We've been a model business tenant with Level Office since February 2016 when we came on board. We later upgraded our office size and acquired a partnership in September of 2017 with the agreement of doing 1 business networking event to help the community at Level Office gain more business and help with tenant retention. Everything was great up until recently in July 2018 when our rent was submitted early on June 30th for July rent. The rent was processed 14 days late by the community manager and our company was expected to pay late fees due to their own delays with processing. We were later released of responsibility on that fee due to a corporate complaint that was filed. In lieu of our partnership, we were also promised 1 month free on our new tenant lease signed in September 2017, however when the community manager whom was working on the initial account for us was termed, the company chose to renege on their contractual obligation. We also were advised after inquiring at the end of our lease term in August about possibly expanding to a new space that our contract was automatically renewed without prior consent from us, which is not something that is enforceable under our current lease agreement. There were plenty of issues that would warrant a breach in responsibility of a landlord in the months of July, & August of 2018 that included non communication of office closure and security issues with access to the building that cost my company time, money, and clientele. We had voiced these concerns directly with management and corporate and found no resolve. Even though, we had indicated that we were unsure about renewing, we were then charged forcibly for rent in the month of September, even though we had already vacated the property and stated our intent to move. Now the company is sending our account to collections for a balance that we do not owe and even feel that they owe us compensation for business lost in the month of July and August due to negligence.

Please see the attached statement, which shows an unpaid Rent Balance from August and September. Our team reached out about these unpaid balances, giving over 30 days notice for the August balances before we sent to our Collections Agency. The former client, ***, was unresponsive on these rent payments.

The attached statement shows the terms of this office agreement as well. 7a. details that the agreement will auto-renew if written notice is not given within 60 days of the expiration date. No notice was given and therefore the agreement renewed for another 6 month term. The client, ***, also continued to physically occupy the space for August and moved out without warning on August 29th. They are responsible for rent on this office until January, 2019. However we have only asked our Collections Agency to collect August and September rent since these are current months due.

Our Community Manager has worked with this client during their time in our building to both address and escalate their complaints. We have put this client in touch with our Chief Operating Officer and the client expressed their satisfaction with our responses and complimented our Community Manager on her efforts. This former client held an unsanctioned event in our Amenity Space, our Community Manager reached out about our Event Policies and that same evening, the client moved out of their office without warning. When a complaint came up about a late fee, our Accounting Team reversed that for the client, despite it being a legitimate charge, the details of our late fees are listed in the attached agreement.

We work to avoid sending any clients to our Collections Agency but with the lack of response from this former client, and a few thousand dollars outstanding, that was our only option to receive funds for the office space we provided according to their signed office agreement.

I am rejecting this response because: The business and it's management failed to be responsive to our needs and request for our intent to move out of the space and provide alternative options to meet our needs. This is a grave misconstrued way of placing blame on the customer due to their lack of customer service and attentiveness. This was done in a predatory manor in order for the business to auto extend our lease terms unethically. We had many communications about the current space being no longer functional and expressed our intent to move and no longer continuing our contract in the current space past the expiration date of our lease in September. Why would we be expected to move out prior to the end of our lease in September? This is a convoluted reasoning on the business's end. Also, they did not address the 1 month free at the end of our term that they committed to as part of the partnership agreement. This is a prime example of a breach in the contract and we are not accepting any less than a zero balance as promised. ***
