Thank you for giving us the opportunity to respond to the above referenced complaintI will describe the credit union's actions, which were completely justified.The account was opened on-line with a $check that deposited at a *** *** ATMThat check was returned by *** as uncollectable
That prompted our processing staff to contact *** *** *** *** (***) to verify that there were funds available to clear the other two checks, totaling $6,(The $check reference in the complaint was not held because it fell below our threshold of human review of a remotely deposited item.) *** personnel advised us that the two checks would not clear because the account on which they were drawn was in review in ***'s Fraud DepartmentDuring repeated follow ups on the checks, *** personnel said they would not release the funds until they were able to talk to the account owner.Because *** personnel refused to put any of this in writing and because *** *** was repeatedly asking for the funds to be released, we contacted our attorneyHe advised us not to release the funds until *** confirmed that the checks would be paidWe did not hear back from *** and the funds continued to be held.*** *** has also contacted ***, our Federal regulator and our internal Supervisory (Audit) CommitteeWhen getting ready to respond to the ***, we were told the complaint had been withdrawn.During this time, *** *** said that her state income tax refund was going to be sent to her NRLFCU account and We allowed those funds to be released to her*** ***'s debit card was never deactivatedShe accessed the income tax refund by originating online transfers through accounts in *** *** *** ***, *** *** *** *** *** and *** *** *** ***The transfer to *** *** *** was returned to us because the account had been closedWe do not allow On-line and Remote Deposit Capture privileges after an account has a history of suspicious transactions and those privileges will not be reinstated.*** ***'s address has not been changed back to *** * *** *** *** *, Sierra Vista, AZ ***She made this request online, but her on-line privileges have been revokedWe will need a written request with her signature and a photo ID in order to make that changeThe reason for the extra security is because of the possibility that *** *** DD MOVE to Virginia and that a subsequent tenant in her Arizona apartment has gotten her mail and that is who is requesting the address change in order to take over her accountThis is, unfortunately, a prime way that identities are stolen,Today, we called *** again and they have now advised us that the checks have cleared the accountAs a result, we have released the fundsOur credit union has a fiduciary duty to over 21,membersReturned check losses and identity theft affect all members because they cause the credit union losses and as a cooperative, it affects our ability to limit fees and to provide more competitive interest rates than the banks chargeIt is my conviction that any consumer reading this rebuttal will gladly do their banking through NRLFederal Credit Union because we take that duty very seriously.Sincerely, Linda ** P***President/CEO NRL Federal Credit Union
