I am rejecting this response because:The picture of the large hole in the bathroom is not in our apartment and I have never heard of a land lord mad about someone filling all the nail holes in an apartment to assist in the clean up of the apartment I have proof from several other tenatants that there wa no damage to the apartment as I could not get law enforcement out to verifythat there was no damage to the apartmentone thenant even took videothe other tenant is the code enforcement officer for springtown tx when she did her walk through she reported no damage.

This is an incorrect statementAll tenants who have broken a lease and moved out early have forfeited their depositIf you would like move out prior to the ending of your lease, you are welcome to do soYour security deposit will be applied per the terms of your contract

The heart of the issue here is that *** *** refused to renew his lease with our property andwas not happy when we decided not to renew his month to month tenancy with us*** ***had a term lease that expired mid 2016, when I approached him in September of aboutgetting him back onto a term
lease, he stated that they would be buying a house soon and thatthey would be out of the apartment as soon as they found a house.Four months later, in January, *** *** was still in his apartment on a month to month basisand he showed no intention of leaving his apartmentMarket rent for an apartment in Januarywas $(+$water bill)*** *** was still utilizing his month to month lease at $650(with no water bill)In January, our company implemented a policy that in order to stay on amonth to month lease, the rate was 20% above marketThat being said we notified *** ***that his month to month rent would be increasing in March on to $840/month in order tostay on a month to month basis.After *** *** stated that he would be leaving in March, I posted official notice that we wouldnot be renewing his month to month tenancy as of 2/28/This notice is required legally forending a month to month leaseRather than calling me and asking if there was something wecould work out, *** *** resorted to yelling at my property manager and causing adisturbance at the propertyI received a call from my property manager saying that *** ***was acting irate and that he was causing a sceneTelling my manager, “Get that son of a bhup here” (referring to me)I was out of town but had my property manager tell *** *** thathe was more than welcome to call and talk to meI reiterated throughout this entire process that*** *** was welcome to give me a call.*** *** refused to give me a call and demanded a face to face meeting and said that hewould be withholding his rent until he got a face to face meeting (illegal as per Section TexasProperty Code, Subchapter B)I tried to organize a call with him several timesAnd tried toorganize a face to face meeting on Saturday 2/4/After his rent was withheld and not paidat 5:pm on 2/5/2017, I filed a notice to vacate on the unit.*** *** was given hours to move out and surrendered the keys to the unit on 2/8/Iwas left with considerable financial damages on the propertyOn 2/22/2017, the Justice of thePeace, Parker County, TX awarded financial damages on the apartment of $I haveincluded the pictures of the apartment as we were left it and the emails that I had with *** regarding this disagreementI will include the court documents as soon as I get back tothe office on Sunday 2/26/2017.Thank you for giving us a chance to tell our side of the story,*** ***
