Oak Creek Whitetail Ranch, LLC., not a guide service. It has nothing to do with a guide service. His invoice is for a hunt at Oak Creek Whitetail Ranch, LLC, he is scheduled to come and hunt October 5-7, 2015. His invoice is for a deer hunt at Oak Creek Whitetail Ranch, LLC not for a guide.
Mr. [redacted]'s hunt in 2014 was set up the same way. It was for a deer hunt he did not know the guide at that time, he met his guide upon arrival at Oak Creek. He was perfectly satisfied with his hunt so he rebooked for another hunt this year in 2015. We are staffed with plenty of other guides that are more than capable of guiding our clients on their hunt of a lifetime.
Mr. [redacted] heard of one of our employee's termination in a Newsletter that was sent out to all of our clients to update them on all of the things that were going on at the ranch. Oak Creek has been in business for over 23 years and has never had this type of complaint against us. We take it personally. We thrive on making sure that all of our clients are 100% happy and taken care of while they are hunting with us. We are fortunate to have a great staff. Like any other company, on occasion there are changes that have to be made for various reasons. Mr. [redacted] was the only person to contact us and tell us that he did not want to fulfill his contract with Oak Creek Whitetail Ranch, LLC because his guide was no longer available, as a matter of fact we had just the opposite response. People book their hunt of a lifetime with us for the deer harvested not for the food, the accommodations or the guide they spend a total of 3 days with. I am not saying that the guides don't do their best to follow our guidelines and accommodate our clients but they are here for the harvest not the guide. It was not necessary to contact any of our clients about any of the changes made to the ranch. Things like this happen all of the time. We have more than enough guides that are able to take care of him. We would like the opportunity to take care of Mr. [redacted] as we have in the past. Now if Mr. [redacted] is having financial problems or some other issues he needs to call us so we can discuss his options.
He claims we did not notify him when one of our guides was let go but the question I have for Mr. [redacted] is when Walmart terminates a cashier or greeter are they responsible for contacting all of their customers? No they have other employees that are more than capable of taking that persons place. We are still the same hunting ranch and are more than capable of taking care of his hunt. We are a seasonable business and rely on our bookings from August through January for the upcoming year. Mr. [redacted] cancelling at this late of a date will be almost impossible for us to rebook those dates, thus the reason for the non refundable deposit.
Mr. [redacted] has not received his "guide services" as of yet because his hunt is set up for October 5-7, 2015. We have a full staff of guides that are perfectly capable of satisfying Mr. [redacted]'s deer hunt. Mr. [redacted] did not know his guide from 2014 until he arrived for his hunt. That is generally how our hunts are taken care of. You meet your guide when you arrive. We are still holding Mr. [redacted]'s hunt dates and will continue to hold his dates.
We have been in the hospitality business for over 23 years and have always had the same policy, non refundable deposits, with no issues but most people are easier to work with than Mr. [redacted]. We have always booked whitetail hunts not guides. We have never had an issue like this arise and have always taken care of our customers. The guide Mr. [redacted] is requesting is no longer employed by Oak Creek Whitetail Ranch due to reasons I would not want to discuss here. But Mr. [redacted] has to understand there are many reasons why employee/employer relations don't work some times. Some employees get caught stealing, some employees can not arrive on time, some employees get caught drinking on the job or show up drunk, some employees cause so much chaos in the work place that other more valued employees are not happy so they have to be terminated. There are so many reasons that an employer is forced to terminate that employee, not saying any of that is the case here but there are reasons. While employees are very important to an employer, sometimes it is better to sever that relationship. Mr. [redacted] is a valued customer and we are only asking for him to let us continue to give him the experience of a lifetime.
In reference to the UCC "Impossibility of Performance" and "Specific Performance" Nothing has changed with Mr. [redacted]'s hunt he booked. There is no contract between his guide and Mr. [redacted], only a contract between Oak Creek Whitetail Ranch, LLC. and Mr. [redacted]. Now if his guide/Oak Creek Representative promised him something I do not know about or that is not on his contract, then Mr. [redacted] needs to discuss that matter with me but as for "Performance", we are the same ranch and same product he booked last year, that I might add he was content enough to rebook again this year. After all he met his guide/Oak Creek employee last year through the company and only spent 3 days with him tops so I am sure any other guide is more than capable of taking care of any of his needs. I believe Mr. [redacted] has other issues and is not wanting to be honest.
Just because you sign an agreement with [redacted] for cell service and that employee is terminated does not void [redacted]'s contract with you.
Mr. [redacted] needs to learn to talk to people and he will get better results but to put holds on credit cards and turn a trivial matter over to Revdex.com is not necessary. In over 23 years of business I have never had a negative response from a customer to Revdex.com or kept someone's deposit. It has always been worked out but since Mr. [redacted] has gone to this extreme and put a black mark on my reputation, I will fight this one to the end due to Mr. [redacted] actions and attitude. Mr. [redacted] called with concerns but never told me that he wanted his deposit back he just went straight to an American Express dispute and a complaint to Revdex.com. If he would have given me a call and discusses it with me it would have never turned into this.
