October 5, 2014To [redacted],We would like to take this opportunity to thank you for your consideration and follow up in advance. We have reviewed the case more in details and depth over the past few days. After full consideration of our records and experiences with this particular customer, we came up to the agreement to respond as describe below,At this time we are not moving forward with any payment towards this purchase. We had offered our customer the best of we could offer on the spot and have got rejected in the past. We are calling into question about the truth of the statement provided by the customer as it has shown to us; the statement has many errors and does not contain accurate designated vehicle information such as mileage and vin number. It is essential to explain that this vehicle was offered for sale at the price of $4950 plus $165.00 fixed processing fee as advertised online in major car.com website, however the customer negotiated to the down price sold $4500 including processing fee. We already reduced the price for about $615.00 on agreed purchase amount according to our bill of sale. It is also important to mention that the customer had checked the car inside out prior to the purchase (The husband went under the vehicle to double check underneath the car himself) and came up to the conclusion to buy this vehicle “ AS IS” condition with no warranty even though “Limited warranty” was available at the time of purchase. We would like to draw your attention to the paragraph # 6 of bill of sale as it states:“ Any motor vehicle sold to purchaser by dealer under this order is sold without warranty, express or implied, including any implied warranty of merchant ability or fitness for a particular purpose as to its condition or the condition of any part thereof except as may be specifically provided in a separate writing furnished damages, damages to property, damages for loss of use, loss of time, loss of profits or income, or any other incidental damages.”At the time that customer presented to our location 30 days past purchase date, we had gone beyond our kindness to offer for the cost of the parts needed to be repair to help them with financial situation despite the fact dealer does not have any responsibility or further obligation towards the sold “AS IS” inventory from the date of purchase. The very first time the customer came to our location asking for help, stating financial difficulties, made us to feel responsible as trust worthy business and we agreed to help in anyway we could therefore we requested for the statement of the repair, the respond from customer was that she does not have it with her but approximately about $700 -$800. We offered on the spot to pay a portion of the bill which was about $400.00 and she did not accept and asked for more contributions in near future, finally we ended up asking her to provide us the statement and we could discuss the best we can offer. Once she returned back with the faulty statement, it was raised up to $1313.00 plus cost of re-alignment and loss wage and that was the time we were able to offer up to $500. Unfortunately to us, it is most likely the customer is trying to take advantage of our kindness and support in this regard moreover, providing inaccurate questionable car repair statement. At the end we would like to mention as provided before, we had spend $895.11 on parts and labor with accurate truth documents prior to offering it for sale and it was not like we just got inspection sticker for this vehicle and did not fix any other required repairs prior to sale; therefore, we are not going to cover any extra charges that came up after 30 days of the purchase. We are questioning the statement provided by the customer for accuracy and details and do not accept verbal statement about three mechanics stated the car should not pass inspection, and would like to see written notices with details if that’s the case.In conclusion, we would like to thank Revdex.com representatives for taking their times and effort in reading this letter and analyzing our response to the complaint and to mention once again that we do not accept any further complains in regards to the sold 1998 [redacted] “AS IS” condition and has been driven for more that 30 days from the date of purchase with no major issues at the time of the sale. Furthermore, would like to conclude that we all practicing business based on respect, fairness, and honesty within the scope of our practice designated by the nature of the business.Sincerely Yours,Nova Auto sales Team

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed Administratively Resolved]
Complaint: [redacted]The dealer's response is correct that they are only...

required to have the vehicles inspected prior to sale.  That is the exact point that I am calling into question.  Once an investigation is complete on their inspection of this car we will know whether it was faulty or not.  The point the dealer made in his response about the offer to pay for the parts was only partially true.  The dealer at first offered $400 to settle the issue and then when I later presented him with the estimate from the mechanic he told me that he looked up the parts online and found them cheaper and he would pay me $500.  I paid $670.98 for parts to cover the suspension and another 642.33 for labor.  I also had to pay $169.73 to get the car properly realigned.  So the dealer did NOT offer to pay what I paid for the parts.  Additionally, the offer he put on the table was with the understanding that it was between he and I only, saying that if I take the money "this thing done, you go don't do anything" implying that I would not pursue further action. Therefore I did not agree or feel comfortable taking the offer.  The car was sold to me with a VA State inspection sticker on it.  The sticker indicated to me that it was safe to drive.  Step #8 in the VA Required Official Inspection Procedure (http://www.vsp.state.va.us/Safety.shtm#InspectionProgram) is to inspect the vehicle's steering and suspension.  The car had a bad suspension and shouldn't have had a inspection sticker on it. I have had 3 different mechanics and an independent inspection station look at the car parts and say that they shouldn't have passed.  My expectation to resolve the issue is that in order to compensate for selling me a car that should not have passed inspection, the dealer would cover the full cost of the repairs that should have been done prior to passing inspection.
Regards,
