Complaint: [redacted]
I am rejecting this response because:
Mr.[redacted], matter not closed. You are absolutely incorrect. I do not have to go through any of your distribution channels in order to lay claim to my rights. When I purchased your product I also purchased it's liabilities and rights. You can not try to circumvent your responsibility as a manufacture of the product through your inability to comprehend your company's legal liabilities. Your liabilities and my rights are held directly by me. If I file a small claims suit in DC Superior Court I would file it against Nu-Calgon and it's registered agent where a summons would be issued to appear in court in the District of Columbia. I would not file it against "[redacted]." Moreover, in your weak analogy, most retailers now tell customers to contact the manufacture after 30 days, that is definitely the case with [redacted], [redacted], [redacted]  so your analogy is not only incorrect but irrelevant in this situation. Furthermore, in this situation, this information you are stating was not what I was given by Mike, he told me to send in the 2 malfunctioning direct inject Easy Seal items and it was received there via USPS [redacted]  What do you expect me to take to any "distributor" when I no longer have the items? I purchased through [redacted], which is selling your product directly, like it or not, and since it was after 30 days I was told to deal directly with the manufacture.As far as the canisters products that I used, what do you want me to return to the place that I bought your product, in this case [redacted], empty canisters which I don't know I even have, but would not even be taken by [redacted] at this point since months have passed. This is satisfaction issue with your product, of course I have to deal with company that produced it. If you actually cared about your company's long term reputation, one would think, you would want to resolve this. Like I said before your liabilities are held by me. If your product damages my equipment I'm coming after Nu-Calgon not "[redacted]." I'm not even sure your products even work. Do you have any outside scientific studies to show they actually do what you advertise them to do? Show them. Your company clearly from top to bottom has a bad culture in supporting your products and dealing with customers and this will be reflected in your new Revdex.com profile rating hopefully alerting others to stay away from your products and your company. I need a speedy resolution, I have wasted too much time already with your company's run-around. If you would like to continue this  run-around, just give me your registered agent's name and I will pay the $10 filing fee to DC Court have them summoned so they can pay for a trip to the nation's capital to represent your incorrect thought process to a judge and let them decide.

12/11/2017  These products were for my A/C at home. My tech/repairman and I thought their products would work based on the ads. The canisters were tried first. I believe a pack of two was a little over $100.00. They did not appear to work. Argued with the Business about this. Tried the Easy Seal Sticks after the canisters did not do the job. Tried 3, and two did not inject. Returned the ones I had left, but no help with a refund/replacement from manufacturer. I don't know what I paid for the Sticks.  Alright, I understand if I want a refund as an option to product replacement, that I need to provide  you a dollar amount. I have the letter they sent in response to my complaint but I cannot find my complaint nor my reply after reading their letter, so can you send me those? Thanks.  No, I did not take anything up with [redacted] about this and understand the business claims I have to seek any refund or replacement from them. I'll get back with you about the dollar amount I would want for a refund. Understand you believe based on the tone of their response in the letter they sent that you do not expect them to try to resolve this with me, but, you will be giving it a try anyway to see what happens. Thanks.12/15/2017 Hi, It comes out to roughly $240 for the two products.12/18/2017  [ left a vm about business response to send 2 Easy Seal sticks to his licensed technician. I'm not really satisfied this is all they are going to do, but, I'm going to accept that just to be done with this. Thank you.12/26/2017 ok, please don't close the file based on my dealings they don't follow through. I will send over the information as soon as I can. 12/28/2017  {mediator had emailed consumer on 12-26 after receipt of his above email. Advised since it would probably be several months before he orders anything for A/C, Revdex.com's policy is not to leave complaint open that long, but, if he orders the sticks in the future they agreed to send and if business does not send them, he can reopen the complaint. Mentioned in this email of 12-26 that would wait until noon today to see if he had any new information and if not would close complaint}

We are aware of Mr. [redacted] situation.  We have instructed him to return the product from which he bought it because he is not a direct customer of ours.  We are a manufacturer and we work through the distribution network.  If a customer is unhappy with a Nu-Calgon product they need to...

go back to that distributor.  This is not different than most products being sold.  If you buy a product at [redacted] and you don't like it, you return it to [redacted].  You don't call the manufacturer to try and get money from them or ask for free products.We have offered Mr. [redacted] a solution but he refuses to work through the distributor.  With that being said, I consider this matter closed.

12/15/2017  [left vm with [redacted] at business]12/18/2017  We only work through distribution and our distributors are only supposed to sell the product to licensed technicians and not the general public. Obviously, some of our distributors nevertheless sell to [redacted]. We still believe he needs to take this up with [redacted] and are not interested  in paying him any money. We have checked out his phone number and it's possible he tries to scam others. I would like to see a copy of that USPS tracking info he has; we did not receive anything. The best we can do is send two Easy Seal sticks to a licensed technician of his choosing. Thanks.12/26/2017 [ left VM with [redacted], who is out of office until Jan 2, that consumer not really satisfied this is all they will do and disagrees they did not get the returned sticks as he has tracking info and post office receipt to show otherwise, but will accept the offer. Since no plans now to do any A/C testing, it will be several months before he has the name of a licensed technician to ship the Easy Sticks to. Told would close complaint now but consumer could reopen if he does not eventually get these]
