Initial Business Response /* (1000, 5, 2014/12/16) */
*** *** did hire me for this job on contract with one progress paymentThe job was to take two weeks
He made one progress at the end of the first week
Tuesday of the second week his only complaint was that the tile was not
lining up perfectly at the cornersI told him that most tile laid the corners are not match perfectlyI said if he was not happy with the tile (Tiled back wall and part of one side wall) that he was more then welcome to get someone else to do the tiling and he could call me back to finish the job and deduct the tile labor cost off the balanceHe said OK to thatHe asked me to remove the tile and I did even though I did not see any problem with itHe never did call me back to finishHe asked for an accounting of the work paid for the following day and I sent it to him
Since he paid me for the first installment for the first weekI would suggest that if he thinks he has losses then to take them out of the two days of the second week that I worked and did not get paid for them

Initial Consumer Rebuttal /* (3000, 7, 2014/12/19) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The response from this business is not acceptable for the following reasons:
- As outlined in the original complaint, there were many concerns with the tiling beyond uneven corners, and these were discussed at the time
The response also did not address the other issues in the complaint:
- Improper securement of new bathtub
- Missing parts in bathtub plumbing causing leakage to apartment below
- Improper and unsecured installation of new shower plumbing
- Joining of drywall in between studs by using scrap tin and wood, and screwing into the drainage stack
The $payment was a requirement of the contract, and it was paid in good faith after three days of workNo where in the contract or verbally was it ever implied that the money was to cover labor for any specified period of timeThe "accounting" of the work provided did not give any detail on hours or costs
***
The reason that he was not called back to complete the job after *** we did not consider the workmanship satisfactory to perform any other work in our home
There are plenty of pictures available to support the complaint
Final Consumer Response /* (4200, 11, 2014/12/30) */
(The consumer indicated he/she DID NOT accept the response from the business.)
***
In response:
***
-Tub was secured - yes, improperly
- The missing part was a gasket in the bathtub drain which the plumber found during his inspection
- Shower valve had backing, but was not secured to it
- Flattening an inch piece of unsecured aluminum stud to hold two pieces of drywall together seems like a questionable practice
- I agree that screwing into the plumbing stack was apprentice-likeI can provide picture if required
- There was no reason for any insurance claim as the leakage was found by the plumber before any damage was caused - the tub had not been used in the interim
- The business was not called back as I did not feel the quality of work was adequate to complete the job
Final Business Response /* (4000, 13, 2015/01/06) */
How was the tub secured improperly, the directions call for a wide pan head screw or a screw with a washer to be secured just above the edge of the tub
Some manufactures i.e.*** metal tubs supply clips that goes over the edge of the tub
I have done enough showers and tubs to know to use the gaskets
There is only one rubber gasket that comes with the kit for the drain and one rubber gasket for the over flowI put them both on
This is what I think happened, the plumber or his helper while pulling up the tub knocked off the rubber drain gasket and it rolled under the floor so they could not see itThey found another one in their tool box and used that
Regarding the *** *** shower valve, even if I was having an off day and missed securing the valve to the backing, I could secure it at any time even after the tile was installed with only two screws
"Flattening an inch piece of unsecured aluminum stud to hold two pieces of drywall together seems like a questionable practice"
The most common place you find this:
is repairing a hole in drywallA board or flattened steal stud is put behind the hole and only secured to the drywall then a patch piece of drywall is cut and put into place
I did not do anything wrong in installing the drywall, it was not falling off the wall, it was not loose, and I did not screw into the stack
There is nothing wrong with the tile that I was installingYou asked me to take it down, I did

The Drywall
There were numerous problems with the existing drywall, no melcor butting up to the windows on the window returns, missing studs in the corners, drywall sitting on the floor, device holes that are to big to cover with a cover plate, screws in the drywall that are put in to deepsheets on the ceiling and walls that are not staggeredWhen I told her about the ceiling I showed her that the majority of the screws were through the paper and that the ceiling should be boarded correctly since there were places along the wall where the drywall was not screwed toThe only place that did not have board was the stairwell, four small walls at the bottom of the stairs and and the framed in support postI had boarded most of these areas but did not get a chance to finish screwing them

Saturday morning came around and I was getting ready to go back to her place to workI was completely in disbelief when I received the following text message
"Hi *** I need to talk to you about your estimate before you proceed with any more work as its a lot higher then what we verbally agreed on and the is when my trust with contractors breaks down."
"Consider this text message as notice that you are not to enter m premises until we come to an agreement in the morning"
She asked for all my business legal even my drivers licence which I know I don't have to provide, but I did anywayThe only thing I could not provide was a red seal certificate to say that I was an electricianI explained why I did not need oneShe then said she wanted me to provider her a copy of my red seal carpentry certificate, when I was not even framing her basement other then fixing some of the existing framing for drywall.
I felt at this point she did not want me there at all and was using any excuse to keep me out and not pay meI went to her home and picked up my stuffShe never said one word to me about the contract or said there was anything wrong with the quality of work
She did however send payment when I only requested half, which came to - roughly, of the original contract price. She said would send more, but that never transpiredI will write off the difference as a bad dept.
I never sent any nasty emails. The only thing I ever said to her is that I believe this is how she gets work done on her house for freeOther then that I have been very professional in responding to her, and I am prepared to sit down with a Revdex.com representative and bring up all correspondence from my email account on *** to prove thatI have also saved every text message with her as well.
July is the last time I emailed ***, sending her what I had been doing for the five days that I was there
I have no idea to this day, why she became so angry and now vindictive.
There really is not any reason for this
About me,I always try to be fair with my clients and work with them when changes need to be doneI have only had one other complaint since I started this businessI don't live paycheck to paycheck and never ask for money up front on a job. One can always find cheap contractors, but you won't find better quality then what I provide. When the electrical inspector came, he came to do a final. I explained the situation to him telling him that I believed that whoever had the last rough in inspected proceeded to add more after the inspection passed. I persuaded him not to charge for the reinspection. He said he would not charge for the inspection and would cancel the current permit and that we would have to get a new permit for the rough in. I called an associate to pull the permit for me. I spoke to the client after about my concerns with the drywall in the main room. That the drywall had been install incorrectly. It was sitting on the floor and the inside corners were not framed right . I told her that both of these could cause problems. I explained to her that moister can wick up into the drywall and cause mold, also that the drywall can buckle from the floor heaving. The corners would crack easy since their is lack of support on one wall coming in. After the inspection I proceeded to start boarding the stairwell. She told me to give her a quote on reboarding the room. I told here I would redo the contract. I took measurements and told her it would be an additional 1400.00. She said okay. I told her I would just revise the existing contract. On the website, it was indicated that the fare will not be debited until the trip was completed. However, contrary to this mention, my credit card was immediately debited ( 9.45 AM, according to my Citibank record ). Not only that, the amount debited was $120, which is much higher than the price announced.

In addition, when I got to the airport, the driver, upon my asking, indicated that the tip was not included, so I gave him $15 in addition to the $120 already paid. I ended up paying much more than what I was supposed to. The fact that the increased amount of $120 was debited from my card right away caused me problems : my credit card was refused for another payment as I had not anticipated that NYC Limousine would debit the card immediately.Desired Settlement: That NYC Limousine apologize and - at least - refund the difference between what was wrongly debited and the figure mentioned on the website.

Review: I would also like to express the level of quality of the vehicle which was less than optimal. The air conditioner did not work appropriately, nor the heat. We were sweating to our location and freezing on the way home. The blue-tooth did not work as well. Also, the driver advised us that the gratuity included (which I revealed to him the receipt at the end of the ride) did not go to him. Although he was cordial, his driving had much to be desired. I would like a supervisor to contact me regarding this matter.Desired Settlement: I attempted to dispute this via [redacted] unsuccessfully. I wanted a partial refund for a service was provided; however extremely undesirable.

Review: From the minute we stepped into the vehicle we were concerned that the driver was not fully alert. As we travelled on our companion had to continually talk to the driver to make sure he stayed awake. We felt that this behaviour put our safety at risk. When he wasn't almost falling asleep he was texting. We were so concerned we insisted the driver stop at a service area and we offered him coffee and then rang your office. We tried to organise alternative transport but was unable to arrange this so we travelled on to Philadelphia as planned. The driver mentioned that he had been working until the early hours of the morning and this concerned us greatly. When I went to pay for the trip and advised him we would not return with him he became abusive and used profanities which I was absolutely appalled with. I was very upset and shaken by the whole ordeal as were my three companions. The day was ruined. I would also like to bring to your notice the state of the vehicle and the driver. The vehicle had not be washed or vacuumed and the overall presentation of the vehicle was sub-standard. This was booked many months ago and after numerous telephone calls and emails I was assured that a high standard of service would be delivered.Desired Settlement: At the very least I would expect to be fully refunded for the entire trip due to the anxiety and fear for our safety that this ordeal caused.

Response:

The customer asked to smoke in the limousine. The driver explained them politely that smoking is not allowed in our vehicles. This made them extremely upset. This driver has been working with our company for 10 years and has flawless record.

Response:

Thank you for your email. We strive to provide our customers the best possible service. For over twenty years, we have been serving thousands of tourists from all over the world. They are visiting our wonderful city and bring with them their customs and expectation, and we are happily trying to accommodate them. When the driver didn’t allow [redacted] to smoke in the limousine, she become very abusive! [redacted] told the driver that she paying a lot of money for the trip from New York City to Philadelphia in a stretch limousine and that she expect him to let her smoke in the vehicle. The driver explained [redacted] that the amount of money she is paying has nothing to do with our policy and the law which prohibit smoking in TLC vehicles. The driver agreed to stop on the way so she can get coffee and smoke without extra charge.

It is disappointing to read her allegations about the driver’s behavior which do not correspond to the driver’s customer service record. He has been working with us for 10 year with flawless record.
