Problem statement: Failure to refund a pre-payment, failure to act in good faith, failure to engage in dialogue.

We hired the company (OC Painting) to paint our house on December 24th and left them with a $1000 (as they requested) for a a $2900 job to be completed on December 27th. We are in the process of selling our home. We called OC Painting later that same day (by 5pm) to cancel the job. The company understood that this was a cancellation - they never came to the house, tried to renegotiate or otherwise see if the job was still active. We called them initially because of the tight schedule (later we sent a letter- see below). Note that the receipt we signed did not indicate anything about forfeiture of payment etc. Nothing of this nature was disclosed on the phone when we cancelled.

To our surprise, we noticed that the company had cashed our personal check. When we learned of this, we immediately called and asked them to refund it. Nobody picked up the phone so we left a message. To our dismay, we have called over 10 times, written 2 letters and visited their premises. The company will not engage us and seems content to withhold our money for no valid reason. We note that they have not provided a rational position for withholding the money; in fact they have said little to nothing at all.

The problem is worsened because the owner, [redacted], claims to not speak English and always says we should call back later to talk to [redacted], who does speak English. (Assuming [redacted] even answers the phone at all). This cat-and-mouse game has grown tiresome and it is a clear attempt to stall and not resolve the issue at hand.

Two times they told a relative of ours that a check was coming - but no check was delivered. Multiple times we have requested that they call us to discuss, but they refuse.Desired Settlement: A full refund of our deposit check is desired.
