My response is attached: Following are the facts/core issues, as I understand them:Reference: In her email message to you dated 1/4/MsF [redacted] references a Personal Training Contract signed by me to train for times per week for weeks commencing 10/10/for weeks.I have never received a copy of the contract MsF [redacted] refers to therefore; I am unable to address/rebutt the content of the contract I have an emailed copy of the NuFitness Sales Receipt dated October 10, I have cut and pasted sales receipt which outlines the following charges: SCHEDULED AUTOPAYS:Monthly - Personal Training 2X Week - Auto Pay for [redacted] every WeeksStarting 10/10/12:00:AM Monthly - Personal Training 2X Week - Auto Pay Fee of$ + tax $Total $ Monthly - Personal Training 2X Week - Auto Pay for [redacted] every WeeksStarting 11/7/12:00:AM$ + tax $Total $501.57Of note: the emailed receipt references monthly charges billed on October 10, and November 7, 2016Of Concern: On December 7, Nufitness applied an automatic debit to my bank account in the amount of $501.57On January 2, and Nufitness attempted three automatic debits in the amount of $each for additional weeks of service which I believed were erroneous Each of the debit attempts were notified to me via email.Issue: In her email to you MsF [redacted] states her phone number has been “blocked” to/from my phone To my knowledge my phone does not have a “blocking” application I am perplexed as to how MsF [redacted] is able make that declaration without having access to or knowledge of my phone model, my carrier or my data plan as I have only provided her my phone number all of my personal phone information is confidential and not available to herIssue: MsF [redacted] infers I “pretended” not to have received her text messages A review of my text message history indicates I have received text messages from her beginning 10/3/through 10/14/ No additional messages were received from MsF [redacted] after that dateAlbeit I have sent text messages to her through December 12, without response.Concern: I became disabled from physical activity as a result of a unanticipated/unforeseen respiratory issue, which began on November 30, The referenced respiratory issue escalated to pneumonia on December 10, and continued through January 4, On January 4, my personal physician issued a physical restriction report limiting my walking distances and complete avoidance of stairs as a result of pre-existing severe bilateral degenerative osteoarthritis of both knees The physical restriction period is defined as January 4, (at 9:40am) through January 4, 2018.My request is as follows:Refund of the monies debited by Nufitness Lifestyle on December 7, in the amount of $501.57.Support for the request includes:December services were not provided as a result of my unanticipated/unforeseen medical disability/incapacitation which was commenced on November 30, and ended on January 4, Continued physical incapacitation as outlined in my physician’s physical modifications status, which outlined restricted walking distances and complete avoidance of stairs commenced on January 4, and ends on January 4,

[redacted] signed a personal training contract to train 2x week for 12 weeks. On 11/28 she became sick and said she couldn't train for a bit. I told her that would be ok and just to let me know when she could start back up. I assured her I would extend her session for her so they wouldn't expire. Then,...

after her final payment had processed, she said she couldn't train anymore. I told her that was fine, we could wait until she was fully recovered and I would extend her package as long as needed. Then out of the blue I was contacted by the Revdex.com. [redacted] never called the gym phone, emailed or came in. She only called and emailed me personally on my personal phone. As seen in the attachments, I called and texted her back every single time in a very understanding and professional manner. She never messaged me back or called or did anything to let me know there was even a problem. It has now been made clear that [redacted] has my phone number blocked from her phone and has been blocked since she texted me and apparently "pretended" not to get my messages. Regardless of all of this, [redacted] still has 8 sessions remaining and I am willing to extend them for an additional 12 months from today. That will give her plenty of time to heal and recover. Either way, she will need to respond back to any of my emails texts, or voice message. Here is the time line of events:-Was last charged on 12/5/2015.-On 12/12/ 2016 at 9:13am I was informed you couldn't continue training until your lungs were healed.-I responded emmediealty at 9:19am "Oh no, I can't believe that happened. Pneumonia is nothing to mess around with. Just let me know when you are ready to return and we can just push out your sessions into January if that works. Happy healing and I hope you feel better soon."Then on 12/13/16 you left a voicemail sounding as if you had not recieved my voicemail. I called back the same day at 1:55pm and left you a voicemail stating what I had said in the text message. I also added that if we needed to do your remaining sessions after your surgery that would not be a problem either. I have not heard anything else from you, no request for anything or updates. I had every reason to believe I would just hear from you once you were feeling better. Then to my surpise on 12/22/16 on got a notification from the Revdex.com that a complaint had beed filed agains me. Then on 12/22/16 at 4:53pm I called and left you a voicemail asking you to call me back so we could discuss this. I also sent you a text message at that time. Since then I have called, texted and emailed to address this issue and have not been responded back to. Like I said, I was never even informed by [redacted] that there was a problem until I was contacted by the Revdex.com. Then I immediately tried to contact her in varies ways and was not contacted back. I take great pride in my business and customer satisfaction, that is why I have not problem extending the sessions she had already purchased on contract. Mahalo,Erykah F[redacted]
