I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The only thing the business did is post emails related to creating the advertisement, but it does nothing to link it back to me (other than by name).  For example, even though the person listed in the email chain has the name '[redacted]', it clearly states the email address is for a '[redacted]'.  If required, I can get evidence and proof from AOL that email address is not associated with me nor has it ever been associated with me. 
Second, the contact information for the billing is [redacted] Sterling, VA [redacted]  Phone : ###-###-####.  That is a location for what used to be our mail room/facilities office.  We no longer use that facility (recent closure), but I am not authorized to recruit for the company, especially since the advertisement is for a warehouse operative.  I would not be able to post a job opening for that location.  And, if I was posting an ad for a  job I  was trying to offer I wouldn't use my work address as the billing address for a credit card!!!  The phone number listed is also not associated with me in any way.  When you dial the number, you get a message saying that 'You have reached a Pinger number...' and it references www.pinger.com  This web site appears to allow people to use their tablets/smartphones to communicate via free web-based calls and text:
Whoever wanted to place this add seems like they opened and closed an account with them since the number is no longer active.
If I was trying to pull the wool over someone's eyes I would not take the time to do the extensive amount of forensic background checking I'm doing to substantiate my complaint.  It appears, through the emails submitted by Mr. Gamboa, that someone used a piece of information here, a piece of information there, and pieced together a request for an ad hoping that they would never have to pay for it.  I am still not the person Mr. Gamboa is looking for.  The original complaint is related to the treatment I received on the phone when originally contacted by him, and the information provided still does not link me to any of the contact/telephone/credit card/etc. related to the request he received to post ads in his publication. 
 My request is still quite simple...do not call me (he can do all of the background checks he wants to do on [redacted], the company I work for, and my background) and make a donation to the [redacted].  If necessary, I can provide even more information to hopefully prove I never solicited this ad.

Review: I received a call from [redacted] at Nuevas Raices @ 1:40 on April 2, 2014. I received the call at my desk at my office. When I answered the call, he said he had been waiting for my return call, and he had some information related to an advertisement in his publication that he wasn't able to process due to erroneous credit card information. When I informed him that I had not taken out any advertisement he said someone had done so on my behalf. When I explained further that I did not have any outside agents requesting advertising on my part, he continued to press me for information about the ad and trying to validate some identification information. At that point in time I stated to him that I was not the person involved and I did not have any reason to put any advertising in his publication and that I wanted to have the number he called removed from his call list (my phrase). This is when the verbal abuse started. He told me I was "being an [redacted] and I was giving him a difficult time because he was Hispanic. He also inferred that I was being a racist and not being nice to him, also because he was Hispanic. When I told him that I was merely asking pointed questions because of the fact that a) I do not have a need to publish in a Hispanic paper because I'm not Hispanic b) I never asked to have anything published c) the number he was calling was a work number that I would never give out and d) any time someone I don't know calls me and the first thing they ask about is erroneous credit card information, my guard goes up because it sounds like a scam. Then once again called me a " [redacted] because he was being 'nice' to me and I was being rude and insensitive. At that point I asked him to verify the number that showed up on my caller id (###-###-####) and asked to speak to someone who might be in charge. He then again called me a " [redacted] and said I must not think that a Hispanic person could run his own company and that it was rude and insensitive to think that a Hispanic wasn't smart enough to be the person in charge. I told him I'd never heard of his organization before, so I had no way of knowing who he was or what position he represented.

Long story short, after he gave me more information about an AOL email account (that I do not have), and an address in Sterling VA (that is not mine) I once again told him that I did not solicit any advertising and I was not going to be responsible for any payments that were outstanding for it, nor would I give him any additional information. I have several witnesses around me who will attest that I was firm with him on the phone but never called into question his ethnicity, nor did I invoke any profanity when speaking to him. I don't think anyone representing a company should address anyone the way I was spoken to. It was completely unprofessional and, ironically, was pretty rude considering he thought I was treating him rudely...Desired Settlement: Several things:

- Customer relationship training...even if someone else is being 'rude' using profanity is never a solution

- Stop contacting me...self explanatory

- Donation...make a donation to the [redacted] (VA) [redacted]. In his snap to judge who he thinks I am, he failed to realize I'm an African-American Christian who would never (and has never) mistreat(ed) anyone because of their race. I can forgive, but I want his 'apology' to go to the [redacted] (VA) [redacted] that makes wonderful contributions to the needs of many here in NoVA, including the Hispanic community in [redacted]. He can check out [redacted]/ for more information.
