I am rejecting this response because:
Absolute total fabrication, The Police Department did recommend that the solution would best be handled in small claims Court and therefore per this we can procede that direction . I will NOT change anything in my original complaint as this man is totally dishonest and given his prior complaints of aggressive behavior towards patrons I will not ever re-enter this businessIn fact his response is out right delusional. Should he wish to return my property which he can return it to my address on the work slip, as I have not changed addresses as he asertainsRegardless of wheather or not the property is returned I will not change any item of my original complaint as people should know what type of outfit this propiriter runsSince the owner informed me he no longer had my property I have replaced it using a reputable shop in neighboring TurlockNo intimidation regarding a Court , or Lawsuit will change what I feel other patrons should realize before doing business with this 'Gentleman"

On may X XXXX I put a 121.79 dollar deposit on a Glock 23c gun. Oakdale guns and ammo ordered the gun when it came in it was the wrong gun.They tried to make me take it and when I told them I didn't want it they were upset. I told them to oreder the right gun to call me when it arrives. I didn't feel right about the purchse after that so I went to a reputable gun dealer and bought the same gun for 140 dollars less. On may 28 2013 they call me and tell me my gun is ready that it is going to be 30 dollrs more. today 6/4/2013 I go in there and ask for the total on the gun and it was 729.99 I bought the same gun at the other place for 569.99. when I asked why I was being over charged the shorter gentlemen slammed the gun case and walked off the taller gentlemen started yelling at me using vulgar language and told me to get out. I told him I would to give me back my deposit that's when he jumped over the counter put his hands on me and threw me out. I have a police report XX-XXXX city of oakdale. Desired Settlement: I want my 121.72 deposit back. I would also like to make sure they are a legal business because they also were trying to sell me a 15 round clip gun and they are not legal in California. I just want them to be held accountable for their action's I am a veteran and my spouse too and I don't think we should be treated this way

This letter is in response to your corispondence dated 6-24-13, Mr.[redacted] has violated regulatory

requirements in the process of buying a firearm from Oakdale Guns and Ammo. He provided the model # and discription of the special order firearm and then refused to cooperate in the resolution and return of the incorrectly ordered firearm. We considered at that time no harm no foul, even after he had provided the wrong model and style in his request of the first firearm. To help accommodate the customers need we

then ordered a second firearm . During this transition Mr [redacted] searched the local market for the best price he could muster, then complained that we had not been fair with the price he approved at the time of reorder. Mr [redacted] showed little restaint of a very short temper displayed to our employees and to me as the owner. At that time it was necessary to request Mr. [redacted] contain his emotions and anger or be

escorted out of the store to insure separation of grasp and control of any near firearms. Mr [redacted] declared at this time he would not leave the armory and refused to budge. We then proceeded to firmly but respectfully escort Mr [redacted] from the store. We called Oakdale Police Dept. to record the icident.

OPD dispatch stated Mr. [redacted] is on the other line as well..

Furthurmore after the dust had settled, we called Mr. [redacted] and told him to come to the store

and pick up a refund of 128.34 (his deposit) and asked he not returun in the future. No response, nor were we surprised . We at this time consider this case disputed and closed. We also would clearly note there are people who should not be in possesion of firearms even if they are not in a prohibitive class, which is also reserved to the dealers descretion. We will consider this matter closed. We will also not be sending copies

of this communication to the Department of Justice, we would not want them to construe this as obstuction of justice on your part as a third party.

You can turn this to make me look like I was in the wrong with your well thought easy you wrote. The fact is you own a business and your customer service is execrable. It was that last 30 dollars that you were trying to squeeze out of me that made me check the going price on the gun. I showed a short temper, you guy slamming gun cases and jumping over counters is your way of showing restraint. I should not own a gun , I am a war veteran with two tours to Iraq. You were armed and you put your hands on me like a bully it is you sir that should not have a gun. You ordered the wrong gun it was your incompetence. I have proof too I took a picture of the first gun you ordered clearly showing the wrong model. To any body reading this who would like to see proof email me [redacted]@yahoo.com. I wish you would turn this into the department of justice, Please due. Make sure you do not delete the footage on the cameras. You still have my deposit and you consider this case closed. I will be putting a judgment out on your business if I do not get my deposit back. I will never set foot in your over priced under stocked size of my closet thing you call a gun store ever again. More like a good old boy hang out than anything else. You have my address how do you want to handle this.

Review: I purchased two guns from them, then was denied from the DOJ so the purchse became voided and I am having a nightmare of a time trying to get a refund

I purchased the 2 guns 3/14/13, I bought a pistol and a shotgun. When I asked about qualifying with the stae [redacted] the store owner asked me several questions all questions I had said no to. I did tell him I had a few problems when I was a kid about 43 years ago and was told they were minor and they wouldn't be a problem. I was approved by the state DOJ for the purchase at first and when I went to pick up the guns he had forgot to put the 2nd gun on the regerstration. He wanted to charge me an additional fee for his mistake and I said no, it was his fault forgetting the 2nd gun. So he ran the same paperwork back thru and added the second gun. For some reason the 2nd time was denied. So according to the DOJ the sales has been voided that was about in a months time. I went thru several appeals with the DOJ but they would not listen to the appeals. I needed to hire a attorney to fight my appeal and went back to the dealer to get a refund to help me pay the costs. I was told to read my reciept or he called it his contract. Which states he gets a 25% re-stocking fee and the balance of instore credit that would have been about $1583.70. Well the only thing they sell his guns and ammo and a few other things basically all pertains to guns. So I said ok and when he figured my credit amount he deduct storage fees, fees to fill out my paperwork with the state that was wrong anyway and the 25% restock and then also my sales tax I paid. My purchase price was $2,147.18 and he would issue me a bottom line credit for $917.64. I was nice with him but after I left I said wow how can he do that. By him doing that he breached his own contract so I wrote him a letter explaing my position and asking for a full refund, that was on 10/9/13. I received a phone call from [redacted] (Owner) today 10/15/13 @ 10:30 am and was told he has denied any refund period and if I came in his store he will have me arrested. I don't think any business anywhere should be able to operate this way. In lieu of going to a large store to purchase the guns I thought I would buy local here in Oakdale where my place of work is but I guess next time I will go to the larger store. After all this has happened I now find out he has done this before, has been taken to small claims court etc. It's my opinion this store has terible business tactics and has a total disregard for his customers. Why does a gun dealer tell you that you have to purchase the gun prior to qualify with the state. When I signed the receipt I thought I was signing to show I was paying for the guns, I did not know I was signing a contract telling the store they keep my hard earned money no matter what. The store should tell the customer in advance to signing that their money is not refundable and I bet not to many people will buy there. From what I hear from friends that this is one of the only stores that does this.Desired Settlement: I want a full refund now, they breached their contract by adding on a bunch of other fees and also not refunding me even my sales tax. The owner told me that he had paid the tax that quarter and he's not going to have to fight with the tax board to get the money back. But the purchase was voided by the state DOJ a month after purchase, which was not the end of the quarter. also I don't believe I should pay the fees for the paperwork they sent in at first wrong. I am asking for a full refund of my money which is $2,147.18. As I stated the store is very small and 95% of their inventory is guns and ammo which I can't buy. also I was told I cannot enter the store although their was no ill words spoken when I was in the store. and now knowing the store owner if I was to return for instore credit he would increase prices so high for what I could by, I would have problems. The money I used I had saved for this purchase and I feel has though this is my money not his to dictate to me how it should be deligated and used.

My name is [redacted], I am the propietor of Oakdale Guns and ammo. I am attaching copies of a

complete unconditional release of all claims signed by Mr. [redacted] for your records. Mr. [redacted] is a convicted felon and or is in a prohibited class and may not possess firearms or ammunition in California and most likely in any other State. He knowingly (convicted Felon) tried to subvent the federal and State laws by applying to the background check system (Calif. DROSS ) that alone is fraud. Nevertheless our invoice which Mr. [redacted] signed in both senarios clearly releases us from all claims. We will include copies of this document. We will consider this matter closed We will also not be sending copies of this communication to the Department of Justice, we would not want them to construe this as obstuction of justice on your part as a third party.

Review: Left a Forearm off my Browning A-5 for repair in a split portion of the wood. Owner, [redacted] informed me that the repair cost would be 35.00. This was over a year ago and after repeated calls inquiring about the process I went by the shop and spoke with the owner who informed me that "You came and picked up the forearm, because you did not want to wait any longer". I informed him that I did not and asked to have my property back at which point he told me he now longer had my property. Receipt of drop off and theft report made with Oakdale Police Department.Desired Settlement: Give me back my property or replace it .
