Initial Business Response /* (1000, 7, 2014/06/26) */
Case Number [redacted]

I am writing to respond to the complainant that the customer has against Nouveau Tavern and myself. I am one of the account managers at the restaurant and lounge. After hearing the gentleman's complaint, I...

researched his credit card slip which he left an addition 22% tip totaling his tab to $197.34. Mr. [redacted] was with a large party that was celebrating a graduation. His server stated that once it was time to cash out that the he agreed to pay for his items as well as the drinks and food of another young ladies which would be the additional $59.00 dollars that he mentions in his letter.
At this time I am unsure of what else can be done to resolve Mr. [redacted]'s complaint, due to him authorizing the charges.
Please contact me if further info is needed.
Regards,

Initial Consumer Rebuttal /* (3000, 9, 2014/07/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Dear Whom It May Concern:
The response that this business gave is not true. I did not agree to pay for any other persons' purchases that night besides[redacted] There were items on my bill I did not even order. And in reference to[redacted] response that I left an additional tip; That is not true aw well. Gratuity was not included in the bill. The bill list the recommended tip based on a percentage. All I did was leave the suggested amount. I have attached statements from the guest who made the reservation ([redacted]) which disputes what the server said about me paying for other ladies' drinks and foods items. As well I have attached the original bill with the suggested tips included at the bottom. I told the waitress that night I was only paying for my friend[redacted]'s drinks. In a picture I uploaded it shows another guest of[redacted] eating bayou wings that appeared on my bill. Another picture with[redacted] who paid for[redacted]'s gumbo is on the left, myself in the middle and[redacted] is on the end. You can see another bayou wings in the picture and that was where I was sitting. I did not even know the other girl with the wings until that night but I agreed to buy her food? Sorry that did not happen and in our initial conversation I tried to tell this to[redacted] but she cut me off. She said it was "he say she say" and would not allow me to explain or did not want proof. So I provided it today.
Because I found errors on my bill after I was charged is not a reason to take my complaint lightly, otherwise their would not be dispute departments or agencies such as yourselves.
[redacted] is trying to minimize what she has reported in this complaint. She admitted on the phone that the waitress made an error that night in splitting up the check (the company has a policy of only splitting the check two ways- our check that night was split more than their policy allows.) Their policy is valid to cut down on errors such as mines. But since their employees cannot follow company policy, I now have to file an complaint.
I would still like my refund including adjusted taxes and corrected suggested tip.
I hope with the evidence and statement we can come to a resolution quickly.
Best Regards,
[redacted]
Final Business Response /* (4000, 11, 2014/07/17) */
This is in regards to Case #[redacted].
I have a receipt here that [redacted] authorized from the night of service. I also have a Retrieval Sales Draft Request from our bank that shows [redacted] was attempting to dispute the whole amount of the check and added tip totaling 197.34. If these transaction were false why would he have paid the bill as well as left an extra tip? Why would he attempt to dispute the whole amount if only $59.00 was wrong?
The server[redacted] gave a statement about what happened that night. "There were 3 women and 2 guys celebrating a graduation for one of the young ladies. They all wanted separate checks and asked to divide the graduate's items amongst all of their checks. The first lady paid her bill and left early in the night. I brought the graduate out a FREE Signature Cocktail to celebrate. After that [redacted] continued to order double shots of Hennessy. At 10pm Nouveau turns into a lounge with loud music so I went to cash the party out before the restaurant got to chaotic. At that time the other lady beside the graduate attempted to pay for her bill, [redacted] said, "What are you doing, I got you!!"...The lady thanked him and that is where the additional items on his check came from."
At this time I am unaware of who to believe. My server has a bill of sale with these items purchased, she also gave a clear description of the night. The ticket certainly says several double shots of Hennessy were purchased and food items. I find it unfair for patrons to decide to cancel items on their checks after they have ate or drank them as well as agreed to pay for them by signing the credit card slip with the total boldly printed.
Thanks for your assistance with this matter.
Final Consumer Response /* (4200, 13, 2014/07/17) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The problem I am having with this company is they do not want to prove me wrong. They tell me what others are saying like the waitress[redacted] but no one is providing receipts. In my last correspondence I did provide my receipts and reasons for disputing the charges alongside written statement from guest there that night as well as pictures. Why can't this established give me the same courtesy? After[redacted] said the bill balanced out and nobody was over charged I was never shown any proof of that. I cannot count on what this employee is saying to her superiors as I mentioned in previous correspondence she did not follow company policy in splitting up the bill. Mind addressing why that occurred[redacted]?
Can this restaurant provide me with proof that I am wrong. Because my friend's guest are telling me the opposite of what this company has stated. Everyone said they paid their own bill that night expect for the graduate. Receipts would be helpful because I want to see what everyone was charged since everything according to[redacted]'s text message balanced out.
Afton keeps saying I left an additional/extra tip. I did not, I left the suggested tip at the bottom bill. This boils down to a billing mistake that I did not notice when I left the restaurant. Just because I signed the bill and left a tip as customer are expected to does not make it non-disputable bill. Just like your employees made I mistake, my mistake was not checking my bill before I paid that night. That mishap does not make it okay to not look into the matter and come to a resolution.
And I made the Revdex.com complaint before I did anything i.e. contacting my credit card company. You agreed to refund my money and later refused. Additionally I did not try to dispute the whole bill. You can find attached the letter I sent to my credit charge company. I only disputed the overages not the whole bill.
So again can we see your receipts please?
