DuPont HighwayNew Castle, DE, 19720 Sales ManagerOffice: [redacted] Sales ManagerOffice: [redacted] Short version of the story:On Saturday, November 8, 2014 about 2pm I went to NUCAR Chevrolet-Mazda and purchased a new 2015 Mazda CX-5 Touring FWD. After I gave them my trade (a 2006 Pontiac Torrent) for $3000.00 toward the price of the new car and signed all the paper I was waiting for the vehicle to be finished being detailed. When the vehicle was ready I looked it over and noticed scratches all over the body of the vehicle. I told the salesmen and he informed the Sales Manager. The salesmen seen the scratches, told me to take the vehicle and bring it back Monday after I finish work to tend to the scratches and he would give me a loaner vehicle. I left about 6:30pm. That night I knew I did not want the car. Over the weekend it became more evident how hard the vehicles seats were and my back started hurting. The 5 minute test drive did not indicate this. I have had 2 back surgeries. The dealership was closed on Sunday, November 9, 2014.On Monday morning, November 10, 2014 I called the Sales and Leasing person several times to get a rescission of contract and get my trade back. I called him because he was the one with whom I signed all the paperwork. I could not reach him but I left a couple voice mail messages for him to call me. One voice mail message was Sunday night. I called the salesmen and asked him to have the Sales and Leasing person call me (not knowing the salesman was the one to talk to). The Sales and Leasing person returned my call and I informed him I wanted a rescission of contract and get my trade back and he indicated the sales manager is the one to talk to. He said he would tell the sales manager. After work I dropped the car off, but I informed the sales manager I want a rescission of contract and get my trade back. He wanted the opportunity to get the scratches. I informed him he can do that if he wants, but a dealership scratching up a brand new vehicle before it even leaves the lot is indicative of service. I have concerns of getting a simple oil change. I told him I want a rescission of contract and get my trade back. He indicated he will work on the scratches. I took the loaner. On Tuesday afternoon, November 11, 2014 I went back to the dealership with my sister with intentions to get a rescission of contract and get my trade back. In case they did not have my trade I would have accepted the $3000.00 they applied to the new vehicle for the trade, therefore my sister could have given me a ride home. The sales manager was not there. I spoke to the sales manager that was there. The situation was explained to him. My sister informed him I wanted a rescission of contract and to get my trade back. The other sales manager said they dont just take back cars and that I signed a contract and the car is mine. He indicated he will have [redacted] call me to bring the car in to take it to a specialist about the scratches.On Wednesday, November 12, 2014 the original sales manager left a voice mail message indicating he wanted me to meet with the shop manager to show him what the problem is with the car. I told him I want a rescission of contract and get my trade back. He indicated thats not an option. I informed him I will have to take this to a higher level. I left out personal reference as instructed by Revdex.com instructions. I have them ready if you need them. Please forgive me if I missed some. I have a more detailed description of events if needed.Desired Settlement: I want a rescission of contract to put me back in the position I was before the contract was signed. this would include nullifying the loan and getting my trade back. In case the dealership does not have my trade I would accept the $3000.00 they applied to the new vehicle for my trade.
