I am rejecting this response because:
What is wrong with you people????!!!!
It is not about a late fee, and it is not about what is in the note.
I challenged that provision twice with your representative [redacted], and he assured me it was simply an administrative provision to get the mortgage going, and that it would be set to my needs in April 2016.
If this had occurred, as stated twice by Mr. [redacted], we would not be having this back and forth.  No other mortgage interaction I've had has insisted on this cut and dry demand.  They worked with us to get
the mortgage in place to their satisfaction and our ability.  We are not asking you to waive the fee.  We are asking you to let us pay in full on  June 17th - as you promised - and set the schedule to every other Friday.  We are able
to pay timely scheduled payments, if you let us set up the agreement tomorrow.
What policy are you referring to when you say you are not able to make this concession that Mr. [redacted] said would be no problem?  Is it in writing?  I'd like to see that specific portion of your mandates.  I was
told by Mr. [redacted], that the owner could waive this provision.  You'd think it would be done because of the misinformation we received from Mr. [redacted], in proof that no fraud was intended on his
part when  he clearly advised me that I could wait until April 2016 to set up a payment schedule to my required specifications.  I said to him on several occasions, that if this was NOT something
your company could provide, I DID NOT WANT TO CONTINUE WITH THE RE-FINANCE!

Review: I initiated a refinance with Oceanside Mortgage company in March of 2014 and have yet to receive a refinance. I was told it would take, at the most, a couple of months but it has now been 6 months and the company has not refinanced my home. They cite problems with the VA yet when I talk with the VA personnel they state all is well with them and that the issue lies with Oceanside mortgage. They were very friendly and helpful at first but soon after paying for my home appraisal, which they said they would reimburse me for and handing over copious amounts of personnel information, communication and progress on my refinance slowed then stopped. I am concerned this company may be a scam and have implemented security protocols as a precaution due to the amount of personnel information this company has on my family and me. I have been in contact with both the VA and Oceanside mortgage to which both sides are pointing the finger at the other.Desired Settlement: If this company in legitimate then I would like to have my refinance concluded by the end of September 2014 at the agreed upon rate and terms along with the home appraisal reimbursement.

Attached please find a copy of the "Notice of Value" we received from the Department of Veterans Affairs. A copy of this document was also sent to Mr. [redacted] directly from the VA. Item 7 indicates that the borrower must provide "evidence that use of the private road or common-use driveway is protected by a recorded permanent easement or recorded right-of-way from the property to a public road, and that a provision exists for its continued maintenance".

We have contacted the VA over 10 times to try to get them to remove this condition. Unfortunately, they will not remove it. We would be happy to proceed with Mr. [redacted] loan application if this matter could be resolved.

We take borrower privacy very seriously. All of Mr. [redacted] documents are protected under our privacy policy and I can assure you that we have no gain by retaining them. Further, we actually paid for Mr. [redacted] appraisal in the amount of $400. There would be no logical reason for us to accept a loan application and pay fees on the borrowers behalf if we were trying to take advantage of Mr. [redacted] in any way.

We would love to help Mr. [redacted] if he can clear up the issue with the easement. Unfortunately, there is nothing that we can do. The issue lies with the VA. The VA is unwilling to insure the loan, which means we would not legally be able to originate and close this loan as a VA loan. I believe the title company that was processing the transaction for Mr. [redacted] offered to prepare and record the required documents which would clear up the issue. Please let me know what type of resolution Mr. [redacted] would like. I would be happy to help in anyway that I could.

Review: I recently did a streamline FHA refinance with Oceanside MortgageMy previous mortgage company collected and paid a Water and Sewer Assessment (commonly called a "Front Foot Fee" in [redacted])I mentioned this to my loan officerWhen the day of settlement came, this item was not listed in the loan documentsI called him and he stated that I could call their load servicing department after the paperwork was submittedI called the loan servicing department and they said if it wasn't on the loan paperwork there is nothing they can doI talked with a manager about this and he stated he would gather some information and call me backFrom that point on, both my loan officer and the manager ignored all of my calls or were mysteriously out of the officeThis company has poor customer service after the loan is processed
Prior to closing, my loan officer returned every phone call without hesitation, but as soon as the loan was closed and I needed help they became non-existent!!! I even called the manager and left a message stating that this was the 5th unanswered call and that I was becoming upset and that it was bad business practice to ignore a customer's callI still did not receive a call.Desired Settlement: I desire that Oceanside call me and make the necessary adjustments to collect the additional funds on a monthly basis into Escrow and pay the Water and Sewer Assessment as they do with Taxes and Homeowner's Insurance out of EscrowThis Water and Sewer Assessment is a Priority Lien against a property and is satisfied before the lein on the Deed of Trust and is not a frivilous charge that I am asking that they pay, but rather a legal lein holder on new homes in newer communities in [redacted]

I am rejecting this response because: I was told that prior to closing that I could call the Loan Administration department and they could have the item included in my loanWhen I called, they told me that it could not be added, unless it was part of the original loan documentation (HUD-1)The Loan Administration department told me to talk with my Loan Officer, who has ignored my calls ever sinceThis is the reason I am rejecting the response, because I have been run in circles and have called multiple times with no repsonse, not even a form letter stating that they are addressing my complaintIts as if I dont' exist and they want me to simply go away

Review: I was quoted a different price on refinancing my condo. At the beginning they said it was an seamless process, it turned into a nightmare. I gave Oceanside all the info they requested. First the bank statement wasn't good enough, so I gave them my account info electronically and that wasn't good enough, then they wanted me to go to the bank again. then I had to get an escrow balance because Oceanside is not competent enough to get it themselves. The list goes on and on. Nothing they said was followed through on. The closer came to my house and didn't have any documents, then I had to wait 9 hours until another closer could come. Bottom line is Oceanside doesn't follow through on their promises, and there mail info sheet was not accurate claiming to be an "easy" process. I would not recommend Oceanside to anyone.Desired Settlement: I want Oceanside to follow through on their promises.

They had committed a interest rate of 4.25% No Points No Costs loan 3 months back but now they are saying that they cannot give the loan once all the formalities including the underwriting of the loan is completed. I had lost the opportunity to refinance with others because of this.

I have also spent months following up and working with Oceanside Mortgage now.Desired Settlement: Need the loan to be approved with a interest rate of 4.25% No Points No Costs.

The business committed thru email (attached below) that the rate had been locked at 4.25% for this transaction. They also said that in case the rates went down that would be passed on to the customer.

They had also provided the Good Faith Estimate confirming the 4.25% (attached for your reference). This was also confirmed in multiple emails and discussions with [redacted]. We can also refer to these recorded conversations if needed.
