The above referenced complaint came into my office and was addressed to an agent who did not forward it to me for a couple of days.The amount listed by my client ($1,000) was for earnest money which she put down when she wrote the contract (12/14/2015). earnest money is controlled by the title company ([redacted]) and was in no way conveyed to me. The facts as presented in Mrs. [redacted] complaint are not entirely factual. While the events that delayed the closing were partially due to the hardship of her mothers passing, they were more truly a result of the fact that her husband, [redacted] failure to file his tax returns timely and their lender, [redacted]) could not process their loan until this issue was resolved. We extended the contract on 9 separate occasions to accommodate the [redacted] various financing/personal issues. Frankly, I have never expended so much time and effort in an attempt to help the [redacted] including making 2 trips to Austin and one to Waco in an attempt to secure a copy of [redacted]' tax transcript. Finally in mid August the mortgage banker felt he had all he needed to move forward with the loan, however unbeknownst to him the [redacted] paperwork had once again expired and his underwriting department was asking for all new documentation. At this point both the [redacted] and the seller ran out of patience and the seller would not extend the closing date any further and decided after 8 months of working with the [redacted] to call it quits. On September 2, 2016 the [redacted] signed the Notice of Buyers Termination of Contract (attached) and the Release of Earnest Money (attached) giving the Seller ([redacted]) the remainder of the Earnest Money ($789.27) after paying two invoices that the [redacted] had incurred for inspections as liquidated damages. Mrs. [redacted] reference that I would return her $1,000 whenever she found another home was a gesture that I offered her because I knew that the loss of this money was a hardship on her and her husband. In that event I would have had to lower my commission on another purchase and have the seller reduce the purchase price in that amount. I made this offer out of the kindness of my heart as I was in no way obligated to do so and I did not benefit financially in any way from her attempt to purchase the property in question.I am totally shocked that the [redacted] would look to me to refund money that I never received or in any way benefited from.Please let me know if you have any other questions.
