Complaint: ***
I am rejecting this response because:Bruce Tall Construction can't seem to get their facts straight and that is the reason this complaint has been filed. In this most recent response, the business claims the insurance paid for one side and the consumer paid for the other sides. That is not a true statement. Bruce Tall construction acted on my behalf with the insurance company on the damage done to my home due to hail damage. I do have emails where the business contacted the insurance company in regards to the damage done to all sides of the home. The insurance company did cover the home on all sides and approved the work to be done. I never showed signs of not wanting to pay. We were waiting on the insurance company to pay, it is stated in the contract that the only portion that would be my responsibility is the deductable which I had already paid. I kept Bruce Tall construction informed at least weekly via email or phone call while waiting for the insurance company to cut the check. I do have the emails and can provide these if requested. Funny that he thinks I was going to be dishonest and even if I was we both know there are recourses he could take to get paid which he did take advantage of by putting a lein on my home.In the most recent response the business claims they replaced the fascia. This was part of the original dispute, the fascia was not replaced. It was stated in the contract and is in the invoice, but this work was never done. The business claims they were not hired to reattach the phone line. That is absolutely untrue, I have an invoice from the title company showing I released money to Bruce Tall construction to do this work. The city code and state code may state that ice and water is required, but I have an email from Carl S*** (Bruce Tall employee) with the insurance company stating that ice and water would not be done. The attached signed contract and agreement states that the Fascia is to be removed and replaced, painted on the front, back, left, and right sides of the home. The attached email exchange between me and Carl S***, an employee of Bruce Tall Construction, confirms that the fascia work replacement is to be done. The attached email; Carl S*** followed up with the insurance company and he confirmed via email that the insurance company had accepted the bid "to do everything along with fascia work on front, Right, Left, and Rear" of home. Attached is the insurance confirmation of insurance to accept bid including fascia for entire home. Also, includes an email exchange between Carl S*** and Dan Helms that the garage was not going to have ice and water shield included in garage roof. I was charged for this work. As Bruce Tall indicated, $of this was refunded, but there is an additional $is owed. The attached invoice dated May 4th, shows I was charged for the "R&R of Fascia" for Front, Right, Back and Left side.I was unable to attach the invoices, but they have been previously attached in the original complaint
Sincerely,
*** ***

MrTall, it appears my facts are straight and there have been no accusations made. If you have evidence to support that my facts are not straight then please provide. Sincerely,*** ***

To whom it may concern,   We were working off his claim paperwork for the work needing done and covered by insurance. We also worked on behalf of [redacted] to get the rest of his house covered for painting. Were only two sides were covered. There was no damage to the garage so insurance wouldn't cover with paint. Knowing it would not match we did the garage at no charge Dean. We completed the work that is listed on invoice. Upon completion [redacted] had left Billings and was in process to sell 1136 Yale Ave. He called us or emailed about us fixing the end of house gable vent areas. They had not been damaged from the hail storm and were not covered in the claim and we had not put them into the contract to be fixed so we declined the work. [redacted] also began bringing other items up that he felt we should have covered. In a way to try and satisfy [redacted] we told him we would discount our invoice $400 to be done with him. He agreed and we got the check from the mortgage company. The new home owners were told by [redacted] that we were to fix the vents. Talking with the owner Bruce Tall told them they should put the amount of $871.90  into escrow to have vents fixed which they did. It was not part of the hail claim.  We did not here from the new owners. We did not do the work. We did not take the money. It is still in escrow as far as we know. We tried to satisfy Mr. [redacted] and tried to treat him fairly. Please let me know if I can get more documentation or answer other questions.    Claim Amount:  $16963.00 (see invoice) Disputed Amount: $871.90      Thank You,   Carl S[redacted]
