I signed a contract with Oceanview Builders, Inc on May 14, 2019 to have them renovate my kitchen (replace kitchen cabinets, install new lighting, etc.) and gave them 50% advance payment ($6,800). After going through a longer than expected process to obtain approval from the Condo HOA and permits issued from the city on December 9th, 2019 we discussed starting work sometime after the Christmas Holidays. Since then, I have been trying to get the contractor to give me a firm start but without success. It's been excuse after excuse including the latest which involved his plumber needing to get the main shut-off valves replaced in advance of the major work, But, neither the general contractor or the sub (the plumber) have been able to start. For the past two weeks I have been calling, texting, and emailing but no response or resolve has been obtained from the general contractor or the sub contractor (plumber). In fact, when calling both the office and cell numbers I noticed the message has changed from a professional greeting to none at all. The General contractor is in breach of contract for lack of response and follow through on the services he was hired and paid in advance to do.

Desired Outcome

Refund I want to cancel the contract made with this general contractor and get a full refund for the $6,800 advance payment (at a minimum). It's been over 8 months trying to get this GC to perform this rather simple kitchen renovation. I have been prompt and diligent in every requirement that I have had to complete but the GC has not and I cannot continue to wait to get this work started.

I have communicated with the client at all times. We have the permits and are ready to begin. I was supposed to give him a start date once he made sure that the two main valves were replaced by the condominium as this was not part of the scope of work contracted. Customer had to make arrangements for maintenance to take care of replacing the main valves of the unit or have a licensed plumber do so. The plumber I have is only responsible for the plumbing work in the kitchen which is sink and ice maker line. I told customer once the valves are replaced I can give a start date within two business weeks.

Thanks for sharing the companies response. I agree with the company that we discussed having the main valves replaced in advance of starting the kitchen renovation, but I disagree that I was the one left with the responsibility to replace the main valves using my buildings maintenance department since I communicated to him via text on November 6th 2019 (see attached picture of text sent Nov 6) that "the maintenance guys don't do the valve replacements like I thought. They say it has to be done with a plumber contractor. So my question to you is how much would you be able to do this for?"
After multiple attempts (see attached picture of follow up text sent November 18) to get the company to respond I received the following response on November 18, 2019 (see picture of response text from company on Nov 18): "1,000 Sorry my phone is acting up since Friday Yes need to have checked but I don't 4 hours to wait for them to check lol."
We texted a few more time to coordinate his plumber to come by the apartment to assess the valve replacement, submit required paper work with the association and coordinate the shutoff and start date but nothing was done by either plumber or company. See attached evidence of 2 attempts via email sent with the forms needed and instructions on requirements for water shutdown coordination. Both times (in November 2019 and most recently in January 2020) the plumber and company failed to follow through on submitting the paperwork and request the shutdown. Despite more attempts by phone, text, and email neither the company or the plumber followed through. This is why I have submitted my complaint and I stand by my request to have my money returned to me due to company's lack of follow through. I have wasted 8 months already and I don't want to waste anymore time, energy or money on this company.
