I am the finance manager who assisted in the paperwork for [redacted]. He was explained by myself that a $100.00 deposit was required in order to hold the vehicle while he waited for approval from his credit union to complete the purchase. At no time did we refuse to refund...

Mr. [redacted] his $100.00 deposit. I have communicated with Mr. [redacted] via email on on 5/8/17 in response to this matter. He provided his debit card number and I processed the refund of $100.00 on 5/8/17. This letter is in response to a concern our dealership received from you which was submitted on 09/10/2015 with an assigned ID of [redacted] Our dealership is and has been proactive in trying to resolve our customer's concern. It has taken some time to contact all of the parties involved in this...

matter to determine an appropriate resolution due to the circumstances and nature of the claim. At this time we are having the transmission rebuilt at no cost to the customer. We are doing this because we value our customers and strive to be fair and equitable in dealing with concerns. Our action is not a result of the filing of this complaint with your office. The reason the vehicle service contract is not covering the repairs in this particular claim, as stated by the contract administrator to us, is not due to a lift kit on the vehicle, but rather the oversize tires. The entire service contract coverage at this time would not be void for potential future claims of other covered components not related to the oversize tires. The original agreement to purchase the vehicle signed by our customer did not include a vehicle service contract. We are a full disclosure dealership and customer options, including but not limited to the investment in a vehicle service contract, are presented in our business offices at the time of finalizing the necessary paperwork to complete the sale. None of our lenders, including [redacted], require a customer to purchase products or services that are offered after an agreement is reached to purchase only the vehicle. We will be contacting our customer to review the cancellation process for any of the products and services that are desired to be cancelled since the disputed amount listed, and the desired settlement asked for by our customer, does not reflect the actual purchase price for the vehicle service agreement.

In response to the complaint of not receiving the title:  We had the title when the customer showed interest in purchasing, it had just came in on trade.  In attempt to have title put in transfer it was realized that the previous client had marked and signed the title as exceeded actual...

mileage which isn't the case.  We then had to ship the title for correction to the DMV of Columbus, they have been working on this ever since.  We have faxed everything they ask for and we constantly get told that it will be signed off on by a supervisor and be in the mail today or tomorrow even Monday, Tuesday and Wednesday of this week.  The Name who we have been working with at the DMV is  "[redacted]", I have spoke with her this week and was told today or tomorrow again.  She has stated that all she needs is to have her supervisor sign off and she can get it in the mail????  We have been in contact with the Bank which is [redacted] and they have been aware of the problem we are having with our State DMV.  The phone # to [redacted] at the DMV is  [redacted] I do know that corrections on titles at auto auctions can be sent and returned in a couple days so I'm at a loss on why this has taken this long at a State Agency.  We would like to think that we would have the title by week end but I am having doubts.  [redacted] has funded the deal and we have been in contact.  The customer also have been making payments on time and have been driving the vehicle.  We feel that the State DMV is at fault with how long this has taken.  There should never be any title work that takes this long to process.Respectfully,[redacted]
