I am rejecting this response because: [redacted] engaged in deceptive business practices by violating [redacted] Property Code. She withheld our deposit and did not provide an itemized deduction list within the required time frame of the law. On the day we surrendered the property she said she was remodeling the home and we did not need to do anything to clean/repair it. She came with her father and husband ([redacted]) to measure for carpeting and new appliances. I have text messages proving such. She then signed a glowing review for us for our next landlord, which I have kept for our records. It was when our deposit was due to be returned she changed the story and said we mis-managed the property and we were not due the deposit. She violated the [redacted] Property Code and now owes us three times the amount of the deposit + our attorney's fees we will be using in court. 
According the [redacted] Property Code 92.109 the landlord who fails to provide the deposit or itemized deduction list within 30 days of the tenants' surrender forfeits the right to any portion of the security deposit. 
Sec. 92.109. Liability of Landlord. (a) A landlord who in bad faith retains a security deposit in violation of this subchapter is liable for an amount equal to the sum of $100, three times the portion of the deposit wrongfully withheld, and the tenant's reasonable attorney's fees in a suit to recover the deposit.

In responding to this complaint, I would like to give you a brief...

understanding of our company services and history.   Keeping our good reputation and clean record with the Revdex.com is critical, so as the [redacted] and [redacted], I do not take these frivolous allegation lightly.   I am also prepared to escalate this issue though Civil Court if necessary.
 
Owning [redacted] has 3 divisions and extensive experience in the Real Estate services.

Owning [redacted] Management , LLC - manages over 60 doors
Owning [redacted] Construction, LLC   - remodeled hundreds of homes
We run a best of class, full service [redacted]age with great referrals and repeat business.    We have had tenants that have leased from us for over 9 years in the same properties.   [redacted](my [redacted]) is without a doubt one of the few property managers that truly cares about her tenants and takes care of business.
 
We accepted this tenant as you can see from the attached lease agreement.   We always use the promulgated forms from the [redacted] Association of Realtor.   We lease the property below market value and at a low security deposit because we were led to believe that they would maintain this beautiful home and abide by the strict HOA requirements of one of the premier master planned communities in [redacted], **.  Plus the complaints husband is a [redacted].     In addition, the tenants ask if they could eventually purchase the home.  
 
We also requested that they fill out the Property Condition Report recorded when they moved in.   The home had been remodeled so it was in excellent condition.   Feel free to ask for all the receipt, estimates, invoices and checks paid out to contractors before they moved in.
Secondly,  we would be happy to send you all the marketing photos of what the home looked like when we leased it to them
Part of the agreement was that they would maintain the yard.    This was an issue as we continued to get complaints from the HOA and fines (feel free to request HOA notices which include pictures of the tenant's violation)   The property management paid the fines but were not reimbursed by the tenant. (hundreds of dollars)
Attached is the after pictures after they moved out.   It is more than obvious the level of damage and items left behind that we paid services to remove. (The TAR lease agreement is very clear on this subject)
Also attached is the receipts, invoices and payments to contractors needed to get a new tenant into the home
This does not include the extended time lost in rents due to the work needed.
[redacted] also helped the tenant by giving Landlord verification to the [redacted] in [redacted].
Last but certainly not least, see attached photos of the property after they moved to [redacted].
