response to the complaint from *** *** (***) attached you will find
the contract from this job. I will address these complaints numerically
and give summary at the end 1) I will agree that Mr *** did request
from my crew and myself about removing the rocks, which
were rocks that the
majority were along the back fence to fill the gap and many were buried only
exposing a small portion of the top. I explained to him that rock haul
off was not part of the bid and that it would cost extra, to which he became
agitated and asked me how much. However at the end of the job, I bit the
bullet, told my guys to load up the rock and lets just go. I personally
watched my guys load approximately wheel barrow loads of rock from his back
yard as I was addressing other things2) As far as uneven fence, the
pickets go with the hilly terrain of yard, which is standard3) The
complaint about not enough concrete is unfounded. There is TWICE as much
concrete than in the original fence posts. Each hole is 26-inches deep
with a full bag of concrete in each hole where galvanized metal posts were
installed. He complained on our Facebook page that we cheated him
concrete and gave his neighbor too much. I will agree that his neighbor
was given too much but he was not shorted. I arrived back at the job site
after my crew had installed the majority of the neighbors posts to find that
they had put more than in the hole. I explained to my crew that we
put full bag of concrete in each hole and that would leave 2-inches of dirt
on the top for grass to growA) can't set pickets correctly on a ball of
concrete B) It looks much cleaner with grass around it. To which my crew
got, and continued on with my preferred method. If extra concrete was
wished for, it should have been requested 4) Nailing into a knot hole,
happens when using a pneumatic nailer. If Mr*** wanted screws, it
would have been provided at an additional cost due to materials and labor cost.
As far as warped pickets, we don't make the lumber, however we do make a
concerted effort to remove any pickets that are grossly out of line. When
ordering pickets for fence jobs, they are delivered by the pallet and not
sifted through so we do on site. There were a numerous collection of
pickets that were culled due to being split or grossly warped or crooked
5) As for the cursing of an employee on site, 1st of all he is NOT a
friend of my son's and has ABSOLUTELY no bearing on this WHATSOEVER and had it
been brought to my attention at the time it DEFINITELY would have been
addressed PERIOD!! Mr
*** left a star review to which I responded to on our Facebook page and I
asked him why he didn't call me and that you would think if you had a problem
with a business that you would allow them an opportunity to take care of the
issue. Then he responded with a response close to his complaint to
Revdex.com. Mr*** including in his comments about his disability, though
obvious, did not come up in conversation with me on the job site and it is my
opinion only added here to "sauce" up the comments is disturbing to
me!! Especially since I observed him this past weekend maneuvering a festival
here in town with ease. Only if Mr*** knew me or my company and how
much volunteering and support myself and my company spend on handicap, youth,
food banks, habitat for humanity etc and how there are many people out there
that are in worse situations, he wouldn't play that card as much!

I am rejecting this response because:
Please forgive my late reply but I had surgery on my ankle and partially amputated foot on Friday morning so I'm just now getting back to being able to think clearly.As for my response to *** *** dba Oak Creek Construction, he never finished the job that we agreed onThroughout the job I reminded his crew as well as himself when he was actually supervising them or doing the work himself that the rocks that had been left along the bottom edge of the two sides of my fence needed to be hauled away due to my physical inability to do soWhat little debris was removed did not fill one entire wheelbarrow and nails, old wood, plastic from the nail gun that was used was left behindThe gate is poorly constructed and doesn't work well at all, partially because there was not enough cement poured into the post holesThis was covered up with rocks and a little dirt in order to hide the problemI had the dirt and rocks that had been dumped on top of what little cement had been used in the post holes at the gate removed because I couldn't figure out why the entire gate section was so loose and discovered what had been doneThere are several places on the gate where the nails don't go into the boards behind them and just stick outThe bolts on the gate hinge were screwed in at angles and don't hold everything together at square, causing it to warp and be difficult to closeThe cross brace two by four is not secured to the middle with anything, just one nail as each endThere are several boards, both fence boards and 2x4's that are split, chipped and should have been discarded but we're used anywayI relied on Mr*** to do the repairs we spoke about before and during the job and he verbally indicated that it would be doneNow he goes back on his word and states that it was not part of the contractIs cleanup after the job an extra charge or is it implied? I asked, reminded and stated that the rocks and building debris needed to be cleaned up and hauled away numerous times and was never told that it wasn't part of the contractI relied on Oak Creek Construction to do these things and was taken advantage ofMr*** never gave me a final receipt or any notice that he had completed the job nor was there a final review of the work done on my fence to see if I was satisfiedHad there been such a review then Mr*** might have even seen the split fence boards, the warped boards, the unstable nails through the knots as well as the fence boards or pickets as he called them that were only wedged in place and had no nails, screws or even glue to hold them thereFinally, Mr*** seems to imply that my disability is not as limiting as I have explained, stating that he saw me "maneuvering quite well" at a local festival here in New BraunfelsI would ask him to produce proof that he has the necessary medical training, experience and credentials to render a professional opinion on my condition and how he arrived at that conclusion, specifically by either consultation with my health care providers or by review of my medical recordsI am looking at having to pay another thousand dollars or so to not only have my fence completed but the added expense of the labor involved to tear down, dig up and deconstruct all the mistakes he and his crew made along with new materials that will be neededThere is labor involved to remove the construction debris that was left behind, as shown in the pictures sent to the Revdex.com which I am physically unable to accomplishMr*** and his crew knew that fact, which is now subject to even more medical restrictions after Friday's surgical procedureI will be using a knee scooter for the next to weeks, making it impossible to even go into my yard, front or back as the scooter only rolls on a hard surface.Oh, and *** *** was the one who told me, specifically that the tall guy on his crew was a friend of his son and had been homeless, along with saying "give him a break." He was the one who constructed the gate right outside of my bedroom window while using profanity loud enough for me to hear inside of my houseMr*** failed to supervise his employee, review the work that he had done or made any attempt to assess the level of satisfaction I as the customer had in the building of the gate*** ** ***
