series of events that led up to the complaint in a clear and concise manner that helps her and others understand our position. The long and the short of the situation is that the tenant owed back rent and electric bills from the start of tenancy in October We continually had to send late notices and then when that didn’t work, we had to make phone calls which would result in payment, but days later and then always partialMost complexes would have never allowed such violations to the set forth lease agreement that was signed upon move inThe lease agreement states, “If rent is not paid when due, Owner/Agent may issue a 144-hour notice of non-payment of rent on or after the 11th day of the rental period or a 72-hour notice of nonpayment of rent on or after the 15th day of the rental periodFailure of Resident to timely pay any other amounts due Owner/Agent is a material non-compliance with this rental agreement.” We knew that she had a child and in good conscience couldn’t kick her out and continued to work with her well past what we should havePlease also realize that during the duration of tenancy, we graciously only charged one late fee because we knew that she was obviously struggling and didn’t want to add to her balanceThe balance also included the electricity bills as mentioned aboveThis is not procedure as electricity is transferred from the complex name into the tenants name upon move inThe tenant was not able to open an account in her name so we kept it in our name and added the monthly bill to her accountThis again proves that we were more than sympathetic to said tenants plight and worked with her during her stay. Now that we have established our landlord/tenant relationship, let’s touch on the complaints that were lodged against usThe first being the “threats” that she is accusing us ofI want to first ask this questionIf you went to the grocery store, loaded a cart full of groceries and just walked out of the door without payment, wouldn’t you expect some sort of consequence? The threat of arrest surely comes to mind, doesn’t it? Now, put yourself in our placeWe have a tenant that has a track record of late and partial paymentsWe had to remind her to, all but one time, pay rentIt is standard procedure to occasionally have the manager go around to tenant’s doors, in the morning, to inquire of the rent balanceThe previous manager was a large man and we can understand why it might have seemed intimidating to have him loudly knocking on the door early in the morningThe “threat” was not of bodily harm, but to pay or quitAgain, what should the consequence be for somebody who won’t pay rent willingly? Shouldn’t we be allowed to give them the option to pay rent or be given a notice to quit without being accused of being threatening? We are truly sorry if she felt scared by the previous manager’s presence and wish we had known at the time of her concerns and fearsIt was only known to us at the time of the Revdex.com complaint letterThe second “threat” was after the tenant gave a day notice, but hadn’t paid any rent and owed a balance which totaled over $1,The current manger sent her a letter that stated that if she didn’t pay the balance within a day timeframe, that she would be issued a hour noticeShe came in at that time and was upset over the letter and at that point refused to pay the balanceThe complaint of being threatened of having the Sheriff come in and “forcibly remove her from her apartment” is a dramatic replay of a conversation as the Sheriff’s Department is involved in the process of hour notice She and her family were in no way threatened to be forcibly removed if the hour was not givenAgain, there was no threat of bodily harm and/or any other harm toward her family Let’s touch on the second complaint of being sent to collectionsWe sent a bill out with no response from the tenantThe tenant should have also taken responsibility in this matter as she knew she owed back rentNot to mention charges for removal of abandoned property as furniture was left behind that had to removed and storedThis was brought to her attention by a letter sent to her current address, a phone call with a voicemail and a notice posted at her door here at the complexUnfortunately, we didn’t hear from her again until she received a call from the collection agencyThis matter could have been resolved if there was a reasonable conversation had over payment toward the balance owedAt that point we could have come up with a payment planThe only way now to rescind the balance from collections would be to have the tenant willing to pay the balance in full. Our reputation with the rental community precedes us with how well we take care of incoming and residing tenantsWe pride ourselves on conflict resolution that accommodates both landlord and tenantWe are truly sorry if she feels like she was threatened by or not taken care of by the staff here, that was never our intentionWe feel like we have fairly stated our defense in a true and fair manner and hope that you find this tooPlease let us know if you have any questions with said matter
