[redacted] I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. As stated in my original complaint, my wife and I were held liable by [redacted] as the owners of record according to [redacted] records at the time the car was towed. This is entirely due to the failure of Ocean Auto "to complete all necessary documents, as needed, to transfer ownership as required by law." In addition to the monetary costs, the ongoing process of dealing with the ***, [redacted] ***., and now the [redacted] has been enormously stressful and time-consuming. I have no wish to take on the additional burden of resolving this dispute through the legal system, but if Ocean Auto continues to show no interest in bearing their rightful responsibility in this matter, I will have no further recourse but to file a claim in small claims court. Regards, [redacted] ***

Due to  Mrs.. [redacted] situation we were forced to go with a finance company that charges a very hefty acquisition fee. We informed her that...

she had 10 days to find her own financing and we would be able to reduce the price of the vehicle. Her credit union was only able to loan her a certain amount that was lower than the agreed upon price. We also could not produce a different contract for her without her signatures since she was already driving the vehicle. Upon her not coming into sign a different contract we assigned her to one of our finance companies. That finance company has certain stipulations that she agreed to with her signature on the legal contract. None of those stipulation, i.e. paperwork was ever received and the contract was returned to us. We also were not able to contact her for several months. There was never any monthly payments received. After the course of 5 months with no contact and no payments received we had to repossess the vehicle and Mrs.. [redacted] was not able to produce any payment since. We are understanding and do everything in our power to facilitate a successful financial contract with our customers. We cannot however give our products away for free and have to abide by stipulations put down by the banks and finance establishments. In short we lost money and Mrs.. [redacted] received a vehicle to drive around that was never paid for.

When I purchased the vehicle I asked if there were any outstanding recalls -- and I was told NO.  Incidentally, last week I went in to Toyota to have the recalls attended to.  They called later, asked me to come by asap.  I did and was told that they did the recalls; BUT there was so much wrong with the vehicle that it would take thousands of dollars to make it road-worthy.
Toyota bought the Toyota matrix from me, leaving me in the hole for around $6,000.  However, now at least I am driving a small vehicle which won't break down; will not need a vast amount of money thrown into it; and most of all, I WILL BE SAFE.  I'll still be paying for this new/used vehicle for the next five years or so.
The decent thing for Ocean Auto to do is to send me a check in the amount of $5,500 (which is only part of the money I gave this despicable company in the first place).  They should be ashamed of themselves.  They put me into a vehicle which could have killed me.  Also, Revdex.com should make sure that the business is closed down.

We however had no choice but to reposses the vehicle when we were not able to have any communication and we recieved zero payments for the vehicle from the customer and found the customer had moved out of state. The process of getting our merchandise back still took several months after this and cost us quiet abit of money. Our goal is to help our customers with good vehicles and re-establishing their credit, this process however does require our customers to work with us and the financial institutions to fullfill the stipulations of said institutes and make the agreed payments. We also try to be flexible and help fullfil those obligations and payments in any way possible. However after an unreasonable time of no communication and never recieving any monthly payments we are obligated to return our merchandise just as with any other business that does not recieve any payment. We are more than willing to try and assist this customer in getting into a vehicle at any time.

I reject the response from Ocean Auto which included no reference to the complaint I submitted. The statement they provided is erroneous for the following reasons and im attaching facts , information and various resources to prove my side. 1.  I was approved for the loan by my credit union the second day of the allowed ten days to obtain financier.  They offered the high KBB value which was only 800 less than ocean autos listed. Since ocean auto agreed to deduct 400 for bad tires and the 2 factory recalls I had to take to be resolved which wasnt disclosed to me considering it was a major saftey recall, the negotiation seemed good. The paperwork and underwriting from my bank was ready so they personally called ocean auto while I was there . My loan officer (whos info ill attach) spoke with wally and he accepted their offer, the bank also stated their offer was to be 100% of all owed, which again he agreed. When they asked him to fax them the new contract so they can send them the money, he refused and wanted me to come to office to sign. When I went to office they were only going to rewrite contract upon them receiving the difference and taxes and tags so about $800.2.  I was not able to obtain 800 by the 10th day so I was left with the choice to take a personal loan and pay towards ocean autos lenders. I came into their office accompanied by a friend (whose info I will attach) gave them a total of $1200 towards car and and they informed me that one of their lenders will contact me , but couldnt provide me with the banks information because they werent sure. the finance percentage of their lender was 25% as to the 10% my credit union had me at. I felt this was why they wanted me to go with their alleged lender3.  I never received an approval from any lender or credit inquiry in which I received from [redacted] and [redacted] from my recent visit car shopping. If I had a payment due I was waiting for a bill statement and I thought then it would show who to send payment to along with finance rates and stipulations of agreement .4.  I contacted Revdex.com after not receiving lender info and was suddenly bombarded with emails from wally saying payment due and to make payment to him. When I asked where my statement from bank lender is, he said theydont send statements (attached his email statin this). Under the advisement of a Revdex.com agent along witht th e advisement from dmv investigator, it was not right and to not give payment til I was provided with the information im legally required to request and inwhich ocean auto by law must provide.5.  As per the 40 plus similar complaints (attached is list from yelp of complaints) I believe many complaints should be reviewed by Revdex.com as the high number of complaints seems illegal

As stated in my original complaint, my wife and I were held liable by [redacted] as the owners of record according to [redacted] records at the time the car was towed. This is entirely due to the failure of Ocean Auto "to complete all necessary documents, as needed, to transfer ownership as required by law." In addition to the monetary costs, the ongoing process of dealing with the [redacted], [redacted]., and now the [redacted] has been enormously stressful and time-consuming. I have no wish to take on the additional burden of resolving this dispute through the legal system, but if Ocean Auto continues to show no interest in bearing their rightful responsibility in this matter, I will have no further recourse but to file a claim in small claims court.
