Review: I received a phone message from a third party bill collector. she indicate that I had been reported by Northside fitness for a bill totally over $600.00. I contacted Northside fitness and they indicated that I had not cancelled my contract. I was on a month to month billing and paid by check each month. My husband and I chose to no longer go to the gym. We quit going and had not heard anything from the gym regarding any past due payments until the phone call I received today from a third party bill collector. I was not told when I renewed by memebership that I needed to cancel or I would keep getting billed. If I would have received a late notice I would have certainly contacted Northside at that time and cancelled my memberhsip. I look forward to any assistance you can give me with this matter.Desired Settlement: I would request that Northside Fitness contact the third party bill collector and remove this lein. I don't understand how they can turn this over to a bill collector without having communication with me first. I attempted to contact Northside and the person I need to speak with is not available until next week. I have only used the gym when I was in a paid status.

Review: My husband [redacted] signed up to go to NS Fit in Yuba City in Feburary 2015. A while ago when I went to the gym to tell them that I do not want to renew my membership, and from what the associate told me, I was under the impression that it was taken care of, that its in their system that our membership will end when time comes.

Today I checked my credit card account and found out that I got charged $25 memeber renewing fee and $39 for monthly fee for March. So I called them and they said they cannot refund my money because I have to come to the gym to do paperwork 30 days before the membership ends. And they said it is in the contract.

The thing is we honestly did not know this information. If we did we will do it their way.Desired Settlement: We would like our $64 back.

We are sorry to hear that you were not aware of the contractual agreement you entered when becoming a member of our health club, NSFit. Please review your copy of the contract you signed. Our membership contracts clearly state the following...1. Memberships must be cancelled in person, and in writing. 2. All cancellations require a 30 day notice to cancel before next membership fees due date. 3. W charge a one time per year annual enhancement fee. Please visit one of our facilities to cancel your existing contract with us, and we will provide you with a receipt of cancellation.

Thank you for the response. Unfortunately, we are not able to validate any verbal communication you may have had with one of our associates. Our contracts very clearly state that all cancellations must be in writing.

I am rejecting this response because: Yes, u are not able to, but that's what happened. So it's your responsibility. Do u really think that I made this up? Are u serious?Do u really think that I have some money laying around to give to u like that, and if I know it I would do whatever I can to cancel the payment. I wasn't told that info is in the contract also. And how u can charge people one extra payment after cancellation is being too smarty, getting more money in your pockets. I sure will never do business with u again and will not recommend anybody.

Review: PAID MONTH TO MONTH AT NS FITNESS CHICO LOCATION. MADE MOST PAYMENTS IN CASH AND ONE CREDIT CARD PAYMENT. NS FITNESS MADE NO ATTEMPT TO KEEP CREDIT CARD INFORMATION ON FILE. THEY ACCEPTED ALL PAYMENTS MADE IN CASH AND WITH CREDIT. EMPLOYEES STATED THAT AT SOME POINT IN THE FUTURE WE WOULD MEET WITH A BILLING REPRESENTATIVE. EMPLOYEES NEVER FOLLOWED UP OR REQUIRED THIS. WAS ASSURED THAT WE COULD CANCEL AT ANY POINT IN TIME BY GIVING VERBAL NOTICE. RECEIVED A PHONE CALL FROM COLLECTIONS ON 5/5/2014. Re: [redacted] signed a Personal Training Agreement with NS fitness in Chico on April 9, 2014 (see enclosed copy). The Agreement stipulates that he trainer will be [redacted]. Ms. [redacted] was lead to believe by a store employee named [redacted] that it was cancellable on a month-to-month basis, as it was being paid for by "[redacted]," part of her [redacted] supplement health insurance. The contract also clearly states that her personal trainer will be [redacted].

At the end of August, Ms. [redacted] was informed that [redacted] no longer worked for NS Fitness. She discontinued her payments at that time, as there was no other trainer available who understood her therapy needs. [redacted] had taken time to communicate with her doctor about her health needs.

Ms. [redacted] informed NS Fitness of her reasons for discontinuing payment in a letter dated October 15, 2014, that while he agreed that she had been misled about the contract, NS Fitness intends to hold her to the year-long term anyway.Desired Settlement: Ms. [redacted] is asking that NS Fitness not pursue collections on the remaining months they are claiming, ie, to April 9, 2015. She understood from the beginning that it was a month-to-month agreement. Also, she entered into an agreement to have [redacted] as her personal trainer, and since he is gone, the contract cannot be fulfilled by NS Fitness. If [redacted] were still her personal trainer, she would continue.

Please confirm in writing, within 20 days of receipt of this letter, that NS Fitness will cease collections on this account.

Review: I had a month to month membership with Northside. I went in to their building on Bogue Rd to cancel 4-5 years ago. I got a call from them a year or so later saying I had an outstanding balance. Which means they never filed my cancellation. So I went in to their other building on Kelton way to cancel and pay my outstanding balance, so my credit wasn't hurt. Even though I haven't been to their gym in 12-18 months. I know for a fact that I filled out a cancellation form. I just recently got a letter in the mail from collections. So I found out they've been billing my account $49 a month for the last 4-5 years even though it was cancelled. They say they don't have the cancelation on file. I don't check my bank statements, so I never really noticed they were charging me every month still. Now I have a collections of over $300. I'm more upset about the collections because I have great credit and wouldn't let something like this hurt it. Adding up the $49 a month since I cancelled, they have taken over $2,000. If they bring up their files, it will show I haven't stepped foot in their gym for at least 4-5 years. My friend that has worked for them for years, says it happens all the time.Desired Settlement: I would like them to drop the collections. I would love to have all the money I have payed them over the years after my cancellation. I would also like for this business to not screw their customers. From what I've been told, they do this to a lot of people.

After reviewing Mr. [redacted]'s file, we found that in February of 2013, his payments for both his and his wife's memberships were declined. Phone calls were made and emails were sent (enclosed notes). Mr. [redacted] spoke with a manager about cancelling his wife's membership (see note on February 11th) and a phone call out was made by the billing rep on March 5th, 2013 letting Mr. [redacted] know that in order to cancel his wife's membership he needed to bring his account current. Another phone call out by the manager on March 25th, 2013 reminding Mr. [redacted] of his past dues. On the 28th of March 2013, Mr. [redacted] came into the facility and filled out a change of request form and gave new billing information for his account (see enclosed). There are no notes regarding his wishes to cancel his own membership, we only have a form providing updated billing information. We will be more than happy to assist Mr. [redacted] in addressing his past due account and have notified the collection agency to remove him from their list as well as waiving all past dues at this point.
