about the unit not being an upgrade like the smaller one she leased, but agreed to it for the increases square footage, but she insisted on moving on the 6th of September due to circumstances with her current landlord. We agreed to push the move in date up, but she was informed it was occupied and that the current resident was upgrading and would be out by 8/31/2014. On Monday the first of September I was informed by the tenant in [redacted] (the unit [redacted] leased) that she had been by the unit itself without our permission and was asking to see the inside of the unit as they were moving. After reassuring [redacted] by email that we would completely refurbish the unit because the tenants had lived there 10 plus years, she said she trusted us and she would come to sign the lease and take possession on the 6th. She was informed that she would need to wait until after 4pm on the 6th to come take the keys, because we did not receive keys until the second and were expediting her move in in about a weeks less  time than we normally require.
 On the morning of the 6th I received a several calls and text from the office staff saying that [redacted] was already in the office and the apartment again (without permission since no lease had been signed, or rent exchanged hands) and that she was being very abrupt and rude our carpet vendor, to the extent that he felt uncomfortable staying, but agreed to return the following day to finish the floor repair and the carpet installation. She was told that she was welcome to stay in our fully furnished model for the evening, which she was given the keys to. She was also offered the option to move her belongings into the first floor of the townhome she was going to rent as the carpet work was being completed upstairs. The carpet work which would have been done if the vendor who was doing it would have not been intimidated and left the property to avoid the situation. On September the 7th at approximately 1:45pm I was notified that she was canceling her move in and was requesting a refund of her deposit. I told the staff member I would look at it in the morning.
  In closing [redacted] has not given us the fair opportunity from the beginning to accommodate her  housing needs. She has taken our time, and financial resources and left us in a larger financial bind of making ready that is now ready and unrented. She will not be compensated financially or otherwise. Her deposit being refunded is not even optional at this point in light of the work, time , expense incurred due to [redacted] not planning her move in accordance with her necessary budget and timeline.
