Initial Business Response / [redacted] (1000, 5, 2015/08/07) */ Contact Name and Title: [redacted] , Owner Contact Phone: [redacted] Contact Email: [redacted] @nvdesignandmarketing.com This complaint is not correctMy company designed over logos designs and made multiple changes per [redacted] and her motherThey could not come to a final decision at any given timeThey switched companies more than once between the two of them and then returned to ask me where the final log wasWe had sent it to them months before that and never got a response backThen, I get an email from [redacted] 's mother saying she was having problems with her email so I resent everything once more and never heard back againWe designed an incredible amount of work and can submit that to the Revdex.comThey simply would not make a decisionWe would be happy to give them what we have designed if they want the artworkThey have already disputed the $that they charged with my companyI went ahead and allowed them that credit because I knew that they were not happyAs for the $that they are asking for, we have done hours upon hours worth of work and I believe we can come to the agreement that they got half of their money back and we did much work that deserves the other halfAgain, I would be happy to send over all of their artwork and emails that were never answered by themThank you Initial Consumer Rebuttal / [redacted] (3000, 7, 2015/08/07) */ (The consumer indicated he/she DID NOT accept the response from the business.) Contrary to what NV Design and Marketing stated in their response, we did in fact decide upon a final logo by evidence that my mother and I were trying to get business card proofs from NV Design and Marketing, which you cannot do without an agreed upon logoMy mother had NV Design and Marketing design for her, but the designs never came back with the corrected changes/additionsThis has nothing to do with the logo designI have emails where my mother asked for the same material on her business card times and each time the proof came back incorrectMy mother was never able to get a solid design from NV Design and Marketing and gave upI spoke to the owner in January to begin designing for meI asked for business cards with the new logo on itI waited for weeks for the design and never received itWhen I finally contacted NV Design and Marketing I was told that I should have picked up the phone and called and that I was the reason for the breakdown in communicationWe switched offices and I did alert NV about the new office, but then my office was bought out less than a month later by a new agency all between the time I asked for business cards and received the initial proof, which took weeksIn my business a delay like that costs me money as wellInstead of NV trying to make things right when they finally responded to my email by offering to get the new company name and information, they cut off communication with me entirelyI am not denying that NV designed for us, and that we did have an agreed upon logo designMy complaint is that we have been out of contract since July 7th, and have NO logo in which to put on any of my business materials, emails, open house fliers, Open house signs, business cards, stationary, Facebook page, etcfor which I paid for up-front the previous yearNone of the logos or designs has been released to me for my business useI have paid for products not rendered and services incomplete! I did not just pay for the design, but for the release of said designs upon the completion of the execution of the contractI paid ultimately to have a product that I could USEI held up my end by giving my ideas for logos to the designer, meeting with her personally to complete the design when communication over email failed, asking for products that included my design and paying for services up frontThis vendor is in breach of contract as of July 8th, I do not have the designs I paid forI paid for a product that I do not haveSo what I have paid for is labor of a design that was supposed to be given to me, but has not The vendor stated that she gave half the money back because we were not pleased with the service, which is untrueMy mother disputed her portion of the payment with her credit card company that NV Design and Marketing did not uphold their contractual agreement stating in her complaint "services not rendered" and was reimbursed by her credit card company because we were able to establish proof that services were not renderedWe submitted pages of correspondence between us and NV Design and Marketing, including the said designs that NV created, as part of the dispute with the credit card companyThe credit card company sided with my mother and gave her back her portion (half) of the up-front payment that we made based on the preponderance of evidence that NV Design and Marketing was in breach of their contractual agreementTherefore, this vendor did not do us a favor by giving back the money to my mother for her portion for not being pleased with the process, but because the grievance department of the credit card company deemed that we paid for services NOT received and that the vendor was liable for her breach of contract I am asking the same here, for reimbursement of my half of the up-front payment for products not renderedThis vendor cannot ethically keep money for a product that she never gave to her clients .This vendor chose not to uphold her contractual agreement and now does not want to payI can also submit the same pages that were given to the credit card company, which will clearly prove the breakdown of communication and lack of cooperation from NV Design and MarketingThe reason we had logo designs was because the designer would not listen to what we asked for and gave us conflicting designs, and refused to design and we instructed (as proven in the documentation given to the credit card company), until we finally sat down with her face to face and walked her step by step with what we wanted Per our contract, logos and designs were to be releasedThey were notRestitution is due in the amount of $ Final Business Response / [redacted] (4000, 9, 2015/08/17) */ We are going to have to simply agree to disagreeWe can not help the fact that they kept switching companies and our agreement was for ONE logo package and we designed so many for them collectivelyIf they want their artwork that we designed for them, they are welcome to itWe have no problem releasing their entire folder to themWe will even make their final changes for them, if they would like and then they can be on their way with what they want regarding design and for whomever they work for nowAs far as NV not designing what they asked for, they told us we had creative liberty and they were asking for clip art to be included in their design and we are designersWe have years of professional experience and we wanted what was best for themWe tried to deliver something that they loved [redacted] must remember that her mother did not respond to my emails for several weeks and then said she was having email problemsAgain, we do not feel it is fair to give ALL of the fee back the themThey have already been refunded the $We have spent many, many hours trying to appease these two women to no avail and the fact that they kept changing companies was not our fault

Then, I get an email from [redacted]'s mother saying she was having problems with her email so I resent everything once more and never heard back again. We designed an incredible amount of work and can submit that to the Revdex.com. They simply would not make a decision. We would be happy to give them what we have designed if they want the artwork. They have already disputed the $650 that they charged with my company. I went ahead and allowed them that credit because I knew that they were not happy. As for the $625 that they are asking for, we have done hours upon hours worth of work and I believe we can come to the agreement that they got half of their money back and we did much work that deserves the other half. Contrary to what NV Design and Marketing stated in their response, we did in fact decide upon a final logo by evidence that my mother and I were trying to get business card proofs from NV Design and Marketing, which you cannot do without an agreed upon logo. My mother had NV Design and Marketing design for her, but the designs never came back with the corrected changes/additions. This has nothing to do with the logo design. I have emails where my mother asked for the same material on her business card 3 times and each time the proof came back incorrect. My mother was never able to get a solid design from NV Design and Marketing and gave up. I spoke to the owner in January 2015 to begin designing for me. I asked for business cards with the new logo on it. I waited for 3 weeks for the design and never received it. When I finally contacted NV Design and Marketing I was told that I should have picked up the phone and called and that I was the reason for the breakdown in communication. We switched offices and I did alert NV about the new office, but then my office was bought out less than a month later by a new agency all between the time I asked for business cards and received the initial proof, which took 3 weeks. I am asking the same here, for reimbursement of my half of the up-front payment for products not rendered. We will even make their final changes for them, if they would like and then they can be on their way with what they want regarding design and for whomever they work for now. As far as NV not designing what they asked for, they told us we had creative liberty and they were asking for clip art to be included in their design and we are designers. We have 20 years of professional experience and we wanted what was best for them. We tried to deliver something that they loved. [redacted] must remember that her mother did not respond to my emails for several weeks and then said she was having email problems. Again, we do not feel it is fair to give ALL of the fee back the them. They have already been refunded the $650.00. We have spent many, many hours trying to appease these two women to no avail and the fact that they kept changing companies was not our fault.
