Our Director of Sales contacted the potential borrower to discuss the loan. He was instructed to only call his cell phone. He called the cell phone and left a message. Our Director of Sales wanted to verify the addrress to which to send the decline letter. The Director left a
detailed message and as of today, Mr*** has not returned the call. The Letter was mailed within the days of decline. We have attached for your review the attached Decline Letter. We would be more than happy to re-send to Mr*** As you can see, we did comply with all request and as such would appreciate the complaint being removed. As to the latest statement from Ms. [redacted], we beg to differ and would like to point out that none of our issues brought up have been addressed. However, we will respond as follows:
1) "The Account Registration Form, Deposit Account Control Agreement and assignment of a loan number is a process that is completed prior to loan review" - if this is the case, why is our denial letter dated prior to these forms being executed? This would have negated the need for a Commitment Fee of $2500.00 in the first place.
2) "as this complaint was the first time we heard of any concerns as alleged by Mr. [redacted]." - we followed proper channels, first initiating phone calls as well as emails to our Loan Processor, Isaac [redacted], to no avail. There was never any return contact from anyone from Oak Street Funding and irregardless of whether this was the first time hearing about our complaint, they had an opportunity to right their wrong. They have chosen, instead, to continue in this manner which only cements the fact that this company operates by deceptive means from top to bottom and beginning to end.
3) "We believe through our responses we have demonstrated that Mr. [redacted]’s claim has no merit;" - this has absolutely not been demonstrated whatsoever as you have not addressed, in specifics, any one of our concerns, questions, proof, etc. and with regards to that, address the following:
 
a) Why is the Agreement and Account Registration Form dated after our denial letter which would have negated the requirement for the Commitment Fee of $2500.00?
b) The Loan Summary dated October 28, 2015 clearly shows there is to be a "deposit refund" of $2500.00 which was prepared by Isaac [redacted] and previously attached as evidence.
c) Breach of your own confidentiality agreement, which is now a new and very serious issue that will be addressed further
 
We have submitted numerous documents, proving that the tactics used by Oak Street Funding are anything but above board. We are like any other consumer and not in a position to simply give away $2500.00 without first being assured this loan would be approved. We are also not the first to initiate a complaint against Oak Street Funding for the exact same reason and if they continue in these practices, we will not be the last. The only resolve that we will accept is the return of our Commitment Fee of $2500.00.Regards,[redacted]
