Per our website listing and [redacted] listing, the buyback guidelines are: In order for the Buyback Guarantee to apply, all guidelines below must be met: If you're not 100% happy with the car, we'll buy it back from you.Vehicle must be shipped to the buyer, vehicles picked up in person do not qualify... for the Buyback Guarantee.Seller must be notified of the return within 48 hours of vehicle delivery.Only applies to vehicles purchased at the asking price and "BuyItNow" price through ***.Vehicle must be shipped back using Seller's own shipping. Buyer is responsible return shipping charges.Any damage (cosmetic or mechanical) caused in transit, delivery, return of the vehicle or while in the buyer's possession will be the buyer's responsibility.Restocking fees apply.Dealer to dealer sales do not qualify. Of the above, this purchase did not fulfill #4, where it is purchased through [redacted] at the asking price ($12,995) including either shipping OR warranty. In Mr. ***'s case, we included shipping as well as the warranty for that price, as well as upgraded the warranty from a $600 policy to a $1,200+ policy at no extra cost. When these factors are considered, the vehicle no longer qualifies for the buyback. Even though the vehicle did not qualify for the buyback, we still offered Mr. [redacted] the option for us to buy the vehicle from him. Since we are BUYING the vehicle back and not RETURNING it, the vehicle had to be registered to pay the taxes due. Mr. [redacted] asked us to buy the vehicle back without him paying the taxes. This is illegal and we refused to do so. Once Mr. [redacted] registered the car, he sent us an e-mail saying "you have to pay me before I ship the car back and you are buying the car back 'as-is.'" This does not match up with the agreement that we had, that payment would take place after the vehicle is in our possession and we inspect the vehicle (per the buyback guidelines). Once Mr. [redacted] refused to follow the procedure we agreed on, we were no longer interested in purchasing the vehicle from him. We offered to help Mr. [redacted] even when we were not obligated to, we spent countless hours communicating with him, 100+ phone calls, 80+ e-mails but he did not want to proceed following our agreement. At this point, we are no longer interested in purchasing the vehicle.Update: As of 2/13/2015, we are completing the insurance paperwork per Mr. [redacted] request as he has decided to keep the vehicle.

Mr [redacted] contacted us regarding the vehicle and asked a few questions Before driving to Houston to see the car, he paid for a 3rd party inspection (which are notoriously rigorous) and upon seeing satisfactory results, he decided to place a non-refundable deposit and drove to houston to pick it up Upon arrival, he said "I didn't know this car has a manual transmission, I don't know how to drive a manual transmission" although this was clearly stated on our website as well as the 3rd party inspection report he received We still wanted to help, so our salesman Mike actually spent 2+ hours with him on the backroads near our place of business to teach him to drive a manual transmission After successfully learning to drive a manual transmission, he came back to the dealership and said "my girlfriend doesn't want me to buy it." After we told him that the deposit is non-refundable, he said "the car has scratches that were not shown in the photos." Given that this was the 3rd or 4th excuse he's given to get out of the sale, we were firm that the deposit is non-refundable.As Mr [redacted] stated, he has already filed a chargeback with his bank and they ruled in our favor after seeing the attached document He clearly agreed that the deposit is non-refundable, regardless of any other factors If he hadn't gotten a 3rd party inspection, it would be a different story But the condition of the vehicle is not the true reason he didn't want to buy the car, it was his indecision and influence from his girlfriend, a personal matter that we are not concerned with

Mr*** was initially interested in purchasing a vehicle from us After he found a more suitable option, he contacted us to purchase a service contract on said vehicle We drafted and executed the service contract (through *** Warranty) on 10/21/and sent him the contract
In December, he contacted us stating he never received the contract and for us to refund him After forwarding the email we previously sent him that included the contract as an attachment, he thanked us for re-sending it A few days later, he cancelled the contract with ***.When Mr*** purchased the contract, we disclosed to him that the contract is non-refundable, as per our policy Moreover, both Credit Card Authorization forms that were signed by Mr*** (attached) clearly stated that the transaction is absolutely final and non-refundable Regarding the partial refund policy, *** suggests that we refund the whole amount; however, it is at our discretion whether to refund any amount, if anyAs previously stated, our policy is clearly shown on the signed document and Mr*** agreed to this prior to us drafting and executing the contract.Please note that Mr*** has already disputed the transactions with his credit card issuer and, after presenting proof that the transaction is non-refundable, they reversed the chargeback in our favor We incurred $326+ in credit card fees alone (interchange fees, credit card rewards fees), which is why we do not issue refunds on service contracts We are willing to offer a partial refund equal to our original cost on the contract

These statements are absolutely untrue - the vehicle was delivered on 12/19/2014, buyback agreement was sent on 12/ It was at this time that you requested more time to have the vehicle inspected and we agreed that we will allot that time, however, this would no longer be a buyback case as it's past the buyback deadline (12/22/2014) You returned the buyback agreement on 12/26, that's days after delivery, not days per our buyback terms In regards to the imperfections in the vehicle, we have addressed these issues in our previous response, please revisit our previous responses This vehicle was sold as-is In regards to buying the vehicle, we are no longer interested in purchasing your vehicle

Nothing in their reply disproves anything I have said. Nor do they address a single grievance. This is their 3rd reply with no substance and no attempt to dispute the facts that I have laid out. In this response, they accuse me of making untrue statements, but don't give a single example - because they can't.
They have not addressed their deception regarding the warranty company, nor their failure to disclose problems with the car. Just because they sold a car as-is doesn't give them the moral right to deceive. It definitely doesn't give them the right to clear a check-engine light before they take a picture of it for [redacted] (assuming that a sensor doesn't go bad during transport).
I believe I made a mistake about the amount that I have spent to repair the car so far. It was closer to $300 than $500 - just to set the record straight.
Other than that, I request a direct example of anything I have said or written that is untrue.
